and more than half a million bottles of instant tylenol are recalled because of complaints that the new bottle makes it hard to get the dosage right. authorities say a man arrested blocks from the u.s. capitol today represents one of the most urgent growing threats. the man picked up is a would-be suicide bomber and he was arrested as he accepted what he thought was a gun and a vest packed with explosives. our brian todd is live at the u.s. courthouse where the suspect just appeared in court. fascinating new details coming out in the court papers. fill us in. >> reporter: certainly, john. a very dramatic day where this alleged plot has unfolded in front of all of us. law enforcement officials say that they have had him in their watch for at least two months. he made an appearance before a judge. he's charged with the unlawfully attempting to use a weapon of mass destruction against property that is owned by the united states. the details, john, that you mentioned, according to court documents that during meetings with undercover officers, he allegedly desired to use and initially had his sights on attacking a rest are raunt in washington, d.c., possibly synagogues, possibly a military location and here's more interesting information from court documents from an affidavit. it alleges that last month when he settled on the capitol, he had modified his plans for an attack, that same day on january 15th of last month, at a quarry in west virginia, the proposed suicide bomb operations, he dialed a cell phone that he believed would detonate a bomb placed in that quarry. the test bomb detonated and expressed his desire for a larger bomb in his attack. he listed today as the day of the operation and he was picked up at a garage near the u.s. capitol as he was picking up what he thought was going to be a suicide vest. it was a vest gift into him and a gun about those of thoet were inpop rabl. some very interesting details. allegedly, according to law enforcement officials, he had this under. >> brian, thank you. let's dig deeper. we're joined by cnn contributor todd fuentes. they are controversial sometimes. when you have an operation like this, you have a suspect and start tracking him and the fbi gets involved with him. how does it unfold? >> these cases are reported by the hundreds throughout the world. sometimes people are trying to report on somebody they don't like, a neighbor or ex-husband or something like that. the fbi has to look at the investigation and find out if it's a credible threat or report and is this person really intent on it or is it someone trying to get a neighbor in trouble or something else. if they are finding out that this person wants to carry out the attack, that he's looking for experts and other terrorists, then that gives him the opportunity to possibly introduce undercover agents posing as al qaeda or other terrorists. and then in that investigation they should be able to record conversations, get his e-mail addresses, intercept other e-mail and determine if he's really serious. my understanding from sources today is that around december, a couple months ago, is when this really took on -- that they knew he was absolutely serious. he was intent on using a suicide vest. we heard about the initial things he talked about. but later he settles on the capitol. a suicide vest. and at that point you know that this is going to be horrific. it's going to have mass media attention doing something like that at the capitol and it would be the first time to have a suicide vest used by someone in the united states and in this case, right in washington, d.c. >> so we've heard for some time, whether it's at the cia, the biggest worry was to have a lone wolf. how did you find out if this is a single operator, a lone wolf and how much harder is it to have someone stopped and tracked if they were operating on their own. >> once you find out about them, it is almost a sigh of relief. there are co-conspirators that are going to carry out a simultaneous attack or assist him in this attack. the lone wolf is very difficult. the fbi and other agencies conduct community outreach saying, please help us. if you hear on somebody intent on doing this, he hates the united states or wants to commit an act, please report it. please tell the police and fbi and then they can start to look at, is this, in fact, that individual lone wolf and in this case, with the fbi satisfied that in fact he doesn't have other conspirators out there, if they arrest him, that will be the end of the plot. they will have the entire thing contained and they will move forward. >> they wait for that moment that they are certain and then go forward? >> yes, they can. if the subject enables them to have that ability, yes, they do. >> tom fuentes, thank you. we're going to shift now to politics. mitt romney lit into rick santorum with the same force that he usually does. idaho holds caucuses on super tuesday. that's march 6th. >> i hope people take a close look at his record because he was in congress for about 20 years and during that time the size of the federal government doubled during his time in office. he voted for billions of dollars of earmarks, including the bridge to nowhere. if you want a fiscal conservative, you can't vote for him. i am. i balance the budget. i'll get america back on track economically. >> with us now, senior correspondent, michael kroul crawley. you say, number one, don't lunch right, don't roll out a new mitt and don't stop attacking. tell us what we just heard mean and why it's so important. >> he's fired up and ready to go. sounds like obama in 2008. he's got energy and emotion. republican voters know mostly good things about santorum. he wasn't attacked in these debates. he was a senator for a long time and there's a reason why the senators have a hard time running for ofrs. there are a lot of compromises and things you sent out the door to get them done. romney's going to remind republican voters of all of the things that santorum did in the senate and i think their opinion of him may change. so i think the best strategy is to attack, attract. don't try to completely reinvent yourself. when you try to do it in a moment of pressure, it seems too phony. i think he has to live by who he is. he's not a great politician. he's got to say, i'm a manager, a fix-it man. he can pump it up a little more. that's fine. and finally don't lunch to the right. the nomination is not worth having if you can't get elected. is he so conservative. romney's best strength is that he has that moderation. i think basically fire away and see if the attacks work. >> arizona and michigan round out the month and romney was and has michigan roots and santorum is saying, wait not so fast. it's not just mitt. >> when my grandfather first came to this country back in 1925, he actually came to detroit and worked for the auto industry. and so we do have some roots here in michigan. >> we're all for michigan as this one rolls around. but give me your take on santorum. a new poll shows that he's still holding a 5-point lead. so at the moment he's holding. as you mentioned, the attacks and the ads are going up. but his growth as candidate from early on, how would you assess him? >> well, santorum? i think he's growing into it. i think he's doing a pretty good job. he doesn't make a lot of mistakes. he's done a pretty good job of staying on his message. he has maybe some problems with his supporters. a certain billionaire that caused controversy. >> off-collared humor? [ male announcer ] one pill a day. 24 hours. zero heartburn. welcome back. here's kate bolduan. >> welcome back. some news to catch you up on. good evening, everyone. just moments ago chris christie vetoed the same-sex marriage bill as he promised. this comes one day after the state assembly passed the bill. christie, a republican who opposes gay marriage, believes voters should decide the issue and wants a statewide referendum. other news we're following, a major recall we want to tell you about of infant's file nol. more than half a million bottles are being pulled over consumer complaints that the dosing syringe is confusing to use. the company says the medicine, though, is safe. and media magnet rupert murdoch launched a new paper. making illegal payments to police and other officials. murdoch staffers there are -- murdoch staffers there are now making plans to launch sunday's edition of the "sun." senator john mccain is leading a delegation heading to egypt to meet with the head of the egyptian military in an effort to resolve the crisis of american workers in cairo. one of those workers, i'm sure you will remember this, is the son of ray lahood. last night we told you about a plane being intercepted in the restricted air space. we now know more details. authorities say the cessna did not respond to repeated attempts to make contact and once f-16s forced the plane to the ground, they found 22 pounds of marijuana on the plane. even though the pilot did violate air space, they don't think he actually intended to harm the president but sounds like he's in a little bit of trouble right now. >> a little bit of trouble because he violated the restricted air space. this is the white house. if you live or work in washington, you understand, there is always restricted air space around the white house. you are not allowed to fly in this space at all. the capitol is here, washington monument here, and if you're a pilot and you're looking at the map, you have a little restricted space right here. the capitol of the white house complex and monument. you can see these other circles. this is forbidden air space and restricted air space. that restricted air space goes with the president when he 2r568s. here travels. marine one is trying to land at the airport as that happens just before 11:30 a.m. local time. a cessna from santa maria comes into that 30-mile restricted zone. it crosses in and guess what happens automatically? up come those f-16s. helicopter goes on to land safely but the cessna gets an escort. two of his closest personal friends now take him to long beach airport. they bring him in. this happens in washington not all the time but frequently. planes get into that space, the f-16s scramble, they have a bit of an interrogation. this time they found 22 pounds of marijuana. the pilots in the interviews had to answer for the marijuana but there was no evidence that there was any threat to the president, any intent to harm the president. this guys in a little bit of trouble. the president after a bref delay headed to san francisco. the moral of the story is, if the president is in the neighborhood, be careful where you fly. i guess especially if you're trying to smuggle drugs. not smart at all. the stock market is higher than it's been in years. in a moment we'll tell you what might go down first. later, the truth about rick santorum's confusing questions about contraception as we visit the culture wars. plus, two barges run into each other and oil spills. let's start with this hour's breaking news. the man and in court this afternoon authorities revealed a suspect first wanted to a synagogue here in the washington area and then settled on target and say he intended to bomb it today. he was arrested in a sting operation today as he accepted what he thought was a gun and a suicide vest packed with explosives. the house homeland security chief said that the fbi did a phenomenal job of tracking the suspect and disrupting the plot. kate bolduan is joining us again. kate? >> the reaction on the hill was mostly surprise and shock, quite frankly. the arrest occurred moments after the senate had just finished its vote on the payroll tax cut extension. the house passed it earlier in the day and was still in session at the time and i remember the capitol was very busy with tourists at the time that this all happened. a congressional representative said that they were briefed on the arrest and operation but wouldn't give too much detail. that's not surprising because they stay tight-lipped on these issues. eric cantor said the majority leader's office was briefed after the arrest was made. i've spoke with top aides as the news was breaking and as most were leaving the capitol for the week-long break and most were not arrest of the arrest or operation at all. we know that the capitol police were involved in the investigation into the man and arrests that happened near the capitol today. but over and over again today they stress that at no point where it was the public or anyone in the congressional committee in danger. earlier it was a scary reminder of what it could be, especially working on the hill and in washington. >> and a lone wolf, somebody that is hard to track. thank you. see you later in the program. in case you haven't noticed, the stock nark ket with levels we haven't seen since 2008. alison kosik is joining me to put this in perspective. where are we now in terms of a recovery for the dow? >> as far as the dow goes, when you see where the dow has been and where it is now, it's made quite a lot of ground. this didn't happen overnight. it's been a slow, steady climbs over the past several months. that's despite the uncertainty that's been coming from the european debt crisis. what you see happening are markets actually reacting to all of those economic reports that have come out lately showing that the recovery is picking up speed. the economy showing that it is adding jobs. the housing numbers, they are improving. gdp is weak but it is growing. now, we watch the dow because it's meant to be representative of the economy. it's made up of leading banks, retailers, insurance companies. and what's in the dow is the specially chosen companies. the dow h dow only includes 30 stocks. the wall street pros say other indecks are a better reflection of how the broader market is doing. john? >> and yet we are having this conversation. how significant would it be maybe psychologically or beyond that for the dow to get to 13,000? >> and you said it. it's an important milestone. it's a lovely nice round number and certainly couldn't hurt president obama's chance for re-election if the dow gets there, stays there, and goes higher. that's a big if. however, it's getting quite close. the dow sits about 50 points away from 13,000. while it's great, it's not at the peak levels that it was at before the recession. if you look at how the past five years have been, it's been a wild ride. the dow hit a record 14,000 and then bottomed out at 2009 at 6000 and since then the dow has really, really clawed its way back. but you know what, for incest stores it's all about gaining back what was lost. people want to break in and make a profit. the dow still needs to gain another 9% to reach its all-time high. it has to go up another 13% and that's what most of our mutual funds, retirement funds, 401(k)s track. that's the real index that we really want to look at. you can't deny that 13,000 is a lovely number to look at. >> looking at all of those reports, and, yeah, i'd like to break even a little bit more. >> i hear you. >> thank you for your help tonight. take care. rick santorum was a two-term congressman before his tearm as senator in pennsylvania. as dana bash reports here, that is not necessarily translating into endorsements. >> reporter: ask rick santorum's old senate colleagues about his bid for president and you get this -- >> rick santorum. >> i came out early for governor romney and i think he's best positioned to win the election. >> little of this. >> that's not the purpose of the conference. >> reporter: this -- >> nope. >> reporter: and this from one senator ranked below santorum in gop leadership. >> senator hutchinson, do you have anything good to say about him? >> oh, yes. good person but i'm not going to do politics right now. >> reporter: mitt romney has far more congressional endorsement. santorum has just three house endorsements and zero in the and santorum was a senior member of the senate republican leadership. so why the lack of support? questions about electability. multiple gop sources tell cnn many who were in the senate trenches with him like him but don't think he can win the presidency. they recall speeches like this. >> a union between one man and one woman. i think traditional marriage is good for everyone. it results in a healthier society, more stable children. >> reporter: bun gop aide called him a cultural warrior, likely to turn off moderate voters. >> i know life begins at conception. >> reporter: and gop tells cnn and crushing 18-point loss in the 2006 re-election bid. but gt thompson dismisses all of that and he's one to endorse rick santorum. >> he recognizes what the number one task will be faced and i like the fact that he talks about manufacturing and small businesses in particular as the backbone of this country. >> reporter: and some of santorum's former colleagues say nice things. >> he's knowledgeable. he's conservative. >> i love rick santorum. i think he would be a great president. >> reporter: still, no endorsement. >> i haven't endorsed anybody. >> reporter: and, john, you talked to some of his colleagues and it's pretty clear that it's not that he doesn't have relationships here, doesn't have friendships here. he certainly does. he has supporters in terms of his issues. it's just really mostly the electability issue. >> and back when it was newt gingrich, former speaker in the house, not only did he have hardly any endorsements, but is it the same for senator santorum? >> you know, i was asking that question and there was a statement, it was a freak out and it's something that we would likely see more of here on capitol hill if senator santorum, more importantly, on super tuesday. if that happens, another source says that people are going to be very, very vernervous. they know what they need in order to beat barack obama. >> dana bash, live on capitol hill, thank you. it seems nothing, nothing has changed on the ground in syria one day after the united nations condemned the government crackdown. more shellings, more attacks, and sadly more deaths. over 60 killed today alone. in the city of homs they say they've heard that the regime may launch a ground offensive later tonight. ivan watson has been in the heart of those demonstrations in northern syria. >> john, today we saw the face of the syrian revolution. hundreds of men and boys who went to pray in a mosque in an opposition-held village and paid respects to one of their neighbors who was killed by a sniper's bullet. then they went out into the streets chanting "god is great" and held a serious rally denouncing the syrian government. they said syrian tanks are massing at a base less than two miles down the road from this opposition-held village. i asked one of the activists why they participate in this weekly ritual of defiance. here's what he had to say. >> i want to send a message. every day they are shelling the building. cnn channel, please, please help us. >> reporter: john, the fact that this is still a practice like this, the incredible loss of life 11 months since the uprising began. more than 6,000 people killed and it's very clear that these people are facing the threat that they could become the next target of a syrian military offensive. the fact that they are continuing it shows that they have their backs against the wall. many of them say they have no choice but to continue in the revolt against the syrian machine. john? ♪ try align today. ask any american, ask what are one or the two biggest issues facing the president? not many would answer contraception yet it's in the news quite a bit these days in part because of a big policy misstep a. fight with catholic bishops whether their health insurance must provide free contraception coverage. it was in the news when rick santorum tried his hand at humor. >> this contraceptive thing, my gosh, it's so inexpensive. back in my days they use bayer aspirin, they put it between their knees and it wasn't that costly. >> rick santorum was smart to get some disfrom his friend. >> well, this is a supporter of mine. lots of folks say it was a bad joke, a stupid joke. it's not reflected at me or my record on this issue. >> well, here's tonight's truth. senator santorum is right. he's not accountable for a friend's stupid joke but he owes voters a statement when he has made personal and i do my best to be a catholic. my wife and i don't believe in birth control as an article in our church. >> and here's the policy. >> there must be a little bit of confusion as to what my position is. my position is that birth control can and should be available. if people want to use it, they certainly have a right to use it. i have voted in the past for funding for it for poor women. >> but, yes, there is confusion. he said his personal view is that contraception is wrong but. >> i didn't vote for any kind of ban on contraception nor did i vote for any ban on sodomies nor would i as president. >> but back in october he did sound as if he would use the bully pull pit to push his personal position. >> one of the things that i will talk about that no president has talked about before is i think the dangers of contraception. many have said, that's okay. contraception is okay. it's not okay. it's a license to do things of a sexual realm that is counter to what -- how things are supposed to be. >> so why one answer to an evangelical organization at a campaign but a different tone now. truth is, if there's any confusion, senator, he himself has created it. here to discuss that and more, terry holt, michael crowley and barbara. if you listen to that in iowa he's quoting evangelicals and seems to say, i'll have a conversation that no president is willing to have. how difficult is it on these issues to draw the lines? >> well, i think you opened up the segment by talking about, this is not anyone's number one issue. it's jobs. as a romney representative here, what we're looking at is jobs. that's what is on people's minds. to the extent that they have opened it up in general, that's what you're going to force people to pay for or religious organizations but the reason people are so upset about obama care is mainly it's killing job creation. it really comes back to jobs. we're not talking about the number one issue certainly in michigan but i think when you look at the third year of the stimulus but it has failed and has it worked and you vote for 20 million people unemployed, we need to get back to jobs. >> they were quick to criticize president obama on this issue and this is one of those issues, no matter what he said, on jobs he couldn't get attention. on any issue he couldn't get attention when he was at 2% for iowa. now that he's a looked at more d there is at least in tone, an inconsistency. >> absolutely. his political demands are different now. in iowa, he was trying to carve out a niche among republican conservatives. if you could lock down one faction, you might win iowa. now, he's playing to a larger audience. michigan electorate is more moderate. jobs are a bigger issue and he's got to start thinking about the possibility of november. this is not a winning issue in november. you're seen as being anticontraception, that is not going to win you the swing vote. this is great for mitt romney, who doesn't want to come out and attack santorum from the left, but is happy to have this unfold in a colorful way. >> knocks on governor romney has been either he's inconsistent or changed his position. if you were advising a candidate other than santorum, would you question the consistency? >> i wouldn't so much. i think part of what this is about is it being a base election. both parties are trying to motivate the most intense activists in the organizations and so, conservative candidates have talked a lot to the social values. barack obama has done what he has done. he didn't pick this part. he's trying to generate support. but i think for the american people, this is a huge distraction. doesn't have and ultimately -- and most effectively is going to win this. >> she was essentially saying hey, my husband's trailing here and he is the candidate. >> i want michigan to be there with us and give us the push we need to take the fight to obama and so i'm really looking forward to michigananders waking up and recognizing that mitt's the guy who can fix this. >> i've met main street romney, she's a delightful person. sure she didn't mean it that way, but is it smart to tell voters you need to wake up? >> there four years ago when they won and people there know mitt romney and know he has been a turn around guy. i first met him at the olympics where we went out there, no salary. then he became governor. again, working for no salary in massachusetts and now, he's going to be able to do that in the country. ann is charming and she's out there talking. she grew up in michigan. >> if your candidate's losing, do you tell the voters to wake up, looking at the wrong person?
