blitzer. >> yeah, i'm very sorry about what happened yesterday. it was what i thought something had to be done on the fiscal cliff before the election. apparently nothing has to be done until the first of the year. so i think he should just stick with his position. >> president clinton claims he didn't know it expires after the electi election. rick santorum is resurfacing. the former pennsylvania senator will lay out his plans for the future today. sources say he wants his voice heard as leader of the conservative wing of the gop. he's expected to announce he's ez forming a political committee to give him that vehicle. new developments in the etan patz murder investigation. look at this photo obtained exclusively by cnn. it shows pedro hernandez, the suspect in the 1978 death of the 6-year-old little new york boy, in a suit and tie wearing glasses. investigators have removed a computer hard drive, two satchels and other items from his new jersey home. hernandez who has confessed to strangling pats, has been ordered to undergo a psychiatric determination to determine whether he's competent to stand trial. congratulations, you may now run for cover. students in new jersey had a very special graduation. it looks like a funnel cloud appeared during their ceremony. really amazing is you can see students still walking while the cloud looms in the background. and then, then came the rain and the hail. most people cleared out before things got really bad, though. no one was hurt, obviously. it could be a rough day in the markets today. ben bernanke did not indicate more stimulus was coming during his capitol hill testimony yesterday. so today the markets are expected to open lower. also some concerns about spain and that situation. and now nasdaq, s&p 500 futures are all down. dow futures down 60 points. video game studio founded by former major league pitcher curt schilling goes belly up. 38 studios declared bankruptcy yesterday after it fired all 400 employees and defaulted on a loan payment. they report the company is now under federal investigation. rhode island lured the company to the state with a $75 million taxpayer backed loan back in 2010. >> christine, thank you for that update. a demand to end what is being called a cascade of classified information leaks. it is a bipartisan effort from four top republican and democrats in light of three glaring sxe ining examples of l happening in the past months. back in may, we found out that a u.s. double agent helped foil an airline bomb plot out of yemen. the obama administration is accused of leaking the secrets for political points. the white house flatly denying that after meeting with the director of national intelligence, james clapper, the top republican on the intelligence committee, senator saxby chambliss, remained ambiguous about whether he thinks the leaks are politically motivated. listen. >> we have been through this before. in the bush administration. wherever the responsibility falls out, that's where it is going to be. if it is in the administration, fine. if it is not in the administration, fine. >> this morning we talked to congressman, republican congressman mike rogers of michigan, the chairman of the intelligence committee. democratic congressman dutch ruppersberger is a ranking member of the intelligence committee. they both met with the direct, clapper, yesterday. thank nyce thanks for joining me. i would love for both of you to answer this question, where do you think the leaks are coming from? why don't we start with you first, congressman rogers? >> we don't exactly know. but we do know it is -- someone has committed a crime that is having serious consequences to our national security. what we are doing in a bipartisan way is we need to follow the leads of the investigation to the leaker and make sure that leaker goes to jail. much like what happened with the valerie plame case. someone went to jail over that. this is 100 times the magnitude of that. >> congressman ruppersberger, do you have a sense of where the leaks are coming from? >> first thing, the leaks are very serious and affects our national security and they're wrong. we're going to follow the facts wherever they go. in a bipartisan way, the senate and the house are coming together. we need the administration to work with us in a partnership to find out where the leaks are and how we stop the leaks. and wherever the facts take us, that's where we should go and if someone, whoever did commit these leaks, they should be held accountable. >> but the question i asked was where do you think the leaks are coming from? do you have a gut sense of who is leaking? >> we don't know. that's what investigations are for. these leaks are occurring more and more as we moved on. this is wrong for america. >> do you think this requires an outside investigator, a moment ago we played a little bit of what senator chambliss was saying. what do you think? >> well, you know, we have to ask some hard questions here and i know i've had discussions with senator dianne feinstein about maybe the possibility of a special council, something i think -- >> she thinks no. as i'm sure you're well aware. she says no. >> i don't think it is as definitive of that. part of the reason is you can't have somebody who may have leaked it in the chain of command investigating themselves. that's the one thing we have to come to a conclusion and it should be a bipartisan conclusion if we get there. but the part of the national security team at the department of justice had to recuse itself on one portion of the investigation, not because they were guilty of anything, but because they had access to information. the fbi had some access at very senior levels. the nfc had access at very senior levels. very compartmented programs. it starts to get murky quickly. we need to make sure it is a fair investigation. it is complete, meaning it can go wherever it takes it. it can ask any question to anyone who had access to the information and it has to be bipartisan. that's what we're wrestling with now. >> congressman ruppersberg, let me ask you a question. is it possible the leaks are coming from congress? the other night anderson was talking to congressman peter king and they were speaking specifically about the airline bomb plot. and here what he is he had to say. let's play that first. >> okay, sure. >> it is probably -- it is one of the most tightly eld operations i've seen. i can tell you myself and in other member of congress knew anything about this, including me, until this afternoon and that's unusual. >> how likely do you think, sir, it is a member of congress potentially who is leaking? >> right now we don't have the facts where it is coming from. we're going to find out. but if it is a member of congress, whoever it is, that person will be held accountable. there are two major issues here. the issue of how we're going to stop the leaks, the culture of leaks and the other issue is find out who did leak it with respect to these investigations. and if, in fact, the facts show that we're getting close and there is an individual that purposefully leaked that information, i think we should move forward with the special prosecutor. it is too soon to make that determination. because, remember, a special prosecutor can take years and costs a lot of money and it is going and targeting on an individual to get evidence and elements of a crime. we have a problem here and the most important thing is for our committees to come together, working with the administration, and putting together a team that is going to stop the leaks and that everyone who works in the area of intelligence has the clearances to deal with that needs to know these leaks cannot happen and you're going to be held accountable and go to jail if you do leak. >> how confident are you you'll be able to not only track down the person who is leaking as you point out, but also, i guess, end this culture of leaking as well? >> well, i will tell you this is the first time we have seen such bipartisan effort because of the severity of the pattern of leaks. there wasn't one particular incident. there was a whole slew of incidents. so i do feel confident we will be able to find and prosecute the individual who did it. the trick is how exactly we get there in a way that make people believe it is fair and bipartisan. and we're working through those issues now. >> and i would guess how do you get there in a way that is not only fair and bipartisan, but that you don't reveal more information in a hearing that is supposed to, in fact, be protecting classified information. isn't that one of the worries? >> well, anything we do in the intelligence committee is classified. and can be classified. so anything we would do through an investigation on the committee itself would be classified. anything that special council would do -- >> or the fbi. >> and for the fbi as well because, again, the level of information that -- when you look at the whole pattern, tells you it is someone very senior in the executive branch or could possibly be a member of congress in either committee. but the indicators show that there is a pattern of this activity and it would take -- this will take a pretty full effort to get at it. >> the testimony from yesterday, you had said there was a segment of the media that is a quote from you present in a classified setting. what were you talking about specifically? >> media or medium. i can't get into too many details, but we had in the preliminary review, we had certain things that indicated to us that there was something to this notion that there is a pattern of problem here. and a culture of trying to feed the media things that were classified. that was one example where there was a situation that was classified, that had an individual from the media or medium, different type of medium, in an event that was inappropriate at best and may have violated other rules or laws as well. >> are you talking specifically about documentary producers who are sitting in classified meetings? come on. >> oklahoma city thunder and kevin durant versus lebron james and the miami heat, yes, i do want to put money on that. >> when lebron cams on the to show tao talk about the victory you'll eat that up. let's turn to talk a little bit about the fight over the botched government gun trafficking program. you remember it is called the fast and the furious. it is heating up. the attorney general eric holder faced pointed and sometimes personal attacks by darrell issa who has been pushing holder to hand over more documents related to that program. >> mr. attorney general, you're not a good witness. a good witness answers the question ansed. let's go back again. >> we asked at 240 custodians, processed millions of electronic records and viewed over 140,000 documents and produce youed to you -- >> 14,000 documents, how many are responsive but you're withholding at this time? >> we produced 7600. >> i don't want to hear about the 7600. >> mr. chairman, i would beg to allow -- >> the lady is out of order. would the lady please -- >> parliamentary inquiry -- >> so that was just a little tiny portion of how angry and nasty it got, a number of the guns from that program, you'll remember, ended up in the hands of mexican drug cartels and then were used in murders on both sides of the border. we'll get right to republican congressman randy forbes of virginia, a member of the judiciary committee, at yesterday's hearing. thanks for talking with us. issa as we all know has been a very fierce critic and sometimes personal attacker of the attorney general holder. were you satisfied with what the attorney general had to say in that testimony yesterday? >> i think there is a lot of things that came out yesterday that shocked many of us. one of the things is there i was revelation that many of the cabinet secretaries had been summoned, not to the white house, where they were counseled by mr. axelrod as the chief strategist for the obama administration by their campaign manager and also by the executive director of the dnc about what actions they should do, what things they should be saying between now and the election. but what shocked us, we thought the attorney general was above that and he acknowledged that he had had meetings with mr. axelrod as well. i think that concerns us because, you know, if anything, the attorney general's office ought to be above politics. >> let's talk about the meeting and sometimes just interactions with axelrod between the attorney general axelrod. it is described in a book that we were talking to the author the other day, don't ever accuse me of trying to interfere with the operations of the justice department, axelrod warned holder, after confronting him in the hallway, he writes. i'm not karl rove. the two men stood chest to chest. it was like a schoolyard fight. white house staffers caught in the cross fire averted their eyes. at issue there is allegedly in that scuffle that axelrod was said to have tried to influence hiring at the doj. what did you think of the testimony on that front involving that particular interaction? >> the attorney general said that mr. axelrod had not tried to influence hiring and so we have to take him at his word on that. i think what concerned most of us is when the attorney general acknowledged that he was having these meetings with the chief strategist for the obama campaign, and when you start talking about that, we think there ought to be a little bit of a wall of protection there. so that the appearance of impropriety is given to people across the country. >> here is what he said about some of those meetings. this is the attorney general eric holder. listen. >> the political dimension to the job that i have as attorney general, i mean, the reality is that i don't sit up in an ivory tower and just do law enforcement. i am the subject of attacks. i'm a person who was seen by some as pretty controversial. and there are times or there was that time when i was looking for some help in that regard. >> we know that david axelrod, who was on tv over the weekend, last weekend, certainly didn't deny it. here is what he said. listen. >> eric holder is a great friend of mine. we went to the same high school. we may have gop chest to chene back in the day. we have a strong relationship. and i'm not going to get into the details of that other than to say i respect him. i never tried to interfere in anything that he did. never talked to him about a governmental matter or justice department matter in alled the years i w s i was in the white . >> both of them are consistent in saying, what we discussed was not interfering in any way with the justice department. do you think there is a version of that that is not true? >> i'm not disputing their honesty. what i'm saying is that the attorney general did not say that. what the attorney general said when he started his remarks is that he said that the attorney general's office ought to base all their decisions on facts and the law and nothing else. they were his words. but later on, when we were talking to him, he acknowledged that was not the case. he was actually meeting with the top campaign strategist for president obama. and he talked about the fact that he was being counseled about what to say and things to do and how to handle attacks on him as the attorney general. and, you know, there are a lot of people he could consult with. i think as to try and get even an appearance of impropriety, he ought not to be counselling with the top strategist for the campaign. >> we know the committee is prepared contempt citation against eric holder. and congressman issa said they could move on that. here is what he said. >> i believe that the speaker is close to the end of his road. i don't expect to go home the fourth of july without having a date for contempt and knowing it is time to wrap up this investigation. >> would you support that, a date for contempt? >> if we can't get the answers that we need and it is important to recognize, it is not just republicans that want those answers. we heard from the ambassador of mexico that this fast and furious operation has done more to poison the relationship between the united states and mexican people than anything we have seen in two administrations. and they're concerned they haven't received this investigation. we want to make sure that we just get the facts so that we can reach a conclusion and find out what actually happened. as we mentioned yesterday, it doesn't matter if the attorney general appears seven times before the committee, if every time he appears he just says he doesn't know on key questions. and it doesn't matter how many documents he gives us if he doesn't give us the ones we asked for. i think what you see with chairman issa is he's just getting frustrated that he feels like he's getting stone walled by the attorney general and not giving this information. >> congressman randy forbes is a republican from virginia, nice to have you with us, sir. thank you. want to bring in dan collilydem the author of the book. we heard from congressman forbes a moment ago saying that what disturbs him the most is this meeting between the attorney general and campaign strategists because it gives us appearance of impropriety. what do you think when you hear what he was saying? >> well, first of all, he talked about meetings. i'm aware of one meeting. david axelrod was a senior adviser in the white house. it is not shocking that the attorney general meets with people in the white house. his job is to some extent a political job. any cabinet secretary has a political dimension to his job. in this particular case, the white house was very focused on the economy and getting health care passed. and they had concerns that holder and other cabinet secretaries occasionally would step on the message, holder got into a little bit of trouble early on in his tenure, gave a speech about race that was controversial. one or two other things and so the white house brought him in because they wanted to make sure that there was coordination on what they called messaging. and as part of that, they also wanted to put someone on his staff who would help, who would be kind of an early warning system as axelrod put it, and that was part of what actually inspired the confrontation because holder was a little bit resentful that the white house was trying to put someone on his staff. i have to say, i reported exhaustively at this particular episode and one thing that did not come up was any real suggestion that the white house was trying to influence, you know, policy or cases. it was much more to do with communications and messaging and pr. >> it is a pretty common accusation that the attorney general is being politicized by the white house. and there is the flip side question here. darrell issa faced a lot of grumbling and in republican circles in washington that his oversight efforts have not produced the kind of political pay dirt or the kind of revelations against the administration that many had hoped in the beginning. if you're asking whether, for example, david axelrod is talking to eric holder, it would seem equally reasonable to ask, what are the conversations with the leadership about this investigation? politics is part of the life in washington. none of these people are kind of cloistered away from it. whether the subject of the investigation or the investigators. there is an equally legitimate question about the extent to which these investigations are being coordinated by -- or being at least discussed with leadership to advance their own goals. >> that's the question, right? i don't think the issue is whether or not attorney general eric holder and president obama, when they were off message together, but the question is when they were on the same message together. you wrote in your book about how close the two individuals are. what the republicans want to know now is who knew what when. that's the question they want to know. who knew about this program that was certainly a program nobody looks at in retrospect and goes, wow, that was a good program. everyone says it was an awful idea. who knew about it and when. they want answers and they're just not getting them. >> let me ask you another question about the kill list, you write about in your book and reported to by the new york times as well and now this fbi investigation and earlier this morning we were talking about a special investigator could be appointed as well. does that mean you'll be investigated for who your sources were? >> i don't know. i've seen some reports that my book is part of this larger investigation. i don't know if that's true. >> the fbi hasn't contacted you. >> i have to say, sometimes i'm surprised at how naive people are about what actually goes into reporting. the old days of, you know, dean arch son calling up scottie reston and saying this is what the story is, just doesn't happen anymore. i had to fight and scratch and scrape for the reporting that i got. these aren't handouts. this is serious journalism, serious reporting and accountability reporting and -- >> dig into that for me a little bit more. when you say that, because it is being framed as if there is an individual who is calling up and leaking the stories. you're saying that's not how it works. >> it is not how it works, that's what i'm saying. >> it would be nice. >> yeah. the number of handouts that i've gotten in my career for this kind of journalism, i could count onhandouts or somebody at level of authority giving you information they shouldn't be. somebody telling you something -- >> it depends on how you define what they shouldn't be telling you. let me say, let me say that in the case of -- in my case, in the case of the new york times, in the case of all of the respectable journalists i know, when there is some suggestion that reporting, national security information, that could do serious damage to the national security, we go to the relevant agencies and we ask is this going to be a problem? if they say yes, we'll debate it, we'll have a serious discussion about it, but, look, we're responsible. we care about the national security of the united states. >> most recently with the warrantless wiretapping revelations in the new york times under george w. bush where they delayed a full year before they actually put it forward. in the end, in the end, through american history there have been many cases where the government did not want things released that ultimately were revealed and the public interest was in the end served by it. so if we have a blanket rule that says the government alone gets to decide what in the end is released to the public, and there is no accountability through an independent press, that's a different lane to go down. >> there is a healthy tension there. we ought to be having the arguments. it is legitimate for people to raise questions about leaks. i'm concerned about when these issues come up in an election year and these issues get politicized. but it is legitimate to ask the questions. i think it is incumbent upon us to be -- >> if you believe -- senator mccain is saying they're leaking because they're trying to frame president obama as a hero. he's always playing the role of heroic role in these. >> not just mccain, it is feinstein, a bipartisan coalition. >> no, senator feinstein did not say that president obama is being framed in a heroic capacity where senator mccain did. there is almost like a pr machine that is orchestrating these leaks. >> the premise is that these leaks are all coming from sources who have a motive -- >> agenda. >> a motive to make the president look good on these issues. well, senator mccain with all due respect doesn't know where this information is coming from. >> is he wrong? how are warmups going between now and tomorrow? what happens exactly? >> every morning the horse goes out and mile and a half worth of exercise but not at the pace he'll run the race at. so far he has good energy. today he had an easier morning to try and have a little extra for tomorrow. preparations have gone as well as we could hope. >> for you? situps, running the track? >> for me it's been answering a lot of questions. some which i can answer and some which i can't because i really can't speak for the horse. >> let me ask you this. soledad mentioned 1978 affirmed last one to win the triple crown. 11 horse since then have gone into belmont having won first two legs of the triple crown. do you see any common mistake among horses or riders talking to your guys about saying let's not do that. that's one thing people make a mistake on that we're not going to make. >> i think from all of the commentary, people are overcomplicating this. >> it's horse run. >> well, kind of. there's a lot of talk because the jockey hasn't ever ridden a race at belmont. his first ride is today and they say he'll get lost today. i think it's pretty simple. you let the horse take you to the head of the stretch and then ask him to go. that's what he's done. >> you mentioned your training at this point. has the horse ever won a worse race at this length? >> no. none of the horses have. the most any of them have run is a mile and quarter in the derby. that went okay. >> that went pretty good. >> how many horses do you own? you bought this horse for $35,000 and now you stand to multiply the value if he wins. >> i own about 30. i would like to say i butt them all for $35,000. that would be a fib. you really just can't tell beforehand how things are going to turn out with a horse. in this case we were very lucky. there have been other cases where we have spent a multiple of that and the horse is probably going around central park right now. >> how early do you know? >> well, all of the scouts and blood suck agents who are the ones who scout young horses will tell you they know when they are watching them for the first time or when they sell them as yearlings they say he has an athletic walk. you get a hint in their 2-year-old year. some horses are like people and don't blossom until three or four years old. >> i want to ask you about milk shaking. i wonder if it taints the feel of the race of the environment and the conversation frankly. >> there's been a lot of conversation about it. what isn't clearly understood is that doug o'neil was found innocent of the so-called milk shaking and he's getting a suspension for strict trainer insurer rule which means the horse had a high level of tc02 gas in his system so the trainer is deemed responsible but people specifically examining it say he didn't milk shake the horse. that's been underplayed in the media because they need something to talk about and he'll deal with that after the race. it's enough pressure going into triple crown without having to defend yourself all of the time for something you have been found innocent of. >> how does it feel as you're 24 hours away? "starting point" begins right now. ♪ >> a walk through the past with margaret hoover. the entire high school career marching before my eyes. >> he could have used taco bell. he was the skinniest rock star ever. >> not from the new menu because it's healthy. the old menu. >> extra cheese on the tacos. >> i haven't seen that since the day it went off the radio play. >> great song. >> our team this morning, margaret hoover. that was her choice. ron brownstein is with us. political director of the national journal and will cain is a columnist is blaze.com. let's listen one more second. ♪ >> let's get to our "starting point." growing battle between florida leaders and department of justice over that state's controversial effort to purge voters. the florida secretary of state is giving the doj its own deadline. monday. he wants doj to explain why it claims it's illegal for voters to remove noncitizens from the voting rolls. the department of state respectfully disagrees with doj position and actions taken by florida to identify and remove noncitizens from voter rolls ensure the right to vote is protected and not diluted by the votes of ineligible persons. >> the problem with the florida effort is that it runs out coun to the law that says you can't do within 90 days of an election. it has been approved in north carolina and georgia doing it via the right way. >> so joining me this morning is the florida secretary of state. nice to see you, sir. thank you for talking with us. appreciate it. you now have a deadline for the doj obstructing your right to hold elections there. you say they are wrong. what do you say to his answer? >> my answer to his statement is that florida has been working on this for over a year now. we've asked the department of homeland security to assist us in making sure our data bases are correct. they held up on that. if we had this information that they had last year we probably could have had this process finished by now. i also challenge his statement that the federal law contemplates that anyone who is a nonlegal individual in florida that's registered to vote should be allowed to vote as we approach the election this fall. >> so he has basically said there's two reasons that you cannot do it. he says, first the amount of time. 90 days for an election. that's under voter registration act. cutoff would have been may 14th. you are outside of that -- as of now you are outside of 90 days so it won't work. the voter registration act says the state should complete not 90 days prior to the date of a primary or general election for federal office any program the purpose of which is -- blah, blah, blah. you are not within 90 days. >> at the present time during this 90-day period we do eliminate individuals that are felons, people mentally incompetent and those deceased. those individuals might have more rates or individuals that are noncitizens would have more rights than someone who is a felon. that's why we act and that's why we continue to act as we go forward. >> there are people that would say timing is suspect. you could wait until after the election and spend a couple years trying to in a coordinated fashion remove who should be off the rolls and ensure those off the rolls and should be on the rolls are the right people. what do you say to that argument? >> my argument is as chief elections officer as the state of florida that if there's a noncitizen eligible to vote and votes in this election, they'll neutralize and delete someone else's vote that's eligible to vote and i can tell you i hear from people every day that call my office and explain that they do not want their vote eliminated by a noncitizen who is registered to vote. that's the mission that i'm undertaking and i want to make sure this fall that everyone who is eligible to vote will vote and that votes will be counted here in florida. >> as you know, this is some of the reporting done by the miami herald. of the 2,700 names identified potentially as noncitizens, 500 were identified as citizens and lawful voters. 40 identified as noncitizens. possibly four voted and they would be guilty of third-degree felony. 2,000 other people it's unclear. so you could make a mistake the other direction. the argument goes in the amount of time you have. you could take a voter who is alle eligible and block them so when it comes voting day, they cannot vote. what's the number you are comfortable with doing that. one person eligible but not on the rolls, five people? where do you draw the line. >> no individual who is eligible to vote has been removed from the voter list. everyone has been notified by the supervisors of election is given due process to notify that supervisor as to their citizenship or not. i'm confident that our due process will make sure that everyone is treated fairly going forward and no eligible citizens will be eliminated from the voter rolls. it's noncitizens that we are trying to eliminate from the rolls so that citizens that are eligible, their vote will be counted in florida. >> let me put you on hold for a second. take us back. much of this has roots obviously in 2000 in florida where there were people who claim to be purged from rolls who were citizens who were not able to vote come election day. >> 537 votes selected the president. there is a nationwide struggle going on. this is my theme of the day. there is inherently a lot of politics in this. you have a series of republican governors, republican state, republican legislators producing tough new laws making it tough to register voters and scrub the voter rolls and this against a backdrop of reality that in 2008 barack obama is polling around 80% of minority voters again in 2012 and almost all of these initiatives would have a disproportionate effect on minority voters and that is a fundamental debate talking about cleaning rolls or suppressing a constituency that you expect primarily to vote for the other side. >> let's bring it back to you. i think that ron is making two points there. you just have to look back to 2000 to see more than 500 people who were eligible voters whose votes were not counted. that was a mistake. how do you know you won't do the same thing? >> he makes an excellent point. that's what i'm trying to safeguard. 537 votes in this environment today is what we're trying to protect. people that are not eligible to vote do not eliminate people who are eligible to vote. in a close election we may need to make sure that our voter rolls are 100% accurate and have a noncitizens on our voter rolls is the problem. that's what i'm trying to solve. so we don't have that problem this year. >> isn't the argument the amount of time you have to do that now may not be enough time and you could purge people who are eligible voters. what's the margin of error that you are comfortable with on this? >> i'm not comfortable with any margin of error. our due process allows for individuals to step forward and provide citizenship information to the supervisors. if they don't provide that information, they can be removed from the polls. there is a due process and i want to remind everyone should they show up at the poll and they claim that they're citizens, they can vote a provisional ballot at the poll which can be validated after the election. that is important and guarantees every vote will be counted in florida. >> the political debate here is that the kind of people who would be targeted by this tend not to be those who would have the easiest access to the legal system and understanding of all of their legal options that would allow them to go through this due process period. they can cast a provisional ballot but fear is that people who are eligible to vote will conclude that they can't do it. >> as i'm sure you know, sir, part of the question is the number -- if you look at the stats, it's just under 60% of voters talking about in the state of florida are latino. the people who are on those rolls at 2,700 suspected at this point are overwhelmingly black and latino. those are people who would overwhelmingly most likely vote democratic. how much of this is just political at the end of the day? >> at the end of the day your assumptions are wrong. we don't look at individuals, ethnic, religious, sexual origin, democratic party, republican party, independent. this process is looked at independently as to if someone is a citizen or noncitizen and the idea of anyone's ethnic origin or party to be part of this process is incorrect and the wrong assumption. >> you can have a law that seems to be race neutral on face but if it has an impact on one group, there is that issue. certainly i think the political debate that we're seeing ferociously around the country in a number of states different versions of this is whether under the rubric of ensuring a clean election you are seeing an impact on voters that would be democratic voters. >> it's a legitimate concern of whether or not voter fraud needs to be done away with. >> isn't the question -- >> it doesn't exist. >> hold on. hold on. i'm going to -- hold on. my apologies. thank you. please, go ahead. >> let me remind everyone that in florida if you register to vote and you're a noncitizen, you have committed a third-degree felony and our job here in florida is to make sure that we have accurate voter rolls and that people are eligible to vote can vote. it does not matter their race, their creed, their party, we need accurate voting and we need to make sure that all eligible voters can vote. that's my job. that's what we're going to do here in florida. >> let's also be very clear. for a very long time the miami herald, one of the leading newspapers in florida, has documented cases of voter fraud for over a decade. dead people on the rolls. this is not like a problem out of left field that's only politicized intended to surprise voter turnout. dead people are voting, that's voter fraud. >> soledad raises the right question. what's the collateral damage you are willing -- certainly there is voter fraud. there is not mass voter fraud. how many people who are eligible to vote will be intimidated into not voting are you willing to accept? >> the secretary of state said they are doing everything they can to ensure that doesn't happen while purging those who shouldn't be voting. >> sir, final question to you before i let you go. thank you as my panel here completely erupts almost in fistfights here at the table, so when someone says this is racist and political at the end of the day and timing is suspicious and if you cared about cleaning up voter rolls you could do it the day after election day and spend time and do it right because most people would agree with you the people who can vote who are eligible to vote should be on the rolls and people no are not te eligible should not be on the rolls. the question becomes how do you do it and time you do it and who do you put at risk for not voting and are eligible to vote? >> the process that we're following is a process that we had in place for many years in florida. there's a new category considered not citizens and that process we've been following is florida statute 98.075 that's been tried and tested and the process that we're going to follow going forward so that we have fair elections. this is not a time to wait until after the elections. it's time to act now to make sure that individuals who are voting are eligible to vote and our voting rolls are accurate and clean in florida. we plan to do that. >> the folks from the election supervisors have said that they don't think they're going to get a list that's accurate so they're not going to go ahead and do this. they feel like it's not -- >> yes. >> are you going to talk them into it? >> that's a good point. i have spoken to many supervisors and they like i are waiting for the department of homeland security to give us access to save data base which they are legally required to do so that we can better and more accurately determine citizenship here in florida and i'm waiting for a letter, return letter, and response from napolitano, the secretary, who i wrote to a week ago requesting an opportunity to meet and determine how we can get access to that voter record. i think when we have access to that and we need it as soon as possible, supervisors would begin the process and reengage in the process of making sure voter registration lists are accurate. i'm waiting to hear from homeland security. >> i think the homeland security data base you were referring to, the department of justice says that's not the right one. i'll play you a little bit of what eric holder said about that. >> the problem with the florida effort is that it runs counter to the national voter registration act which says you can't do this within 90 days of an election. you can successfully do that which florida is trying to do. >> that's not the right sound bite from eric holder. he said the data base florida is requesting is not the answer. the data base does not contain on its rolls or within the data base people born within the united states. that data base will therefore be flawed and could result in exclusion of people from voting who are native born americans. when do you think it will be resolved or do you think it won't be in short-term? >> i would suggest that attorney general holder look at the privacy manual that the department of homeland security put out in which on page 6 it references the fact that the data base can be used for investigations and "voter registration analysis." that's the benchmark for which we want to use that data base and i invite him to join me min meeting with secretary napolitano in determining the value of that. we think it's the answer. if it's not, i invite the attorney general to assist us in helping to determine whether people are citizens or noncitizens so we can clear our rolls and votes will be counted and counted accurately. >> so out of time. thank you for spending a lot of time with us this morning. much more than we thought we would get with you. florida secretary of state joining us from tallahassee. thank you, sir. we appreciate it. we have to take a short break before i get killed by the control room. bill clinton is what we'll talk about on the other side doing damage control. he says he's sorry. five months until election day, what is his liability to the obama campaign? "the new york times" bestseller. it won 2004 toy portfolio gold award. it sold more than 2 million copies and the book has been out for nearly ten years. it has just been banned by a school district in erie, illinois, because of one single line. the line goes like this. some families have two moms or two dads. here's the school board president explaining his decision. listen. >> there's nobody out here that's against gays or lesbians. i'm not. we've chosen to source our materials from another source at that time for that building. >> going to hear from the school district student uperintendent moment. let's talk to the author of the book. todd parr is with us. when did you hear your book was being banned? >> about a month ago i got e-mails from people in erie and teachers saying they were trying to have this book banned in the school and the parents had used the book for years with their kids and teachers also. so it was a month ago and then it was probably two weeks ago when i heard that they had said they're going to remove the book. >> what was your reaction to that? >> i was disappointed. you know, this is book number -- written 38 books so far. this book for me was just about how do you do a book for kids and depict every possible kind of family that you can in a picture book and it just teaches about single parents and kids that are different color or divorce even and i just wanted a book that you could help as a springboard to introduce there are different families in the world and that each one of them is special and important. i was disappointed. i wasn't upset. it was their choice to do. you know, again, i just think there is such an issue with kids learn at a very young age about name calling and bullying and as soon as you can help them understand about differences, i think it's so important. >> i'm going to ask you to stay with us for just a moment while i bring in the erie, illinois, school superintendent. mr. cox, thank you for being with us. what's the problem that you have with "the family book." >> the book references families with two mommies or two daddies as you referenced. and the objection was made on the grounds that any type of sexual orientation was not an age appropriate topic for elementary schoolchildren. the community when they came to talk to the board said it was important that topics be discussed at home and i think it's also important to note that sexual orientation has never been a part of erie's elementary school social and emotional development curriculum. >> i'll read a couple pages before that line that i read. some families have a stepmom or stepdad or stepbrothers or stepsisters. some families adroopt children. some have one parent instead of two. it goes on and on in that vain. do you think at your school board meeting -- let me ask you about that school board meeting where this was decided. how many people showed up to debate this? a hot topic? were people angry? what was the tone? >> we had consecutive board meetings that were very heavily attended. we're a small k-12 rural school in northwestern illinois and any time that we have more than a dozen people at a school board meeting it's a big deal. in consecutive months we had between 75 and 100 people in attendance. at our april board meeting, the vast majority of people that spoke, spoke in opposition of using these instructional resources. >> there are people that would say other things in there might make people uncomfortable. if someone said i think having a family with one parent, not two parents, i'm uncomfortable with that. that's something that shouldn't be in any books. would that be your grounds opposed to sexual orientation which you are talking about with grounds for removing the family book? >> i think at the end of the day the erie board which obviously are publicly elected officials and a reflection of the philosophy and values of the community. i think at the end of the day, the erie board felt that this was not age appropriate. we teach all of these topics at different grade levels. our erie elementary is grade k through four. >> let me send it back to todd parr. when you hear of the superintendent saying that we don't want a book about sexual orientation and it's not age appropriate and it is what it is, what do you think? >> well, you know, it's like i write for a very young audience. i write about complicated things about earth and peace and i try to simplify them and i think that kids spend, you know, a lot of time at school. they hear a lot of things. there's name calling. there's all different kinds of families that live in erie. i think it's so important to have resources to help kids learn about that there are these difference and you're never too young to learn. this is not about sexuality but learning about all different kinds of families that exist and, you know, i just think it's so important to have -- even if it's not my book, you know they said under no condition were they going to talk about alternative families in their school like they don't exist. i'm disappointed like that. they can use any material they want because they will teach diversity and tolerance but how can you exclude certain people and still teach about diversity and tolerance? candy crowley will join us up next. welcome back. cnn exclusive this morning. a big i'm sorry from the former president bill clinton. he's getting back on track after seemingly undermining president obama and going very much off message again. this time he was talking about extending the bush tax cuts responding to controversy on "the situation room" with wolf blitzer saying this. >> i strongly committed to his re-election. and i just regret that -- my instinct -- you know me. i don't think i should have to say bad things about governor romney personally to disagree with him politically. the fact i was complementa araa his success as a business person doesn't mean i think he should be elected and president obama shouldn't. >> president clinton also praised romney's sterling business career when he was chief executive at bain capital. let's get to candy crowley. host of "state of the union." nice to see you. we were talking about this yesterday. i forgot who said that maybe president clinton is a double agent because it's like surrogates gone wild for the obama campaign. what's going on? >> well, there's a problem with surrogates and if you're a surrogate who is a former president, he gets to say what he wants. he always draws attention. i don't think there's some big -- he's getting back at barack obama for beating hillary clinton. >> conspiracy theory. >> motivation, you know, who knows. i do know one thing. he said that he made a mistake on advising the president or saying out loud that we should extend these tax cuts which the president has said he's not going to do and that he wants to cut them off for the wealthy. and president clinton said yesterday, i didn't know when these expired. i actually don't buy that. >> i was going to ask you that. really? i know when they expire. i was never president. >> yeah. when would tax cuts expire? they would expire before the next tax year, right? so i don't buy that explanation. he may have simply made a mistake. but i do believe that the essential bill clinton is this. he thinks it's a mistake to go after bain and it's clear from the things that he said that he doesn't think that is a great idea. and by the way, he said similar things about john mccain when clinton was out campaigning for barack obama and said i don't hate john mccain. he said he didn't hate george bush when he was campaigning for john kerry, et cetera, et cetera. i think he thinks it's a mistake to go after bain and he spoke the truth and i think he probably believes that the tax cuts should go on a little longer even for the wealthy because the economy is bad. he said it was in recession which it's not. maybe there was some mistakes that were made. >> mistakes were made. >> i think you got essential truth of what the former president believes. here is bottom line. he supports president obama. that's what they want to use him for. >> you don't think there will be dialing back or pulling back of president clinton. let me ask you a question about money. first time that republicans have outraised the democrats. governor romney raising 77 million and president obama raising 60 million. ed rendell said this the other day. i want to play a quick chunk. or not. where's my chunk? i'm always open to the energy. i believe in that. let me see what this has to bring. i went there. skeptical of course of what is the situation they want to do something and put my name on it. at the end of the day after i spent a few days with them understanding their company, i realized that the challenge became an opportunity to me to bring a good menu, a balanced menu, a well thought out. you know my cuisine. i'm about freshness and what people eat and our customers right now are paying attention to the way we eat. taco bell understood that. >> can it be fast food that's fresh and gourmet? >> i wouldn't call it gourmet per se because we're talking about less than $5 for what you get on the menu but it is well thought out. it's responsible. focus on ingredients and flavors and textures and that's why it is possible to do. >> this is no the new menu. >> july 5th is when the menu is going to be available in all of the stores at taco bell. >> this thing would no longer be available? >> it will be. i represent a choice. of course taco bell has their core customers. will they go for menus they like. i'm going to be completely honest. i don't go to fast food restaurants. now i'm going to be able to go. i'll bring my nephew who will have a taco and has 20 but now i will bring my friends and it's a different approach and now i think that i'm bringing a choice for people that don't go to taco bell that eat there and people that go that will enjoy. >> what's the theory? what do you think people are going to look for and what you're offering? >> i'm putting my name and my face and reputation on the line for this menu. i'm bringing the choice. i'm bringing the focus of you can have the first bite and go to more. >> specifically what? instead of what i have here? >> i was raised on rice bowl. i love cilantro. everybody knows that. i wanted that as a common thread through my menu. black beans. black beans and rice. wonderful grilled chicken made with a marinade. you have grilled corn. the sauce. i have a sauce that's delicious on top. i'm very visual. i say i like to see my food. why don't we just keep it open. >> taco bell is known for having economic menu. a dollar or two dollars. yu yours will cost more. you can get your money back if you are unsatisfied and they offer that. they say try your meal because you won't want to get your money back. >> that's the only thing i'm asking. just try it. you will love it. that's what we're able to guarantee. >> how much of this is based on chipotle's success? you watch the guy make it. >> people ask me that. i don't think it has anything to do with it. our price point is different. i was raised on the menu that i bring. i bring it to this menu. this is a platform that's here to stay and i will bring new ingredients. this company is able to bring it. >> is it a healthier alternative?
