Bart management began negotiating with two unions representing about 2,500 people april 1st. Workers went on strike for 8. 5 days in early july and Governor Brown had a 60 day cooling off period that expired last thursday. Then there was a 72 hour strike notice issued. Workers may walk off the job in less than 24 hours right now. Bart may come to a screeching halt tomorrow morning with 10s of thousands of people forced to find another way to work. Bay area buses, ferries and other transit options are standing by for tomorrows commute. But the question is can they handle the load . We turned to former mayor willy brown who has actually been on bart negotiations. Our question is when you come in as a official do you put pressure on one side or both sides and how do you work that . Well, you really dont apply pressure either place. You go in and talk about how rational the total decision will be with these components and then you start to process them. I am hoping everybody buys in the the thought. How do you knockout the irrational. The last time you went in to settle a bart strike they were screaming about everything, from the pay raise, to whether or not bart should pay for raincoats for people that work outside as as opposed to people that work inside. Phil, what you really have to could is go in with a sense of humor, period. You also go in with your own reputation on the line. You go in with your relationship with the riding public and that you sell more than anything else and you get rid of the debris quickly. Okay. How much do you have to so, you are basically i would say at this point turning to bart and saying come up with one or two more percent on your offer and they are telling the unions knock off some of your requests and get real. Is that it . You dont say it exactly that way. If you say get real, you may insult somebody. Most people think their recommendation is the best of everything. You have to be very careful, very clever, very political and very sensitive. Egos become almost a component of the ultimate settlement. Do deadlines help or hurt . Well, deadlines help because people cant seem to quit until there is a deadline because they just want to keep the fight going. Absolutely. It takes on a life of its own. You cant give in. Right. And i always find it interesting, you know they are heading for the big sell when the talk goes from the deal to we will just have to avoid a strike. When that becomes more important than anything else. And that becomes important only because the public has said no strike. So, how do you go in and say you will make it good with bart to cover this increase . Well, you can go and address things like the training program, the safety program, the Inspection Program there are a number of thing that is you can do with state dollars that you cant do other places, freeing up local dollars. Here is one thing we can both know that will definitely happen. No matter how this turns out you will be right back here in four years. Possibly. However, if quality leadership is out there, phil, they will start the process of establishing guidelines for a conclusion long before the critical strike day. It is so frustrating for the people caught in the middle. Hundreds of thousands of people. Right. And this is also the time where they Start Playing the shell game. We want to settle this so there isnt a strike, isnt a strike, and you start hearing this back and forth about the actual deal. That is because what they start doing is saying all right, we will give you a raise maybe on your 3 or 4. What they tell the public is one thing and the union is another. They start moving things around in a complicated way, which already covering this deal is tough, right . Yes. Last week there is a situation where bart made a deal and the unions were about to agree to it, then suddenly there was a miscommunication. Or they say they will give them a 10 raise but use 7 of that to pay into their pensions. They will be paying into their pensions. It goes around and around in the idea of somebody saving face and trying to get the deal done. Either that or we wind up with another strike. And it affects so many daily lives. We are 16 hours away from a potential strike that could happen tonight at midnight. The two unions and negotiators are trying to head off the possibility. Contract talks will resume at 9 30 this morning. Overnight they have been analyzing the proposals on both sides and negotiators are hopeful of coming to an agreement. On thursday the atu and seiu postponed a deadline that issued a 72 hour strike notice. We will continue to follow these negotiations as they near tonights midnight deadline. We are still 16 hours away from a potential strike for bart and two unions heading off the possibility. Today we got an update on the talks. That a right. I sat down with zachary ma lay. He is one of the zachary ma lay. He is mallett. I can not say much about what is being discussed. We are working to the last minute and we schedule special meetings which require 24hour notice. That allows us the tonight to meet to discuss. Now, there has been a lot of talk about the health care plan, the wages for bart workers who are some of the most highest paid in the nation but i understand a few things under the table are not talked about too much. I would certainly say so. There are many supplemental role that is give expense to our workers. What are they . Some of those. Our train operators only do two round trips. For most of our eight hour shift worker, that equates to about 41 2 hours of actual work and they get paid their full 8 hour, so they work 55 to 60 of the time. When you apply that to full time quiff lensy at the end of the year the salary is 50. 37. Is that on the table, Something Like that . Why is that . No. Because there is no way we can recover everything in one contract. It appears bart continues to find itself in this situation in part because it doesnt change some of the fundamental rules in the contract. You cant train replacement riders until bart workers go on strike and year after year that stay in the contract. Why . There are a number of things hard to remove and the strike is used as leverage by our work force. Lets say that in the political environments, in the public environment we are very strike adverse when it comes to public transit. But the public doesnt like the idea of a strike or the threat of a strike, yet the question is bart in its history refuses to do anything about that threat. It continually allows it to be there and you are one of the few place where is if they go on strike there is not replacement workers. It seems like a onesided fight to the public. Well, our workers have a right to strike and we through our contract cannot forbid that. We forbid it for the length of the contract. But unlike most places if they go on strike somebody will come in and keep the trains rolling. You agreed as part of the contract if they go on strike you dont replace that right away. We cant. It requires specialized training which we cannot do during the life of the contract. So you keep yourself handcuffed . That is what we have had to do. The public has this idea of sort of they are frustrated with both sides. Umhmm. Certainly they are. I am, as well. But this is a long history and we cannot revolver everything in one contract. I would love to. It cant happen. It seems like it revolvers some things. One of things i noted, you are one of the few bart directors there are nine of you inspectly elected independently elected i instant what is it that is having you branded antiunion. Are you trying to break the union . I am not an antiunion person. I am pro union, but i am also pro fiscal responsibility and fiscally conservative but my fiscal conservative nature does not discriminate. I have been a voice for the unions to have internalized work. I regularly question staff when there is work that is externalled that i feel could be. You want to keep it here . Right. And it seems legislature was trying to strengthen the rules that forbid strikes in the future, but you dont think that will happen . What we will see is a move to bar strike, for example, like in San Francisco. Then the unions will go to sacramento and say we will agree with that but in tern we want these conditions put in that law. Dollars to donuts the democratly dominated legislature would pass those in there like they have other reforms as well that turn out for custom bettersome than the original idea, at which place Governor Brown would veto it and you end up right back where you start. All right. That is not a good place. It is around and around and around and that is why you end up with this situation time and time again. All right. We will see how it turns out.
