many are looking at the gop presidential candidates with a fresh eye. did rick perry do anything to damage his status as the frons runner? i'll ask newt gingrich about his performance as well. stand by. he's joining us live. plus, a brazen taliban attack on the united states embassy in afghanistan. some insurgents may still be on the loose now. we have new pictures and information coming from kabul and some top california politicians are trying to figure out what, if anything, is left of their stolen campaign war chest. a well-known democratic campaign treasurer stands accused of swindling more than a million dollars in campaign donations. i'm wolf blitzer. you're in "the situation room." rick perry may have walked away from his second presidential debate feeling battered and bruised. the tea party face off proved to be a very tough test for the texas governor. less than 24 hours after the republican candidate stood on stage with me in tampa, reviews still are coming in about governor perry's performance. joe johns is here. he's been looking closely at the hits and misses of what happened last night. >> at this stage in the presidential race, it's really not rocket science. the question is whether a conservative candidate like rick perry passed the test. did rick perry do what he needed to do in a debate with the rest of the field targeting him and angling to bring him down a notch? on social security, he is seen as doibl a balancing act on the third rail of american politics, reassuring seniors that social security needs to be fixed. >> slam dunk guaranteed. those individualing moving towards being on social security. that program's going to be there for them. >> at the same time, not backing down on his earlier assertions likening social security to a ponzi scheme. >> it has been called a ponzi scheme by many people long before me, but no one's had the courage to say, here is how we're going to reform it -- >> but for much of the audience perry is speaking to including social republicans and many in the tea party movement, some say the ponzi scheme language plays pretty well. >> i think he's right about social security and it being a ponzi scheme. basically, the retirees retiring now don't have the workers to pay for their retirement in the near future. >> on immigration, perry's record is seen as more moderate than some in the tea party movement would like, so once again, he stood his ground rather than backtrack. here, defending a program giving in-state college tuition to undocumented immigrants at a texas high school. >> we were clearly sending a message to young people regardless of the sound of their last name, we believe in you. >> perry took heat from others, but abandoning it would have been seen as a sign of weakness, at least right now. >> i think that tea party voters, republican primary voters are looking for a authentici authenticity. >> however, on the issue of perry's executive order of requiring schoolgirls to be immunized, perry said he made a mistake before he got asked about it in the debate. then when michele bachmann linked perry's decision to contributions perry had gotten from a pharmaceutical company, perry's denial left him open to questions. >> the company was merck and it was a $5,000 contribution that i had received for them. i raise about $30 million and if you're saying that i can be budget bought for 5,000, i'm offended. >> his response was i'm offended if you think i can be bought by $5,000. he needs to come out and say it. he needs to try to explain relationships and talk about government and fund raising and his role as governor. >> some of the republicans we talked to today said that while perry wasn't perfect, the biggest problem he's creating for himself could come in a general election taking positions that could be hard to defend in the event he gets the republican nomination. >> executions. it's a controversial issue because he's had a lot of them. it didn't come up, but that's potentially an issue. >> a huge issue because he's got a lot more executions coming up and he's already gone on the record and said, hey, i support the texas position. i support executions. we get it right in texas. a lot of liberals and people opposed to the death penalty are going to take issue with that, but this is a race for the republican nomination. and they're talking about the primaries. >> going to have a lot more on rick perry and debate coming up. thanks for that. more confusion about the republican primary calendar today. south carolina now is threatening to jump ahead of any state that tries to preempt its place as the first southern contest. the warning comes a day after the arizona governor jan brewer announced he's moving her state's primary up to february 28th. the move is in violation of party rules designed to ensure that iowa, new hampshire, nevada, north carolina keep their early spots on the primary calendars. stay tuned. this just coming in. president obama's disapproval ratie ining reaching a new high. check out our poll. more than half surveyed, 55% don't approve of the way the president is doing his job. 43% approve. the public is even more down on the president's handling of unemployment. his disapproval rating on that issue is 59%. all the more reason for the president to try to sell the american people on his latest jobs plan. he made the case to voters in columbus, ohio today. our white house correspondent, dan lothian, is traveling with the president is in columbus with the latest. dan? >> you know, over the last few days, the president's been talking about all the different aspects of the jobs plan. today, he was drilling down on education. some $60 billion in the jobs bill, not only to hire teachers, but to rehab schools. the message is twofold. first, explaining the bill and calling on them to put pressure on congress to pass the bill. a good education has always been viewed as a pathway to a good job. but president obama said investing in school buildings can also yield big rewards. >> there are millions of unemployed construction workers who are looking for a job, so my question to congress is, what on earth are we waiting for? >> ft. hayes art and academic school in ohio is wrapping up a multi-million dollar upgrade. the white house said this is an example of rehab prokts that could take place at some 35,000 schools across the country, putting hurrica putti putting hundreds of thousands back to work. >> every child deserve as great school and we can give it to them. >> it's an intense sales job by a white house that often deploys a less aggressive rollout and leaves the bill writing up to congress. not this time. >> this is the bill congress needs to pass. >> driven by a sense of urgency, aides said, the president hit the road after delivering his jobs speech last week. his early targets, key swing states. virginia, ohio and next, north carolina. >> there are no coincidences at this level of politics. there's a lot of strategy and surgical strikes. that's what the president is doing in today. >> but jay carney said this is not about the re-election campaign. >> reality is, as go the american people, so goes the members of congress in this case, so we have to keep focusing everyone's attention on this because it's vitally important. >> but republicans who have expressed an openness to aspects of the president's proposals still see a huge roadblock. how to pay for it all. >> president knows raising taxes is the last thing you want to do to spur job creation. he said so himself. yet that's basically all he's proposing here. >> now, senator mcconnell says that he believes this bill will have a tough time making it through congress, that it is just a political exercise. the white house position is now is too time to make some tough choices and they say the president will continue selling the jobs bill out on the road, even taking another bus tour. although we don't have details on that just yet. >> are huge crowds showing up for the president at these events like the one in columbus, ohio today? which used to be the case four years ago. are those crowds smaller? >> i think you're seeing a similar situation not only at some of the other events, but today as well, the number we were told in terms of attendance, 3,000 people here. it was sort of like a campaign rally. that's what it felt like because when the president talked to these folks and told them they need to put pressure on congress, they started chanting, pass the bill. so, yes, a very enthusiastic crowd here. what's really important is whether or not the president can convince members ov congress to pass the bill. >> dan lothian traveling with the president in columbus, ohio. thanks, dan, very much. one correction. the early states according to republican party rules start in iowa, then they move on to new hampshire, nevada, south carolina. south carolina instead of north carolina. south carolina. that's why arizona's decision today is causing some heartburn among the republicans. there were a lot of pointed moments and surprises during the cnn tea party debate in tampa last night. this exchange and the audience reaction caused some jaws to drop. >> he needs intensive care for six months, who pays? no, uh... you love watching your neighbors watch tv ? at ally, you'll love o raise your rate cd that offers a one-ti rate increase if our currentates go up. jack cafferty's here. >> rick perry went there. by wading into an ongoing debate about what to do about social security. unless you've been hiding under a rock, you know that perry referred to social security as a ponzi scheme, a monstrous lie and a failure. social security is perhaps the federal government's most popular program. millions of americans rely on it as they reach retirement age and calling it a ponzi scheme, perry is implying people are being duped by a massive fraud. those are fighting words, which is probably why he was walking back his comments. in last night's debate, perry said it was time to have a legitimate conversation about how the fix the program and in an op-ed yesterday he wrote, there was no mention of the words, ponzi scheme. here are the facts. social security's badly broken. program will continue to pay 100% of benefits promised until about 2016 -- there are only 1.75 full time private sector workers last year for each person getting social security benefits. governor perry sukts one way to fix the program is to raise retirement age. introduce means testing, which would limit payments to the rich and in the past, he has advocated for the privatization of social security. meanwhile, the other republican candidates, especially mitt romney pounced on it when perry comes talking about social security. romney referred to it as being over the top. a new cnn poll shows only 27% think social security is a lie and a failure. it's more than the fourth of the population though and overwhelming majority think changes are needed. is rick perry right to refer to social security as a ponzi scheme? go to cnn.com/caffertyfile and post a comment on my blog or post on our facebook page. wolf? >> people do that every day, jack. thank you. let's move on to another important story we're watching now. we're taking a closer look at nato forces. they're fighting back against a rather bold daylight attack in afghanistan. one of the main targets, the united states embassy in kabul, which is now on lockdown. let's turn to barbara starr. she's watching the story. a brazen daylight attack. what's the latest? >> you know, the u.s. and nato like to say that the taliban attacks aren't very effective. today, the taliban took nato and the u.s. on. straight on. under fire in a nearby building, nato forces shot back from the top of their headquarters inside one of the most secure areas of kabul. fighting raged for hours as insurgents launched small arms and rocket propelled grenades to attack not just nato, but also the power centers of the u.s.-led war effort. >> handful of individuals, five or so, wearing suicide vests were tibl move into a building under construction. >> at least four sites in kabul were attacked. three afghan police officers killed. no u.s. casualties. >> we will take all necessary steps not only to ensure the safety of our people, but to secure the area and ensure those who perpetrated this attack are dealt with. >> u.s. officials tell cnn they had intelligence that insurgents were preparing to attack kabul under the tenth anniversary of 9/11. susan malveaux said it had an impact. >> the grenades and weapons did not actually penetrate the embassy and some of these other very important buildings. the presidential palace and so forth, but they are striking at the heart of this powerful community and the security inside of this community and that has had a devastating psychological effect. >> the pentagon sought to down play the impact of the attack, but in his first public hearing, david petraeus warned very real threats remain in the region. >> even with its core leadership sustained significant losses, al-qaeda and affiliates still pose a very real threat that will recairo our energy, focus and dedication. operatives remain committed to attacks against u.s. citizens at home and overseas. >> and there are new questions once again about whether the cia is going too far in protecting americans. this all came up at the hearing. general petraeus, now director petraeus, saying the cia inspector general is reviewing the role of a cia officer now working with the new york police department to see if that program is appropriate. >> we're going to be speaking live with susan malveaux. she's in kabul. that's coming up in our next hour. does presidential candidate rick perry mirror president obama when it comes to the war in afghanistan? how do you protect seniors, balance the budget so much, so much goes for social security, medicare. >> but that's just a washington mythology. and anybody who knows anything about the federal government knows that there's such an enormous volume of waste that if you simply had a serious all-out effort to modernize the federal government, you would have hundreds of billions of dollars of savings. >> if you were president, would you work with the democrats assume ling they were the majority in the house or senate? would you compromise with them on some of these gut issue sns. >> when i was a young congressman, reagan taught me a great lesson if you have democrats in charge. that is to go to the american people on principle. have the american people educate their congressman. he used to say, i try to turn up the light r for the people so they will turn up the heat on congress. when we passed welfare reform, half the democrats voted yes and on a principle basis, i'd be glad to work with democrats on any office. >> all right, let's go to tampa, florida. joining us live, the republican presidential candidate, newt gingrich. good to have you back in "the situation room." >> always great to be back with you. you did a great job last night. >> oh, thank you very much. let's talk a little bit about last night because i want to go through some of the issues and see where you stand. i had this exchange with ron paul, the congressman from texas on a sensitive subject. a healthy 30-year-old young man has a good job, makes a good living, but decides you know what, i'm not going to spend 200 or $300 a month for health insurance. something terrible happens, all of a sudden, he needs it. who is going to pay if he goes into a coma? >> in a society that you accept welfare and socialism, he expecting the government to take care of him. what he should do is whatever he wants. my advice to him would be have a major medical policy. >> he doesn't have that and needs intensetive care for six months. who pays? >> that's what freedom is all about. you take risks. but congressman, are you saying that society should just let him die? >> no -- i practice medicine before we had medicaid in the early 1960s when i got out of medical school. i practiced at santa rosa in hospital in san antonio and the churches took care of them. >> rick perry said he was taken aback when he said he heard some in the audience say, yes, they should let this hypothetical 30-year-old die. what went through your mind? >> i thought it was a missed opportunity to make a very important case, which is that historically, we had charity. we had places that said if you're down on your luck, if you fail to be responsible, we will take care of you, but that doesn't mean that you're necessarily going to get a private mean. it doesn't mean you're necessarily going to get everything somebody would get who's been pru dent. i would say that that young person, if they're totally improvident. if they refused to buy insurance, if they've done nothing to be mature adults, yes, we're going to make sure they're taken care of. we care and we're sympathetic and compassionate. not because they've earned it. >> but that money should come from chartable organizations, not taxpayers? >> i personally favor the tax deduction for charitiable donations. i would prefer -- with medicaid, we've provided all sorts of money for the poor. this idea, you know, what's happened is modern liberalism has said if you don't have insurance, you can't be covered. that's not true. we can provide health care for the indigent much less than free health snurns. there are times we ought to look at whether free clinics are less expensive than a euniversal health program. whether nor ott having a program or hospitals is less expensive and delivers first rate care. none of the doctors who work in free clinics are bad doctors. but it's a recognition that if you refuse to be responsible, you refuse to take care of yourself, see the case you used. 30-year-old, has a job. perfectly healthy. refuses to be an adult, a good citizen. i'm not sure we owe them 100% of what we owe somebody who's done everything right and worked hard and paid their taxes and bought their insurance. >> another sensitive subject. governor perry's defense if you will of that decision he made as governor of texas to force 11-year-olds, 12-year-olds, to get a vaccine. although he regretted a fact to get it through executive order. you have a problem with thwhat e point he was trying to make? >> i think governor palin later last night had a very powerful point. she looked at the same program as a mother with daughters. she looked at the same program. she rejected it. i think she thinks that if parents want it, that's one thing, but to impose it unless parents opt out, she thought was going much too far and i'm very semp thetic to that. we don't need big government dictating to the rest of us and then saying, well, you always had a chance. sorry you didn't know about it. i think governor perry has a little more explaining to do on that project and i'm sympathetic to the point rick santorum was making, we ought to be very cautious about big government sben serening, particularly on a 12-year-old girl. >> what about his decision to allow in-state tuition for immigrant children of texas. what do you think? does he have the point there? >> you know, i thought there were two parts of that and i was a little sorry i didn't have a chance to get involved because in a sense, it all goes back to the earlier conversation about the 30-year-old you asked about. first of all, the idea that you have to have in-state tuition to get educated is nonsense. there are private universities. there's phoenix university. there are dozens of way to solve this. you could have said, well, you pay out a state tuition. there are a variety of things you could do, so it's not an either/or situation. i'm very simp thet cal to someone whose parents brought them here at three years of age. clearly, there has to be some path to get them to be part of america. i think that's got to be part of what we approach with reform, but i'm not sympathetic to idea that therefore we owe them the same tax break we give somebody here legally who is a resident. if you're a resident of oklahoma and show up in texas, you're not going to get the same break. we don't say in texas, you have to take care of oklahoma, louisiana, mississippi, new mexico. we say, it's your decision, but i don't think it's quite as clear as the governor tried to make it. and by the way, it's not about somebody's last time. that particular line is slightly goofy. the question is whether you are legal or not, the last name can be smith or my case, gingrich. it's not about your last time. it's about the status of legality in the united states. >> you and i did talk about what to do with the 11 or 12 million illegal immigrants in the united states. assume the border is secure. no problems with the border. what do you do with the 11 or 12 million illegal immigrants in the united states? >> i think if you have a secure border, if you've established that english is a official language, if you have a requirement for learning history in order to be americans and american history to be an american citizen and an effective guest worker program, which means it's probably been outsourced to american express, visa or mastercard because they know how to stop fraud, at that point, you've got to look at a new and much more creative solution for the people who are here. i've suggested looking at the world war ii selective service boards. some people here ought to go home. some immediately. other people, day workers, no ties to the u.s., probably should go home. but you have somebody who's been here 20, 25 years, they've been obeying the law, paying taxes. they're married, three kids, two grand kids, a member of your church. i think the local community's going to say not give them citizenship, that would be wrong, but we need to find a path to allow them to be engaged legally in america within a framework that does not jump, but does recognize that person has real ties here and there be a greater human cost to tearing them out of the fabric of a society in which they've invested 20 or 25 years. i think we need local boards that apply a human approach. but that's tough with criminals and people who have no ties tos u.s. and should go home immediately. >> sounds to a certain degree like we're talking about, like you're talking about a form of amnesty. >> no, i'm talking about a form of legality which recognizes the raels that some folks are here and i don't think when you get down to it, people are very hard lined. you say to them, how many folks in your church are you prepared to go tear out of your families and ship out of the united states? i think you'll find people suddenly say, let's find a human, common sense, interimmediate step. maybe it gets involved with paying a substantial penalty because they have broken the law. and maybe that penalty is a function of how long they've been here and therefore on how much they've got to pay over time. but i think you want to find a practical, common sense solution within a framework of controlling the border, having a guest worker program and immediately expelling criminals and requiring people who have no ties to the u.s. to go back home. >> if you have a second, i want to take a quek commercial break. there's another question i need to ask you about national security. can you stay with us? [ crunching, sipping ] be happy. be healthy. can i try yours? it's time to bring our young men and women home as soon and obviouslily safely as we can. but it's also really important for us to continue to have a presence there cht and i think that entire conversation about how do we deliver our aid to those countries and is it best spent with 100,000 military who have the target on their back in afghanistan? i don't think so at this particular point in time. >> governor rick perry last night at the cnn tea party debate. it sounds like correct many if i'm wrong, he wants to get out of afghanistan a lot more quickly than you would recommend. >> i think we have to ask the military what's the most rapid rate at which we can withdraw from afghanistan safely, but i think we are drafting towards the most dangerous period in the middle east since the war of 1973. the turkish-israeli confrontation could become extremely dangerous. the iranian i think yesterday announced their first new nuclear reactor had gone online. i think people underestimate how problems with building rapidly and i think that the administration's decision to keep 3,000 troops in iraq is extraordinarily dangerous and indefensible. i think there are a lot of things going on and we need to review all our posture in the region. not just iraq and afghanistan. >> you think governor perry has the background, the knowledge to deal with these issues if he were president? >> i think governor perry a very smart man. he had military service. he is somebody who takes seriously understanding the military. has many friends. there are places the size of ft. hood in texas. i think he's a competent guy. if you ask me, if i had to choose between governor perry and president obama, it would be like 99-1 that governor perry knows more at a practical level about national security than president obama does. i am very worried and i believe that president obama's decision about iraq leaving only 3,000 troops there is utterly, totally indefensible and extraordinary dangerous. >> governor perry and romney? >> i like all of my republican friends. i'm happy to choose any of them against president obama, but none of them against each other. they're all my friends and i hope to work with them all in the future. >> one final political question. our latest cnn orc poll -- palin, who's not even in, 8 to 15%. ron paul, 12. you and hermann cane at 5%. where does your campaign stand? where do you assess your position in this race for the sfwhous. >> right now, we're where george mcgovern was at this stage before the nomination. where jimmy carter was before he became president. and at this stage in 2007, john mccain wasn't in the top two either. we are talking about substance. things that matter to the american people starting with job creation. every week that goes by, i think we gain strength in every debate we've been in. we have a lot more folks showing up at newt.org. >> i never thought i'd here newt gingrich making comparisons. that's not every day you hear that. >> got the nomination. >> thanks. >> they got the nomination as did bill clinton and then john mccain. >> good to have you back here. good luck on the campaign trail. former speaker of the house, annuity gingrich. in california, thousands of prisoners may soon be released. we're going to tell you why. this ason, you needtruck le e silvera to take on that list oyours. t'chevy season of ding. and there isn a tt time for a truck, with chk rk after mark of pe doing per. ♪ go yor chevaler today. get the truck and g that list done ♪ whether it can be done safely and responsibly. at exxonmobil we know the answer is yes. when we design any well, the groundwater's protected by multiple layers of steel and cement. most wells are over a mile and a half deep so there's a tremendous amount of protective rock between the fracking operation and the groundwater. natural gas is critical to our future. at exxonmobil we recognize the challenges and how important it is to do this right. at exxonmobil we recognize the challenges and how important it is ooh, the price sure doesn't. i'm tired of shopping around. [ male announcer ] get to a better state. state farm. but not in my neighborhood. ♪ [ female announcer ] we're throwing away misperceptions about natural gas vehicles. more of the vehicles that fuel our lives use clean american natural gas today. it costs about 40 percent less than gasoline, so why aren't we using it even more? start a conversation about using more natural gas vehicles in your community. let's get right to our strategy session. joining us, cnn politic. contributors roland martin and mary matalin. rick perry, did he help himself in a republican contest or hurt himself? >> he continues to be the front-runner, that's a good thing and a bad thing. the front-runner, you're in the bull's-eye. this is not rick perry's first rodeo. he's going to stand up and be a punching bag, pinata, because that's the nature of being a front-runner. he certainly didn't hurt himself. these things get analyzed instantly and they sink in, and what sunk in is that he's still the front-runner by substantial and solid margin, and there's a reason for that and it's his record in texas and it's he walks, he talks, and he looks and sounds like what conservative is and what should be and what the republicans are looking for. but this things far from over. we have many more debates and many more contests in front of us. >> he refused to walk way from some of the controversial positions that he had, positions that some of those tea party supporters aren't very happy about, for example, allowing that in-state tuition for children of illegal immigrants in texas or the vaccine for young girls, he didn't back way from that. he was firm. >> well, first of all on the vaccines he did apologize for not going to the legislature to get that done versus issuing an executive order, so it was very smart for him to do that. but, wolf, i'll tell you, it is wise for him to take this position because, once you have a reputation of being a flip-flopper and backtracking, then of course it hurts you. ask mitt romney in 2008. but here's the thing that governor rick perry must be very clear about and that is, one question can very well open a crack in your armor and let your competition in, remember in the 2008 race, senator hillary clinton was asked a question about driver's licenses for legal immigrants. she flubbed that question. that was the opening that senator obama needed to come in and that race changed after that one question. and so he's going to have to be strong, with some of his answers. but there's no doubt the bull's-eye is on his back. >> were you surprised that michele bachmann was as tough in slamming him last night as she was? >> no. i mean, she's been consistently discounted, myself she's more formidable a person and candidacy than the chattering classes have given her credit for. she got on that like a pit bull, but in the light of day, there are 41 states that have enacted or haven't enacted but had some legislative discussion on the vaccine and 28 states enacted isn't, minnesota being one of them about this is hardly on outlier extreme issue. in the enthat is not going to matter. it's jobs, the economy. where she did a better job, a great job, was her opposition, intensity of the opposition and eloquence of articulation to obama care. that's a big economic concern for the entire country, not just the electorate. she did very well and remains formidable. >> but, wolf, her responses on the vaccination is important because she was hitting hard on him issuing an executive order and also the mandate. and so i looked that the issue going beyond just the vaccination issue, really going to the whole notion of, how do you use an executive order? and so, rick perry had to deal with that. about was smart for her to be this aggressive after winning the ames, iowa pool he has taken a lot of attention. she has to make sure she's in the top tier. it's a smart move to than aggressive in that debate. she can't be less aggressive in any debate in order for her to maintain the top tier stat us. >> we'll continue this conversation. thank you. jack cafferty's up next. then, senator diane feinstein says her campaign war chest has been, quote, wiped out. the alleged crime, an inside job? call social security a ponzi scheme? mike writes, perry's jerk. it's a lifeline for the old and not well off. take the earning cap off fica, but no one has the guts to propose it. tom in atlanta writes, it's time someone talks about the unspeakable third rail political topic. perry has shocked us into openly talking about this, and i give him credit for having done so. is it a ponzi scheme? well it looks like a duck, sounds like a duck, and it walks like a duck. david in missouri writes, if i may make one small correction, social security became a ponzi skam. folks, remember we had $3 trillion in the trust fund, cash on hand. in 30 years congress has spent every single dime of the money that wasn't theirs to spend knowing their ious were bogus. brandon writes, rick perry spent too much time at firing range. a ponzi scheme is where somebody takes money from somebody else for their own personal profit. social security's taking a small sliver of money from the taxpayers and giving to the seniors, people who built this country into what it is today. bill writes, only the future will determine whether social security's ponzi scheme. when the decision was made to not have each to kabul. our own suzanne malveaux is on the scene. senator diane feinstein one of dozens of lawmakers allegedly swindled by a campaign treasurer who is being compared to bernie madoff. we want to welcome our viewers in the was around the world. breaking news, political headlines, and jeanne moos straight ahead. i'm wolf blitzer. you're in "the situation room." as the front-runner texas governor rick perry took repeated jabs from his rival at last night's cnn tea party, republican presidential debate, one blow landed especially hard and its reviving a huge controversy that's dogged perry for years. it step from his effort to require young girls in texas to be vaccinated against the sexually transcommitted virus that can lead to cancer. ed lavandera's in dallas watching this story for us. give us the latest because all of a sudden this whole story has take on new life. >> reporter: wolf, it's a controversy that's been around here in texas for quite some time. but what was interesting, and you saw this firsthand, tea party crowd should have been friendly to governor rick perry but there were a couple times where the crowd turned on governor perry and this hpv vaccine issue was one of those times. the hpv controversy has hovered over rick perry for more than four years. but it wasn't until the cnn tea party debate that paerry's opponents dug into the texas governor. >> to have innocence, little 12-year-old girls be forced to have a government injection through an executive order is just flat-out wrong. the drug company gave thousands of dollars in political donations to the governor and this is just flat-out wrong. >> the company was merck, and it was a $5,000 contribution that i had received from them. i raise about $30 million and if you're saying that i can be bought for $5,000, i'm offended. >> reporter: $5,000 in 2006. according to texas campaign finance documents, but altogether merck has donated more than $28,000 to rick perry's gubernatorial campaigns in last ten years, more than $20,000 of those donations were made before the governor issued the controversial hpv executive order. >> but i do not understand why we, as a people, would not take this opportunity to use this vaccine that's come to us -- >> reporter: that was rick perry back in 2007 trying to muster support for the mandate but he was heavily criticized when it emerged his former chief of staff, mike toomey, worked as a lobbyist for merck and other companies before and after working for perry. dallas tea party activist katrina pierson attended the debate, and says most people in the hall weren't happy with perry's answers on this issue. >> capital cronyism is extremely important and it runs rampant throughout both parties and the issue needs to be discussed and we need to make sure we have a candidate committed to principle legislation and governing, not special interest driven. >> reporter: but the relationship between rick perry, his former chief of staff, and the drugmaker merck is troubling to campaign finance watchdogs like texans for public justice. while perry was prominent in the republican governor's association, merck donated more than $377,000 to the rga, that's since 2006. in the same period, the association has donated $4 million to rick perry's campaigns for governor, all perfectly legal, but a glimpse into how money runs through the political system. and now, rick perry says he handled the hpv vaccine issue all wrong. >> but on that particular issue, i will tell you that i made a mistake not going to the lem slate tur first. at the end of the day, this was about trying to stop a cancer. >> you know, governor perry and his staff have long denied that mike toomey, his former chief of staff and his relationship with him had no influence, nothing to do with him, signing this executive order. and it didn't really affect governor perry in the last election. he handedly defeated senator kay bailey hutchison in texas. >> you have been living in texas for a long time. you've been covering the governor for a long time. what we're seeing now, because all of us are paying attention to him, much more closely now, that is what you've seen over the years? do you see some different parts of the governor right now as he seeks the republican presidential nomination? >> reporter: you know, what's interesting, and i think we'll start hearing a lot, and the dallas tea party activist you heard from in our piece brings up the same point, there's a lot of small issues, like the hpv vaccine issue, a lot of controversies that have been festering for i long time in texas when it comes to rick perry. the question is, as more and more start getting attention will it add up to something? it hasn't in texas during his time as governor. he's been re-elected over and over, the longest-serving governor in texas history, but there's a lot there that people are anxious to see get more scrutiny and a closer look. after all of that adds up, it will be interesting to see what effect it will have. >> he wasn't backing away from the in-state tuition for children of illegal immigrants either. ed lavandera, thanks very much. >> reporter: you got it. this just coming in. good news for governor perry, he's getting another endorsement from a fellow governor, republican governor of nevada, brian sandoval, endorsing governor perry. this, we're just learning. nevada, an early primary state, as well, early contest in the race for the white house. so the governor a rising star, republican star in nevada endorsing rick perry. so we'll have more on that part of the story as well. let's get more on this controversy that ed lavandera was reporting on. tom foreman is checking the facts. >> one of the key questions in all 0 this really is the notion of whether on this actually was put into place. listen again to what michele bachmann said about what the governor did. >> i'm a mom of three children and to have innocent, little 12-year-old girls be forced to have a government injection through an executive order is just flat-out wrong. that should never be done. that's a violation of a liberty interest. that's -- little girls who have a negative reaction to this potentially dangerous drug don't get a mully begin. they don't get a do-over. the parents don't get a do-over. >> so the governor admitted he said himself he shouldn't have handled it this way. but did it happen the way she said? forced injection is flat-out wrong. now, she did specify by executive order. we have lot of injections in the country effectively forced against meeseles and against polio, things like that. but throughout the history we've ryder these things for the kids to go to school, as the governor did there. he t. was overturned by the legislature and he did not veto the legislature. the truth is, though he made by his own admission a mistake it never became anything more. the statements about bachmann, we have to say are true, but they're incomplete because you have to consider the entire picture t you think of the governor and all of this. beyond that, one of the things th over and over was this question of the economy. bs jobs, jobs, jobs and the governor and two former governors, mitt romney and john hundr huntsman kept saying they're better the jobs game than president obama. attack a listen. this president does not understand how to free up the small businessmen and women or for that matter wall street. >> and the people that have been hurt most by the obama economy are the middle class. >> i have put forward a program that i want all of you to understand is basically patterned after what i did as governor. >> what i did as governor. they all said that over and again. what i did as governor. the simple truth is, the picture of what they all did as give is not as clean as they say their states prospered. yes, rick perry has created jobs in his time in office. but texas' unemployment rate has grown like the rest of the country. it's lower than the country unemployment rate now but still at 8.4% versus 9.1%. they still have problems, despite some progress. mitt romney, yes, he came into office with massachusetts losing jobs, he left with them gaining jobs. but they were gaining jobs much slower than the rest of the country generally at that point. so, was he making progress? yes. not that much. probably jon huntsman, in utah, the closest saying what his record really was but he's shaving the numbers. none of these people sit in a vacuum in their states and the national economy affects them. so we have to say with all of their statements about the economy, true, but incomplete. >> true but incomplete. thanks very much for that. let's discuss the debate more with our chief political analyst, gloria borger. another big issue in the debate, social security, was it resolved? >> wolf i do not think it was resolved. i think we're going to be hearing a lot about it. just take a listen to this exchange between perry and romney, and i'll tell you why it's not resolved. >> it's time for us get back to the constitution and a program that's been there 70, 80 years, obviously we're not going to take that program away. but for people to stand up and support what they did in the '30s or what they're doing in the 2010s is not appropriate for america. >> but the question is, do you still believe that social security should be ended as a federal program as you did six months ago when your book came out and return to the states, or do you want to -- >> i think we ought to have a conversation -- >> we're having that right now, governor. we're running for president. >> ouch! that's pretty nasty exchange, wolf. and i do think that the question of whether governor perry thinks that social security is unconstitutional still remains to be discussed. we did not really get a clear answer on that last night. he clearly wants it to be an issue that's taken to the states, but he needs to have a plan. and we don't have a plan. his reform plan yet on social security. now that he's out there saying this, his book has said it, we're going to have to hear just what he wants to do to fix social security for younger people. >> i suspect that republican party as a whole, not very happy this social security issue is forefront in this presidential debate. >> it depends who you ask. the tea party folks are happy to be having this debate but when you talk to people in washington, particularly members of congress who have to run for re-election, they're quite nervous about the fact that the republican party is now discussing social security. it's -- they believe that they're handing this issue over to the democrats. remember, the issue of medicare was such a hot button issue that republicans used against the democrats in the 20 10 midterm elections they're worried about social security being used against them the other big issue children of illegal immigrants in texas getting in-state tuition to go to state universities. let me play this clip. >> if you have been in the state of texas for three years, if you're working towards your college degree and if you are working and pursuing citizenship in the state of texas, you pay in-state tuition there, and the bottom line is and doesn't make any difference what the sound of your last name is. that's the american way. >> i think the american way is not to give taxpayers subsidized benefits to people who have broken our laws and are here in the united states illegally. that's not the american way. >> that was an exchange right there, michele bachmann, really taking off her gloves to a certain degree. >> right. and the issue of immigration, wolf, and ow you though this from george w. bush has been a fault line within the republican party. george w. bush wanted some kind of immigration reform. republicans fought him on it. now the line, the refrain we always hear is secure the borders. but the dream act, which is what they're talking about there, is something that was an issue in congress. an issue for congressional republicans. again, is this a debate republicans want to be having internally in their party right now because it splits the party? what we saw at your debate last night was all of these divisions within the republican party on issues like social security, on issues like immigration. really exposed and you see how divided the party itself is. >> all right. gloria, thanks very much. >> and an attack on the united states embassy, the embassy in kabul. nato headquarters targeted by taliban militants. you're going to see the ferocious gun battle that raged for hours right in the heart of the afghan capital. suzanne is standing by. the disturbing rise in poverty in the united states, soaring to a new level. perhaps never seen before in one the world's wealthiest nations. plus -- a campaign treasurer now suspected of swindling dozens of u.s. lawmakers including california's senator diane feinstein. jack cafferty's here with the kaf cafferty file. >> president obama's plan to bay for the jobs bill with higher taxes, dead on arrival. republicans are insisting that tax hikes are off the table. the white house says congress should pay for the jobs bill by putting new limits on itemized deductions for the wealthy, including deductions for home mortgage interest, state and local property taxes and charitable donations. in this case, wealthy means individuals who make more than $200,000 a year and family whose earn more than $250,000. president obama wants to end tax breaks for oil companies and corporate jet owners and cut out a tax break for investment fund managers. the white house says all of these tax changes would raise $467 billion over 10 years. but republicans are not hearing any of it when it comes to higher taxes. and that's not all they don't like. they have also rejected new stimulus spending on new road projects, school construction. anything that smacks of another stimulus bill ain't going to happen. on the other hand republicans like the president's proposal to give more generous tax breaks to small businesses and the idea of pulling back burdensome government regulations. so far president obama is selling his plan to pay for the jobs bill as a single idea, but realistically there's no way that that will ever get through a divided congress. republicans say that certain parts of the president's plan, though, should be considered individually. here's the question. should people will, jack. thank you. startling, truly startling numbers out from the u.s. census bureau. get this, 46 million americans, that's 1 in every 6, 46 million americans are living in poverty right now. that's the highest rate since 1993, and the most ever recorded in the 52 years the government's been keeping track. lisa silver tess's looking at the numbers for us. >> the numbers indicate the impact of the recession. unemployment, hovering around 9%. many workers have been looking for full-time work they can only find part-time work. and poverty is on the rise. >> reporter: in silver spring, maryland, volunteers load furniture on to trucks, they are part of a nonprofit group called a wider circle, that provides furniture to needy families. >> we get about 400 telephone calls a day and out of those telephone calls, more than half are from people who will tell us the same story, which is i have nothing, i don't care if i can sleep in a bed but i want my kids to have a bed. >> reporter: among those benefiting are this woman and her four children, she works full time as a home health aid but her income of $22,000 a year puts her below the poverty line. >> it's really hard because, like i said, my four kids is like my number one property, so you know i buy food, pay the rent, and whatever i work with until i get paid again. >> reporter: new numbers released by the census bureau show the nation's poverty rate hit the highest level since 1993, 15.1% of the population in 2010. the poverty line for a family of four defined as $22,314 a year. >> if you qualify as being in pvty today you're in deep poverty. that's based on an outdated formula from the '60s. >> reporter: government safety net programs could be cut as lawmakers look to trim government debt. the heritage foundation downplayed the latest numbers saying many of the nation's 46 million in poverty are not truly destitute. >> i think that these numbers are designed to exaggerate the extend of poverty in the united states in order to build a larger welfare state and it does make it more difficult for us to target the assistance to those who truly need it. >> when i graduated -- >> reporter: but rose, who is unemployed, came to a wider circle looking for help says it's not easy to identify those living below the poverty level. >> a lot of people living in poverty that we're not aware of that might seem that, you know, you don't know, but they are. >> the report also found that median household income declined 2.3%. we've also saw a significant jump in the number of young adults living with parents since it 2007 and the number of uninsured in 2010 was 16% of the population. that's basically about where we were the year before in 2009. >> the actual number in the report almost 50 million americans without any health insurance. >> these numbers are absolutely startling when you take a look at it. 50 million without insurance, 46 million living in poverty. keep in mind that poverty level is only about 23,000 a little under $23,000 a year for a family of four. >> startling numbers, in the richest country in the world? he's been in cuba for nearly a week trying to free an what's go on right now? >> reporter: well, wolf, it's about 3:00 in the morning now, kabul time, many people are in bed arc sleep. it is rather quiet now. you hear the occasional dog barking. in previous hours we've heard explosions from our site here. we have heard gunfire as well. the last tweet that was sent from the spokeman of the department of interior says that one of the terrorist is still alive, they believe but soon will be killed by police. that happened within the last hour or so. we do believe that the police have been going through this building, going floor by floor by floor. they believe they may find one or two terrorists left, not even sure if they're dead or alive but continue to search for these folks. in the meantime, there are a lot of anxious people awaiting to see what the morning brings but, wolf, here's how the last 13 hours or so played out today. >> reporter: a bold and brazen attack against the u.s. embassy, and a nato compound in one of the most secure areas in the center of kabul. at least four taliban insurgents holed up in a building under construction in the center of the city. they opened fire with light weapons and rpgs. staff at the u.s. embassy went into duck and cover mode. sporadic gunfire and explosions continued through the day, at times even involving helicopter gun ships. afghan police and army tried to push back the crowds, wounded were taken to a nearby hospital. during the afternoon at least lee insurgents were killed. soldiers outside this military hospital say this man was one of them. >> further down you can see the barbed wire, you can see the compound, the concrete there, that is where we heard those loud explosions. this battle's not yet over. what makes this so powerful for people in the community here is the fact that it really is at the heart of the city, these are the power brokers, you are talking about, the international police force, the afghan officials, intelligence officials, at heart of the security apparatus, and that is where this firefight is taking place. it is meant to make the people here afraid, afraid of the transition, afraid of afghans taking over their own security. in addition to this high-profile attack, there were three other suicide bombers who tried to detonate explosion everybodies at various places around kabul, all killed without reaching their targets. so, wolf, so far seven people killed this day, 17 injured. that could increase tomorrow, as we see the light of day and what has taken place on the ground. we've also learned that personnel at the u.s. embassy are no longer in this complete duck and cover mode, if you will, but still on a heightened state of alert. many of their activities at the embassy have been canceled for the morning. there are still a lot of anxiety, a lot of questions around what took place today. i've had a chance, wolf to talk to general john allen, head of the u.s. and nato mission here in afghanistan, and they said, they expected, we're not surprised, they might see attacks around the days of 9/11, the tenth anniversary, but this is really one that was at the heart, at the heart of the security apparatus in this city. they say it is not spectacular, but it's certainly very bold. it's brazen. and it has very weighty significance, symbolic meaning for many afghans here who want to feel confident and not fearful that they're going to be able to take over their own security in the years to come, wolf. >> that's a good point you make, suzanne. i've spoken with some analysts here in washington who think this attack may not necessarily be successful, but the mere fact that they were able to do this will reinforce this notion that perhaps the u.s., the nato allies, are vulnerable there, it will embolden some of the taliban fight to take more action in the weeks and months to come. is that a similar analysis you're getting from folks in kabu kabul? >> reporter: well, that's right, wolf. one of the things that we have heard and we've been talking with folks at the u.s. embassy as well as inside of the nato compound is that they feel that the afghans, the army and the police, that it was important, even those in some of the helicopters, the choppers flying overhead shooting into that building to kill those insurgents, that they really took the lead or they certainly appeared to take the lead that they were partners with the international military force here because they are trying to counter that image that the afghans can't handle the taliban, that the taliban are stronger than them, and so they are really trying to put them out there. but there's a lot of concern here, wolf, that they are not yet ready for that job. there's a lot of training that needs to be done. we've seen that training firsthand. they know the taliban has succeeded today in at least a very strong symbolic attack here showing that they can get to heart, to the heart, of the security apparatus here in kabul. >> what's so worrisome, they've been training these afghan fighter for ten years hundreds of billions u.s. spent and this take places. we'll touch base with you tomorrow. suzanne malveaux on the scene in kabul. >> another important story we're following. iranian president ahmadinejad vow two american hikers jailed on spying charges could be released within days. let's bring in brian todd, working this part of the story for us. >> the americans were supposed to be serving eight years sentences, convicted and handed e an just a few weeks ago. two years, and it will cost $500,000 each, in what the iranian government calls bail money. but iran's president now says two american hikers, shane bauer and josh fattal, are about to be freed from prison. ahmadinejad spoke with nbc. >> yes, in a couple of days they will be freed, god willing. >> translator: we do it, for example in humanitarian gesture. is it going to solve the problems? i hope so. >> reporter: through a representative the hikers' family said they're overjoyed at the news and hope to say more when loved ones are returned. bower, fatale and bower's fee on say apprehended in 2009 hiking in northern iraq but the iranians alleged they crossed iran's boarder illegally and charged them with spying. all three have denied that. shourd released last year for medical reasons. shane bow somewhere josh fattal recently convicted in a trial and sentenced to eight years. in the nbc interview, ahmadinejad described their conditions in the prison. >> translator: these two people are having very good conditions in prison. it's like staying in a hotel. >> reporter: westerners held there describe mental and emotional torture, constant threat business captors. interviews with cnn after her release, shourd was not physically abused but -- >> being alone 23 hours a day is devastating. i mean it's very hard to hold yourself together, you know? in the beginning i would cream and cry a lot and, you know, sometimes i'd bang on the walls, but eventually you realize that just that resistance is futile. >> reporter: why the iranians releasing them now? ahmadinejad may be trying to build goodwill ahead at the appearance at the u.n. later this month but it may have to do with the personal struggle for power between ahmadinejad and the man who holes the real power in iran. what's in it for him now to do this now? >> over the last several months, within iraning ahmadinejad's been emasculated domestically and this a move by the supreme lead who had to okay the release of the hostages to show to the world ahmadinejad still has some power, still has some clout because it's in their interest the world focus on ahmadinejad. >> he says the ayatollah needs ahmadinejad as a lightning rod to deflect blame for iran's problems away from his himself and this release is a way of seeming it like ahmadinejad has power when he says he done have much. we've e railed iran's mission to ask why americans are being released now. we've not heard back. >> he's hinted at other measures, ahmadinejad, as well. >> he wants iran rans being released. it's not likely they're going to be released. this may be a pure pr move by the iranians at this point. >> they get $1 million, $500,000 each, i wonder where that goes. >> not fruitless. who knows? [ male announcer ] if you can't afford your medication, astrazeneca may be able to help. lisa sylvester's monitor the top stories in the situation right now. no luck on the rescue mission in cuba? >> not so much. attempts to free an american jailed in cuba have failed. former new mexico governor bill richardson will leave the country tomorrow morning after he says he has exhausted all possibilities to negotiate the release of allen gross. a u.s. contractor is sentenced to 15 years for setting up illegal internet connections on the island. a scary moment at a game between the dallas cowboys and the new york jetted. police say a man with a taser got inside the stadium and allegedly fired on the crowd, injuring three people. the cell phone video that you see here, it shows the aftermath. the suspect is charged with assault and possession with a weapon for unlawful purposes. investigators want to know how this man got past security. and talk about an adrenaline rush. bystanders in logan, utah, saw this fiery crash monday and immediately jumped into action. take a look here. after seeing a motorcyclist trapped under the burning car, the crowd lifts the 4,000-pound vehicle dragging the man to safety. 21-year-old brandon wright was taken to the hospital and he is now in stable condition. piers morgan talks to some bystanders tonight at 5:00 eastern, right here on cnn. pretty amazing video. we've seen it before, look at those folks picked that car and rescued that guy. >> amazing. and what kind of condition is he in now? >> stable condition. that was my question. we saw the video and you see him lying there, how is the guy doi doing? he's in stable condition. >> 9:00 p.m., peers will have more. thank you. she'sen being called the bernie madoff of campaign treasurers. pocketing millions in political donations. one democratic lawmaker says she may be the bernie madoff of campaign treasurers. california woman accused of stealing more than 1 million in campaign funds. let's go to los angeles. cnn's casey wian is joining us live. what's going on here? >> reporter: well, wolf, earlier this month the fbi arefed a woman named kinde durkee on suspicion of fraud, well known in california as a campaign treasurer for dozen of candidates and political organizations. and she's accused of pocketing at least $1.5 million in campaign contributions. >> reporter: senator diane feinstein, congress women loretta sanchez and susan dave swiss several california state lawmakers are confirming campaigns each lost hundreds of thousands of dollars in donations because of alleged fraud by this woman, kinde durkee. her burbank california company was hired by democratic lawmakers and political committees to manage donations in accordance with strict campaign finance rules. but an fbi complaint alleges durkee admitted to agents she had been misappropriating her clients' money for years. and a letter to supporters, congresswoman davis said, we've been robbed of about $250,000. senator feinstein told politico over the weekend her campaign was, quote, wiped out, and is still trying to assess the damage. former california assembly speaker robert hertzburg hired durkee to manage some contributions. >> the laws are so complex, if you go to your accountant and say look at these rules your account ant will say i can't do this. in a state that has 38 million people, there literally are only a handful of folks and they have hundreds and hundreds of candidates. >> reporter: the fbi says durkee had control over at least 400 different bank accounts and moved money between campaigns to cover shortfalls. the complaint also alleges durkee diverted money to pay, among other things her mortgage, company's payroll, her mother's nursing home expenses, and her american express bill. among those charges, trips to disneyland, the aquarium of the pacific, and baskin robins. investigators are pouring through all of those transactions, and law enforcement sources say that forensic accounting is going take a long time. durkee has been released on $200,000 bond and she's scheduled to make a court appearance next month. her attorney has not returned our phone calls. law enforcement sources, however, say that settlement discussions are ongoing and she was only arrested on suspicion of fraud, yet no formal charges have been filed at this point. >> what a story. casey, thanks very much. stay on top of it forus. >> congressional republicans sending mixed messages on president obama's jobs bill? plus, jeanne moos and the rowdy parade that's on a viral video. whoa! hey! in large part it's how president obama wants to pay for his $447 billion jobs plan, with two words republicans can't stomach, tax hikes. >> we see permanent tax increases put into effect in order to pay for temporary spending. i just don't think that's really going to help our economy the way -- the way it could. >> reporter: instead, republicans want to pick out individual measures from the president's bill, such as tax relief for small businesses and reforming benefits for the unemployed to help spur job creation. but democrats fear that tactic means their priorities will be left behind. >> i think cantor's statement about we'll take only what we want or give you only what you want, i don't think that's acceptable to us and it's certainly not acceptable to the american people. >> reporter: all the while president obama has taken his sales pitch on the road to ohio. straight to house speaker john boehner's backyard. >> so, let's tell congress instead of just talking about helping america's jobs creators, let's actually do something to help america's job creators. let's pass this bill right away. >> reporter: and while the white house promises president obama will continue to pressure congress to pass the whole jobs package, white house did acknowledge today that the president -- that if congress sends the president only a portion of the jobs bill, he won't veto it, wolf, he will sign it into law. >> the story's not going away, kate, thanks very much. let's get back to jack for "the cafferty file." jack? >> well, the question's related, should tax increases be used to pay for president obama's jobs program? justin says, yes, canceling tax breaks on the richer americans seems like the right thing to do. the job creators have had plenty of time to create jobs with these tax breaks in place, but they aren't doing anything, are they? it's time to try something else, and the rich didn't get rich all by themselves. so quit being so greedy and selfish and help your country get back on its feet. chuck writes, it ought to be paid for with cuts in foreign aid and military spending. it's time we changed our priorities. tim on facebook, no, unless obama can figure out the $250,000 a year for a family is not rich. only if you make over a million over a year, then -- then -- i'm for it. steve in arizona writes, no there shouldn't be. this latest stimulus program will produce the exact same results as the last one, because it takes money away from the ones you're expecting to create these jobs, not to mention when it takes $350,000 to create a job it doesn't sound like a very sane idea. john in new york said the plan is specific and it's a balance of tax cuts for all and a modest increase to the 2% highest income group, it also promotes benefits for those companies who hire america workers and obama is right and he has a well-balanced, fair plan. republicans will do all they can to portray it into a negative light and then drag it into the 2012 election campaign. connie in chicago said, yes, the elite and superrich are bloated from stuffing themselves for ten years with the heavy-laden buffet prepared at the expense of the working poor and the middle-class. much to the chagrin of the republicans and the tea party, it's time to even the playing field and give the middle-class a break. if you want to read more on these ideas, you find them on my blog at cnn.com/caffertyfile, or through our post on "the situation room's" facebook page. wolf?
