we're bringing you the news from a to z. it's nasty out there. tropical storm debby just stalled over florida's panhandle. it's smacking that sunshine state it with high winds and heavy rain. look at the pictures. boats getting smashed around and it's going to get worse before it gets any better. forecasters are saying the sl - slow-moving storm could dump another foot of rain on florida over the next couple of days and then spawn more tornadoes as well. that storm is already blamed for one death. florida's governor has declared a statewide emergency. look at you. you found how bad it is. give me a rundown of how bad it is and if you're in the clear at this point. >> reporter: good morning. a lot of rain overnight. this is what people are waking up to. the water is shallow enough to walk around in but deep enough for you to get a sense of what people are dealing with. everything south of the highway is under mandatory evacuation. now we are hearing washington cull la county. this was one of the hardest hit counties. they got at least 25 inches of rain over the last several days as this storm system parked itself over florida. we have seen downed trees from the wind event. keep in mind the winds associated with this storm packed a whopping 45 miles per hour at times. we still feel some of the wind. we still see some of the rain bands coming through. a lot of the rain has tapered off at this time, but clearly, it's left a lot of flooding. forecasters here expect this area could see another 10 inches of rain before it's said and done, possibly by thursday. >> that's a nasty storm. what are the police saying there about just how dangerous it is to stay in your homes or businesses? >> reporter: well, again, people are waking up to this sort of thing. we were driving along this coastal highway 98 and you see in different places police officers are stationed to make sure that drivers aren't surprised when they run into this standing water. water anywhere from 6 inches to a foot or two feet in some places. that's a big concern. also as we see the rain bands associated with the storm come through this area from time to time, there's always a concern about tornadic activity and also flash flood warnings still associated with this area. >> bad news in the panhandle for sure. by the way, to remind our viewers, you don't know if it's an inch or if it's a foot when you're driving on a road that's covered in water. >> reporter: don't gamble. >> great advice. thanks, george howell. meteorologist alexandra steele is tracking the storm. she's at the weather center in atlanta. what's the storm doing? >> well, you know, turn around don't drown. so certainly stick to that. here's debby. the circulation is still over water in the northeast gulf, but you can see all that convection has been and continues to be to the east of it. here's the good news. the movement from stationary to 3 miles per hour. but now a direct easterly track, which is certainly some good news. 45 miles per hour sustained winds. not expected to strengthen until we're going to see it come over land by tomorrow morning. then it will weaken, but then over the gulf stream, it has the potential to strengthen once again. so all eyes on that. we're calling it a dead zone. it's between two areas of high pressure so there's no steering currents. here's the rain south of tallahassee. we have seen 10 to 20 or in access of 20 inches of rain. this is where the access of the heavy rain will be into southeast georgia over the next 24 hours. so finally we'll begin to see some movement and that's the good news. center of circulation will make its way on shore tomorrow morning and hopefully get out of here. >> all right, thank you. appreciate that. here is the results of the rainfall in one area of florida. you're not going to believe what you're about to see. this giant sink hole is near gainesville. that earth just giving way because 7 inches of rain fell on sunday. while it might not sound like the highest, it's the secondest highest recorded ever for that city in a single day. i don't know what it is about a sink hole, but i always find it shocking. chad myers once described why it happened, and it makes sense, but i always marvel. we have live coverage every half hour of the storm so stay tuned. 5 minutes past the hour. arizona claiming victory after the supreme court struck down most of its controversial and tough immigration crack down. even though most of the law shut down, all the justices upheld the part of the law they had the most problem with. the power to say, show me your papers. the arizona sheriff joe arpaio saying this decision changes nothing as far as his department is concerned. >> we arrest anybody that it violates the law. e we don't care where they are from. it just happens that we are close to the border and a lot of people coming in come from mexico and are here illegally. that's not my problem. >> a lee na cho joins us now with more on the controversy. >> 3 out of 4 provisions of the law were struck down, but this is the most controversial. both sides are claiming a little victory. for those who don't know what me what show me your papers means, it means that police officers essentially can ask for proof of immigration status while enforcing other laws. for example, during a traffic stop. while the high court didn't tell arizona what they could or couldn't do during that traffic stop, this opinion is essentially seen as guidance going forward. how will you enforce it? at the heart of the issue is this. what exactly is reasonable suspicion that a person is in this person illegally? anthony kennedy wrote, there is a basic uncertainty about what the law means and how it will be enforced. jeffrey tuben says it is vague. >> i think this means that as all the other states weigh whether to change their laws and then courts weigh the challenges to those laws, we're still in a bit of a mess on this. the guidance from the supreme court was less than clear here. so the issue of what's permissible and what's not, it's a little clearer than it was this morning, but it's not totally clear by any means. >> all right. if you're boiling it down, it's not over yet. in essence, the supreme court is offering a wait and see approach to how arizona enforces the law, which of course, could open the door to future challenges. and arizona, let's not forget, is the only state that would allow police to ask for proof of immigration status when making a traffic stop. alabama, georgia, south carolina, and utah have similar laws in place. so not just arizona, though arizona gets the most attention. >> how much do voters care about this issue because everyone is watching. how is it going to affect the election in four months? >> you know what's interesting, not much. in fact, it was last on the list. if you're looking at the list, the number one is the federal budget deficit followed by health care, economic growth, unemployment, gap between rich and poor, and just a 5% care about immigration policies. and even if they did, as you well know, it will take a long time before legally this is worked out. wait and see approach. they want to see how this provision of the law is enforced. does it amount to racial profiling? will arizona and other states be able to move forward without problem? >> what does it mean to be reasonable? >> that's right. >> that's voters in general, right? >> yes. ahead this morning, luis gutierrez, joins us at 6:30 eastern. and later on "starting point", the impact on the streets and the election. soledad will be joined with carlos gutierrez, luther strange, and russell pierce. >> you just heard us talking about the issues that voters find most important and guess what? we have another big one for you. the anticipated supreme court decision on health care. we're supposed to find out about it on thursday. they will make that rule on president obama's health care law. a decision should have an immediate and long-term impact on americans on how they get medicine and health care and could have a big effect on the 2012 race as well. the court could decide to toss out that key provision. that's the part of the law that requires every american to get health insurance or face paying a penalty. two jurors in the jerry sandusky trial opening up about what they witnessed in the courtroom and how they reached their decision in the case. this was on "a.c. 360" last night. talking about the creepy expressions that convicted child molester couldn't even hide in court. >> i didn't see anything in the victims that would lead me to think they were not credible. but i also took a look at sandusky while he was watching the victims testify and it seemed to be that he was kind of reminiscing of the victims. >> what do you mean by that? >> reporter: seven active fires here in colorado and more in new mexico. it's been such an intense year for fires out here in the west and we're only in the middle of june. they got good news here on this fire outside of colorado springs yesterday. 5% containment. they were able to create a small amount of fire line to get the first toe hold against this fire. the bad news is they expect this fire could potentially double in size and could be three weeks before they have it fully contained. today they are going to be out there again trying to get more containment. they expect red flag warning conditions again today. that means high winds, high temperature, and low humidity. that's what make s it so hard for these firefighters to advance on the fire and what makes the potential for more fires to break out. yesterday several small fires broke out but were able to knock those down. but these conditions are so dry they know that at any moment, new fires could break out adding to the huge efforts already. there's over 2,000 firefighters at another fire north of here. there are 600 firefighters on this one all trying to get control of these blazes. >> you have to feel for those firefighters in those tough conditions. jim spellman, thank you for that. 17 minutes past 5:00 on the east coast. let's get you up to date. christine romans is doing that for us. >> still following tropical storm debby and she's a rainmaker sitting off florida's gulf coast. it's already drenched the state and another foot of rain is expected over the next few days. the storm has also spawned tornadoes. the governor has declared a statewide emergency. rescuers forced to suspend work at a roof collapse. officials say there's a high probability the interior of the shopping mall could come down. this comes hours after workers heard what they believe to be sounds of breathing in the rubble. at least one person is feared dead in the collapse. a horrifying story out of texas this morning. police in waco say 22-year-old michael daniel was high on the drug k2 when he began beating, choking, and biting the family dog. officers found daniel sitting on the front porch with the dead dog in his lap and a piece of flesh and fur all over him. ten postal workers are on a hunger strike outside the capitol. they are protesting massive cuts at the postal service that will eliminate 28,000 jobs. the workers say that eliminating the congressionally-mandated payments for costs will solve the financial problems right now. >> all right. thank you very much. we're getting an early read on local news making national headlines. dillon mcdermott helped solve the mystery of his mother's tragic death. he asked police to reopen the investigation. the republican american newspaper says police discovered evidence that shows that diane mcdermott was murdered by a gangster boyfriend and she did not commit suicide. the actor was just five years old at the time. and this one is being called by police as gut wrenching and disheartening. a california teacher is facing criminal charges after being accused of tasing high school students. this one is from "the l.a. times." a teacher at fontana high school directed four students to enforce the hazing in order to limit behavior problems in the classroom. the students have also been arrested and one of them has been charged with assault and attempted sodomy. police say at least one of the victims suffered injuries in those assaults. and it 3pays to be a pc if using orbits. it steers mac users to more expensive rooms. that's because the search results are tailored for shopping habits. and mac users spend more. they spend 30% more a night on hotels. or bit z responding to the report. >> reporter: good morning. the rain has tapered off this morning, which is good news. want to show you this though. the owner of this convenience store put out these sandbags, because the owner had an idea of what was to come. take a look at the lot here. this area covered in at least a foot of water. you can still see the impact here of the strong winds. strong enough to knock over a couple trash cans here. this is what we're seeing here in isolated spots in low-lying areas. you can see where the water is up to a foot in some places. we see police officers here on the coastal highway 98. just making sure that people are aware as they drive down the road that standing water is present. and again, this county got at least 25 inches of rain here in the last few days. forecasters are saying that even though the rain has tapered off now, we're still seeing the rain bands from time to time. still feeling the winds at times. we could see another 10 inches of rain before all is said and done, possibly by thursday. >> all right. george howell, thank you. meteorologist alexandra steele is tracking the storm for us. she's in the weather center in atlanta. i'm looking at these models. you do this better than i do. but this is a big, fat, ugly, swirling thing that's blob-like and most move fast enough to give people relief. >> that's the meteorological blob. you're right on the money with this. i was calling it drifting debby. yesterday really stationary. didn't have any movement. it was kind of stuck in this dead zone with no pushing mechanism. the good news today, now it's moving east at 3 miles per hour. where george was, the hardest hit. 21 inches in st. marks. the worst is over in terms of the downpour of rain because it has movement. maximum sustained winds at 45 miles per hour. we're not going to see any strengthening today. here's the good news. tomorrow morning we are going to see the center of circulation make landfall and then we'll see it weaken. as it gets in the gulf stream, we could see it regenerate into a tropical storm again, but then it will move out. so in the dead zone, the wind shear took a toll. the dry air worked its way in. as we talked about yesterday, flooding will be the calling card of this. so here are some of the totals we have seen. over 20 inches in saint marks. and again, this is where it's hardest hit. the access of the heavy rain will move east. we'll talk about who today will see the heavy rain and how much more is expected. >> just really quickly, we're talking about 25 inches of rain in that state in some areas before the storm is done battering them. i don't know. i have never heard about 25 inches of rain in a few days. is that at all normal for florida? >> absolutely not. unheard of, record-breaking, certainly unprecedent ed. so that coupled with the storm surge, which is the water rise above the tide levels along the coast. so this is an incredible maker. in terms of the movement of, or the lack thereof, it just dumped rain e. it doesn't dump rain and moved, it stayed over the same areas. >> the blob that won't move. alexandra steele, thanks so much. appreciate it. 34 minutes past the hour. the difficult we do immediately, the impossible takes a little time. check out this dramatic video of the coast guard swooping in to rescue a family of nine and two dogs and then to air lift them to safety. they were stranded on dog island, florida. flooding rain surrounded the home and they were unable to evacuate to higher ground. amazing pictures. we'll be following this story throughout the show today. live team coverage every half hour hereon cnn. get used to hearing the term "show me your papers." it's going to be in the news a lot. the supreme court has ruled that major portions of arizona's tough immigration crackdown violate the constitution, but the part that was angering a lot of people, the "show me your papers", that's still on the books. alina cho has been up all night break i breaking it news. >> good morning. what's so interesting about this is there was a lot of disagreement on the high court about the other parts of arizona's hotly-dedebated immigration law. but the high court was unanimous in its decision to uphold the most controversial part, "show me your papers", which critics call racial profiling. >> reporter: the supreme court struck down 3 of 4 parts of the illegal immigration law. but politically both sides are claiming victory. >> the court unanimously upheld the portion of that section and that is a victory. it's a victory for the rule of law and it's a victory for the people of arizona and for america and for the tenth amendment. >> reporter: in a statement, president obama applauded the court's decision saying he was pleased the justices struck down key portions of the law. the only provision upheld by the court is also the most controversial. the so called "show me your papers" section, allowing police to ask for papers while enforc enforcing other laws. >> it probably means that person will be hispanic. it's going to be ethnic profiling on a grand scale. >> reporter: joe arpaio insists his officers don't use racial profiling, saying those arrested are merely victims of proximity. >> we arrest anybody who is in violate of the law. it just happens we're close to the border and a lot of people come from mexico and they are here illegally. it's not my problem. >> reporter: the president expressed concern over possible racial profiling saying, no american should ever live under a cloud of suspicion just because of what they look like. he then went a step further canceling arguments that allowed some arizona police departments to enforce federal immigration laws. instead the justice department said its setting up a telephone hotline and e-mail address for public to report civil rights concerns and that prompted an angry response from arizona's republican governor jan brewer. >> and they arbitrarily single out arizona and send a bomb. what he's telling us is arizona, you're on your own. take it or leave. it i guess he doesn't think we're part of the country anymore. >> as all the other states weigh whether to change their laws and then courts weigh the challenges to those laws, we're still in a bit of a mess on this. >> so what jeff toobin is saying, it's not over yet. it's all about enforcement. how will arizona and other states carry out the "show me your papers" provision. what's reasonable suspicion and will it amount to racial profiling? joining us is clyde williams. thank you for coming in. you are no secret to politics. you have been in the democratic party for a long time. you have worked for presidents. you have been with the democratic national committee. but for a lot of people, i think, they might say this seems mean. it seems almost as though you could be considered, you and your other fellow challengers, could be considered vultures over top of a hospital guy in a hospital bed tainted with ethics. >> it's not about me or charlie rangel but about the future of our community and who has the best ideas to move our community forward. that's what i focus on. i never bring up the congressman's ethics issues. from day one, i never thought that was the way to run a campaign. i believe people want people to talk about what is the best way to improve their lives and how are you going to do something. >> did you jump into the race because of the ethics scandals in the last two years? >> i jumped into the race because i thought i had the best ideas. i'm the only one running against him who has taken a poll. based on that, i decide to mount a real campaign. >> so let's talk a little bit about the congressional distr t district. things have really shifted a lot in his 42 years. i still can't believe i talk about someone who has held a job for 42 years. but things have really changed. it used to be an african-american district. and now there's been a 27% increase in same-sex couples ands a hispanics are now the majority. >> i don't see it as anything that's a challenge. the district has at least 46% latino for awhile under congressman rangel. the most important thing people want you to articulate is a real vision and how to address their problems. i have the endorsement of "the new york times." i got an endorsement of "the daily news." >> did you get president clinton's endorsement? >> i'll tell you what i do have. president clinton said he would not endorse charlie rangel because i was in this race. president obama has not endors d ed incumbent. they have not endorsed him or me either. >> for his part, charlie rangel has some good endorse mements i his column. he has the governor of the state and he has the mayor of this city. it's a big deal. but there is that lack of the endorsement check mark from the president. let me ask you this. he's a huge personality. he's famous for those who have never even been to new york. he's been in congress and he's the third-longest serving congressman. is there any part that you think is an uphill battle? sometimes might feel guilty when they get to the ballot box. >> i like the congressman. but this race is not about him. people want someone to solve the decade-old problems in our district. when you look at the unemployment rate in our district x it's more than twice the national average and has been that way for decades. when you look at the health care disparities, again, they are large and they have been for a prolonged period of time. the same when we look at achievement gaps. these are decade-old problems and i'm the best person, i believe, to do something about solving those problems. >> the polls open in about 10 minutes. are you going to vote in on hour? >> reporter: indeed it is. good morning. this is what people are waking up to. you see this lot covered in at least a foot of water. this is not a surprise. you find this in these low lying areas here south of the coastal highway 98. parts of this coastal highway 98 south of it are under a mandatory evacuation, this is one of the hardest hit counties? the state of florida as debby lingers along. this county saw 25 inches of rain in the last several days and they are expecting 10 inches more before all is said and done by thursday. keep in mind. this is what we're dealing with here but in live oak over in lake city, they are just now starting to deal with the flooding from the storm as it lingers overhead, dropping just a lot of rain in a short amount of time. >> all right, george howell, reporting live in florida, thank you very much. our meteorologist alexandra steele has been tracking this storm and it's kind of a boring job because this thing doesn't seem toe want to move. you and i have been having these quick hits and the hits don't change because it is a multiday hassle. >> there is an end of sight, about 22,000 people live with george is, hardest hit area in saint marks and over 21 inches of rain. it is probably moving, all be it at a snail's pace but it's not stationary anymore. eastward momentum. here it is, tropical storm debby, the center of circulation with this is still offshore. no significant change in strength will occur today until it moves over land which will be tomorrow. that is the good news. we're going to watch it finally make its move. here's the national hurricane center's pace, you can see it moving on land and it will weaken tomorrow. when it gets into the gulf stream it will restrengthen again but it will have pushed eastward. flooding will be the calling card of this. we even thought so yesterday because of its stationary station. south of tallahassee, this was the bull's-eye, 10 20 inches of rain. you can see saint marks down to sanborn, 16 inches. southeast georgia, that's who will really see the heart of it today and tomorrow then we'll finally see it move on out. >> thanks so much for that. >> sure. >> here's a view a cnn ireporter is getting from her home in pasco county florida. she was stuck at home unable to get to work. she is saying who hoo in the background, she's a nurse. there's no flooding damage to her home yet. we're not getting far from the story throughout the show. live team coverage every half hour here on cnn. another big story we're following this morning, arizona claiming victory, so are the feds too after the supreme court sfruk down most of the controversial and tough immigration crackdown law. all of the justices upheld that one part of the law that critics said they had the biggest problem with. it was the part that gave the police the power to say, show me your papers when they pulled someone over. the man who has become snon mouse with this law, joe arpaio told erin burnett this decision changes nothing. >> we arrest anybody that violates the law. we don't care where they are from. it just happens we're close to the border and a lot of people coming in from mexico and they are here illegally, that's not my problem. >> well, kind of is because it's his state, he'll deal with it in his jurisdiction. a lot of people are confused because if there's a police officer pulling you over because you might have run a red light or done something that led him to pull you over, he did ask you, show me your papers but if you don't have papers can't do much about it. >> that's why it's essentially going to take another year for all of this to pan out. i think first it's important to explain exactly what show me your papers is. it's the section of arizona's controversial law and it means that police officers can ask for proof of immigration status while enforcing other laws, for example during a traffic stop. the question is, what do they do after that? while the high court didn't tell arizona and other states what they could and couldn't do, how long police could hold someone or whether -- i'm sorry how long they could hold someone, the bigger question is, does this amount to racial profiling. this opinion we should say is essentially guidance going forward. at the heart of the issue is this essential question, what exactly is reasonable suspicion that a person is in the country illegally. justice anthony kennedy wrote this is a basic uncertainty about what the law means and how it will be enforced. it is guidance that our own senior legal analyst jeffrey toobin, admits is vague. >> this means as all other states weigh whether to change their laws and courts weigh the challenges to those laws, we're still in a bit of a mess on this. i think the guidance from the supreme court was less than clear here. the issue of what's per missible and what's not, it's a little clearer than it was this morning but it's not totally clear by any means. >> that's right, it's not over yet, folks, the supreme court is offering essentially a wait and see approach to how arizona enforces the law. this is all about enforcement which could, of course, open the door to future challenges. arizona is not the only state that would allow police to ask for proof of immigration status while making a traffic stop. there are other states, including alabama, georgia, south carolina and utah. all of those states have similar laws in place. not just arizona though it does get the most attention, jan brewer, the republican governor quite outspoken. she was very happy -- >> called it a win. >> she said it was vindication. she said the heart of the law was upheld, of course, like i said before, there's a little something for everyone politically. >> what i thought was really fascinating some of these polling numbers coming out. last week we were talking about the conference in florida and how both of the top candidates wanted to vi for their attention and turns out -- >> there's a poll that polled both registered voters in general and u.s. hispanic voters. and in both cases immigration was nearly at the bottom of the list, a dead last among voters in general and near the bottom of the list for the hispanic population. what's interesting is we talk so much about unemployment and the economy and so forth, health care actually moved to number one on the list. >> i was surprised for that because i thought it would have been education. >> it is interesting, you talk about health care and the economy second. >> i would have thought economy would have moved to number one. excellent reporting. staying up all night to do that. never gets any sleep. >> congressman luis gutierrez will join us. when the supreme court is expected to rule on president obama's health care law, the decision will have an immediate and long-term impact on all americans, both in how they get medicine and health care. it could shape the 2012 race. the court could toss the individual mandate part of the law which requires almost every american to have health insurance or pay a penalty. two jurors in the jerry sandusky trial are opening up about what they witnessed in the courtroom and how they reached their decision in the case. on ac 360 they opened up and one said it is the beginning of our time to heal, also talked about the creepy expressions, that's how it was described, creepy expressions the child month leflter couldn't hide in court. >> i didn't see anything in the victims to leetd me to think they were not credible and watched sandusky while watching the victims testify and it seemed to be he was recommend nising of the victims. >> what do you mean by that? [ engine turns over ] [ male announcer ] we created the luxury crossover and kept turning the page, this is the next chapter for the rx and lexus. this is the pursuit of perfection. welcome back. out of control wildfires in colorado are growing more aggressive, they are shutting down major tourist attractions and forcing 11,000 people to flee from their homes, flee for their lives, weather condition fueling the flames, not expected to get any better at least for a week. our jim spellman is live from colorado springs. there are roughly half a dozen of these major wildfires that are burning right now. and the weather doesn't look very good at all. is there any good news on the horizon, jim? >> well, there is, yesterday firefighters were able to get -- just a toe hold against this fire, 5% containment, able to make fire lines using bulldozers and hand cruetools, so that's g 5%. they want to add to that today to get -- create more of a sort of the safety margin that will lead towards 100% containment. the assessment is it would be three weeks before they get this fire completely contained. before they get to that point it could double in size. they know what they are up against here, it's not going to be easy. right now here overnight, the winds have died down and it has gotten smokeyer here, when the sun comes up and we get into the afternoon, it's going to be another red flag warning day, very high winds and high temperatures and extremely low humidity. yesterday afternoon when the winds picked up, the flames picked up and huge columns of smoke went up. they have to use this life cycle of the fire to take advantage of quiet times to hopefully get more containment. they have 600 firefighters on this fire alone near colorado spring and several thousand more across the state trying to keep these fires in check, even yesterday we saw a couple of new fires pop up. ne they were able to knock them down. new fires could pop up any time. >> you think about 100 degrees plus they are having to work in then the degrees added to it by the flames as well. >> reporter: brutal conditions. >> you're right, brutal. jim spellman, thank you. good job. >> 16 minutes past the hour. here's christine romans with this morning's top stories. tropical storm debby flooding the sunshine state. debby is parked over the gulf of mexico, torrential rains have flooded coastal areas and florida could see another foot of rain before debby is done. the storms also spawned tornadoes which are blamed for one death. florida's governor has declared a statewide emergency. nato diplomats condemned syria's downing of a fire it fighter jet. turkey's prime minister says there was no excuse to attack even if the plane strayed into syrian air space. the former director of a california water agency has been charged with felony child abuse after caught on camera beating his stepson with a belt during a game of catch. he quit his post after the video went viral and he'll be arraigned next month. his lawyer says his client is a loving father and his actions were misinterpreted. critics are accusing facebook of pulling a fast one without asking for permission, facebook said it announced in april that it was updating urls and e-mail addresses but did aannounce listed addresses would be changed as well. you can change your default setting. >> i don't like having to do something if i don't want to. >> you open your life to your friends and they have all of that control. >> good points, thanks, romans. >> speaking of stuff like that, online stuff that annoys you, how about trying to book a bargain trip? the kind of computer you're on may determine what kind of bargain you get. listen up mac users. with the spark cash card from capital one, olaf's pizza palace gets the most rewards of any small business credit card! pizza!!!!! what is reasonable suspicion and will it amount to racial profiling? for now these are still open questions and court watchers say it will probably be another year before all of this is sorted out. >> thank you, alina. to talk more about this, let's bring in congressman luis gutierrez, a democrat representing illinois. he's been a vocal opponent of sb 1070 since it was enacted. thanks for being with us. >> pleasure to be with you this morning, zoraida. >> something you said on nbc chicago yesterday, i'm going to read aological bit then i went you to respond. what the supreme court says is it's okay to leave a mandate that says if a police officer has a reasonable suspicion that you're not in the united states of america legally, he has a mandate to stop you. and if you can't prove it, to handcuff you and put you in jail. is that how you're interpreting this, congressman? >> that's not how i'm interpreting it, it is the law in arizona. he has a mandate, a responsibility. if he has a reasonable suspicion that you have an immigration problem to detaining and to detain you until you can prove otherwise. that is why the statute is so controversial. now, we can have a long conversation about how it is that police officers going to arrive at the conclusion that it's -- he has a reasonable suspicion, but i look at the supreme court and i don't think justice scalia will probably have a problem being asked for his papers or whether a police officer will have a reasonable suspicion. this is about targeting and finger pointing a particular community and scapegoating that community. we know that's what they've done. they did it in california under pete wilson with proposition 187 in the '90 aegs and now a new version in our current time. it's not -- it's scapegoat and finger point in order to school political points. >> the supreme court was concerned about racial profiling and they have set up a telephone hot line and e-mail address for the public to report potential civil rights concerns. doesn't that address your concern and your issue? >> well, it does, but i just think the supreme court -- look, zoraida, i was sitting in the supreme court when the arguments were being made. i was taken aback when the solicitor general said we are not making the argument that 1070 is racial profiling that can violate people's fundamental civil rights. they didn't make that argument so the justices just didn't take in into consideration. i and others in before the supreme court, our making that argument and others that you have reported this morning that will make their way through the court system. i've got to tell you, when you see the first 100 people stopped in arizona and they are all gonzalezes and martinezes and the like, you're going to see the challenges in court will prevail. >> they are expecting that to happen, the supreme court -- i'm sorry for interrupting. expecting lawsuits to be filed? >> absolutely. one of the things the supreme court said was we're going to let this provision remain but we're going to monitor it and we admonish you to be very careful as you implement this. i was kind of like, well why let them do it anyways if you have concerns about the implementation. obviously the concerns that they are, they are going to be taken up through the legal system. and i have to say, i think zoraida, you and i will have a conversation hopefully at 5:30 in the morning and find out it is ruled unconstitutional. >> i welcome that conversation if and when that happens. i want to switch gears and talk about charlie rangel. he's facing three challenges in new york, his first run since the allegations. what do you think will happen in the primary?
