conference, and this will show you how important the latino vote will be in november. the polls show that president obama has a huge lead over mitt romney, and 66% to 24%. but here in florida the president is tight with his lead over romney where he trailed by 12 points. in romney's speech today and i want to bring in the panelists here, jim acosta who is inside, and we will go to him later, and juan carlos and also the executive president of naleo, and i want to start off with u you, juan carlos, first of all, anything surprising with the this speech? a lot of build-up and people want to bring something back home to the constituents. >> the tone. the tone on immigration, an is a different and different message. he recognizes the importance of latinos in the community, and what they provide to the economy and the businesses they create and the importance of the latino family and he says i do not want to separate the families and i want the u.s. citizens and residents to have the same time to process is trelatives. he is saying that immigration needs to be humanitarian issue and not law and order issue, but if you break the law, we have to deport you, but it is a different framing than in the last few months. >> this is something that naleo has been focusing on mano a mano, and he is talking about the 11% unemployment in the hispanic community and 2 million hispanics living in poverty and were you listening for more on immigration specifics or focusing more on the economic issues? >> well, he did something smart focusing on economy and immigration reform. polls show that latino voters are more concerned abo suffering from the great recession and the job loss and being part of the economic recovery. we are guard to immigration, the most important thing that the governor said is that he recognized we have a broken immigration system so there is common ground to work with and that is an important statement on behalf of the governor. >> any specifics that made you feel that this is a something that is a real policy change or sound like a simply political speech? >> well, some of the specifics about immigration, i took to heart and the emphasis of keeping the families together and priority to spouses and children of residents for green cards and what he said that i thought was one of the winning line lines he said is that he would staple a green card to anybody who earns an advanced degree. i think that really goes to the importance of education in our community, and i would hope that this signals an opening here for the greem act. >> the dream act, and we know that he did not endorse the dream act, one of the policy advisers made a point to tell jim acosta inside that he did not go that far. what do you make of the fact that he slams president obama and says this is a short-term fix, if you will on immigration, and the late st announcement tht president obama made just last week that those young people who are meeting certain requirements will avoid deportation. >> well, we have to bring in senator marco rubio and bring him up in the conversation in ones such as this, and he was working on a project similar to the dream act to legalize the young people, but not a path to citizenship, and with the president's announcement, they did that, they will not be deported and in at least two years, receive a work permit and not have a path to citizenship, so i think that this opens the door to negotiations to have something that is permanent and comes from congress and gives people more stability, and they know that this is not something that is going to change. now governor romney has not said that if he reaches the white house what he would do if he would either maintain the policy or he would revoke it, so it is very interesting to see that. he is talking about permanent issues, and he is receiving advice from people like senator rub rubio. >> i want to bring in jim acosta inside of the room. jim, tell us where the applause lines were and did he get any people standing on their feet regarding some of the things or his announcements or what was the mood in the room? >> well, you know, it was polite applause for mitt romney here in this crowd, suzanne. i would say that the strongest applause that he got was when he talked about how he would like to see a path to legal status for the children of members of the armed services, and people who are in the armed services. but that is a policy proposal that he has laid out before and talked about it for many, many months so it is not really new. i have to tell you, suzanne, that what happened here today, and this is really backed up by what a campaign policy director told me a few moments ago, that this is really laying out broad principles, and he wanted to challenge the president and take on the president and point out the fact that the president did not get comprehensive immigration reform passed in the first term of his administration, and that is about all that we got out of mitt romney today. he did not take a position on what the president did late last friday with that policy change with respect to the deportations of young undocumented people in this country, and i will tell you, suzanne, after the speech, i broke awayf a we talked last and i met up with an undocumented college student in the crowd and she told me in an interview moments ago that she went up to mitt romney, and tried to get him to come to her, and she said that she is furious that she did not get direction from mitt romney about what would happen to her life if he would become president. so suzanne, some people were in the room disappointed, but at the same time we have to acknowledge that this is probably a predominantly democratic crowd. remember, this is a crowd of latino elected officials and as we know by looking at the polls a large majority of the latinos in the country favor the president in the upcoming election. so it is not too surprising that the applause was polite and not thunderous in here, susan. >> and talk, jim, in here about the strategy, because of courbv, they are here for a reason, and they don't believe they are going to win over in grand fashion the latino community, but certainly here in florida every vote counts, and what are they hoping for and wishing for in terms of shaving off the margin just even a little bit to get to gain some track shawn here? >> right. >> and suzanne, as you know, e e are in the state where every vote does count, but maybe not in all cases. but, yeah, no. what mitt romney is trying to do here is to talk about the economy and we talked about that a few moments ago and his message, no matter the crowd that he is talking to is about the economy. if it is latino leaders, it is the economy. and keep in mind that he is going to be talking to the naacp next month and he will be talking about the economy and that is the message from here to e election day. jeb bush is coming up and that is a speech coming up and he is obviously a popular political figure in the state among latinos and tomorrow senator marquee rubio ma marco rubio is going to be talking, and what we have not talked about here at naleo is what will happen with marco rubio and whether or not he is being vetted and whether or not he is going to be put on the republican issue, and not just immigration, but a issue that a lot of latinos are going to be watching in this state, suzanne. >> and don't forget as well that president obama will be addressing this group tomorrow to talk about the immigration policy, and economic policy and the reasons that he believes that the latino community should vote for him for another four years. jim acosta, thank you so much, and juan carlos lopez, and mr. vargas, thank you for taking your time. this is what we are working on this hour. the night he killed trayvon martin, george zimmerman reenacted for police what happened and that tape has been made public, and we will play it for you in moments. and both sides of the jerry sandusky trial are wrapping up the closing arguments, and hear what tactic the defense took to try to save sandusky. we are going live to the president, and he is about to speak in 30 minutes or so on the rising student loan rates and a problem he is blaming on republicans. do you see it ? my next guest actually thinks so, and victoria defrancesco desoto is a professor at the university of texas and also a se senior at the the center for women and politics, and i love this, because you are like mama latinos here, and we have had the walmart moms and the soccer mom moms and what is making the difference? >> this is the year of the latina mom, and let me tell you that the focus of the latina mom is on the mobilization, and not the swing vote like the soccer mom or the walmart mom, but it is about seeing what these women do in their family. and latinos have bigger families and multigenerational households and these women are the nucleus and make it go around and if we can get them mobilized and get them to light a fire under the family, then we will see more turnout. >> anything that you heard from mitt romney today that makes you and other latina moms get fired up? >> well, the fact that he came. you know, he came. there was a lot of question whether or not he would come. he did address the question of immigration, but i do not think that it is that shot in the arm that latinos were waiting for. the devil is in the details, and we are still here with an open mind to see what he lab rates on later, but latinos want a bigger project. >> what are you listenening for? what are you hoping for? is it about economic concerns or jobs or providing for your families or school choice for your kids? >> it is all of the above. i mean, we do know that for latinos, immigration and the economy are the top two issues. we have the toughest recession hit, andp the unemployment rates, and we don't want just one, but no silver bullet regrettabl regrettably. >> what do you think as a community and mothers to look to the families and the children and encourage husbands and families to participate in the elections, what do you want? >> we want fixes. we want jobs, but at the same time we want a future for our children when they graduate. it does us no good to have a short-term solution, and when we go forward our kids are going to go to college and no future ahead of them. >> tomorrow, president obama is going to actually come here to speak before you, and was this policy shift last week allowing some illegal immigration, young ploi illegal immigration who meet some criteria to stay in the country, was that enough? do you feel he made a strong enough stand or look like a last-h minute political move? >> well, we do know from the survey evidence that a survey went into the field right this past week right after he made the announcement with the latino decisions, and we saw over to the weekend that enthusiasm of the latino voters shot up 50%, so there is enthusiasmp, with but the problem with the president is that, latinos support the president, and now they will turn out. that is the key question. they can answer yes on the surv survey, but november 6th, where they are? >> well, more or less the judge drop dropped the total charges down to 48 in one of the instances today, because he believed that one charge was redundant, and so he dropped that. and the other ones he had a conflict because he said that the testimony didn't match the charge anymore, and that the testimony that came out during the case was about something else that wasn't directly the kind of sexual assault, and so he threw that out as well. so we are now again down to 48 counts, and a lot of counts anyway. but beyond that, suzanne, the first thing we heard from was the defense that. i got the final say. and they went on to accuse the state and the investigators more or less of manufacturing a case against jerry sandusky. they said, the system is decided mr. sandusky was guilty, and the system set out to convict him. and they gave a number of examples accusing the investigators of coaching the witnesses of what to say, and accusing the alleged victims in this case of making things up, and that they were in it just for money. he kept a recurring theme, and kept saying that this just doesn't make any sense. then he did something very interesting. he said that jerry sandusky wanted him to read to the jurors a poem written by mother theresa in which he says more or less to turn the other cheek a poem called "anyway." and then it was on to the prosecution's closing. do we have time for that? >> sure, go ahead. >> all right. the prosecutors are the ones who wrappeded things up, and they said to thor jurors, we don't want you to forget the boys in this case, the alleged victims in this case. they said that jerry sandusky is a man who has got two sides. just because they said he was a good person in one way does not mean he couldn't have done bad things as they put it, and is that supposed to insulate you from your crimes that you have done some good in your life? and then prosecutors did something very dramatic in the end. the lead pros ecutor moved directly behind jerry sandusky, and then said to the jurors, he knows he did it, and you know he did it, and give him the justice he deserves, find him guilty of everything. and with that, the case has ended, and both sides have spoken, and the jury is now beginning deliberations. suzanne. >> that is very dramatic ending there. susan candiotti, thank you very much and we appreciate it. president obama plans to speak in ten minutes about the rising student loan rates that he says could have been prevented by a bill that the republicans killed. last hour we heard from mitt romney bashing the president on immigration at the largest gra gathering of latino leaders in the country. [ male announcer ] the security of a 2012 iihs top safety pick. the volkswagen passat. that's the power of german engineering. right now lease the 2012 passat for $209 a month. visit vwdealer.com today. latino voters will carry a lot of clout in the 2012 presidential elections, so no doubt that both mitt romney and president obama will speak to the conference. tomorrow the president will speak, and we heard from mitt romney last hour, and he blasted the president on immigration. >> president obama has failed to address immigration reform. for two years, this president had huge majorities in the house and senate, and he was free to pursue any policy he pleased. but he did nothing to advance a permanent fix for our broken immigration system. nothing. instead, he failed to act facing a tough ree l-election and tryi to secure your vote. last week the president finally offered a temporary measure, and he called it a stop-gap measure that he seems to think will be just enough to get him through the election. after three-and-a-half years of putting every issue from loan guarantees to his donors to cash for clunkers, and putting all of those things before immigration, now the president has been seized by an overwhelming need to do what he could have done on day one, but didn't. i think that you deserve better. some people have asked if i will let stand the president's executive order. the answer is that i will put in place my own long term solution that will replace and supersede the president's temporary measure. as president, i won't settle for stop-gap measures. i will work with republicans and democrats to build a long-term solution. president obama is addressing latino leaders here in florida tomorrow, but right now he actually walked into the room, and he is focusing on the student loans and interest rates on federally subsidized loans july 1st and if the republicans and the democrats can't reach an agreement on how the extend the low rates. let's listen in. >> the piano cocktail hour. so, some of the most fun i have had as president is when i get a chance to talk with you, college students, about the importance of earning a higher education in today's economy. and i'll admit that the east room is not as rowdy as carmichael arena at the unc or -- we have unc folks here in the house? there we go. coors center at cu-boulder? anybody? no. okay. i have to say that most of you are much more dressed up than usually when i see you in your own natural habitats [ laughter ] but our message today is serious. right now the unemployment rate for americans with a college degree or more is about half of the national average. they earn twice as much as those who don't have a high school diploma so whether a four-year college or a community college orrer a technical program, some form of higher education, something beyond high school has never been more important. it is the surest path to finding a good job, earning a good salary and making it into the middle-class and at the same time over the last two decades the cost of college has doubled. it is actually more than doubled. that means, and i don't have to tell you, because you are probably tallying it up right now, the cost for you to take out loans has increased and you are more likely to rack up more debt. the average student who borrows to pay for college now graduates with about $26,000 of debt from the student loans. americans as a whole now owe more on student loans than they d on t do on credit cards, and that is wrong. we cannot afford to price the middle-class and folks who aspire to go into the middle-class, we can't price them out of the college education market. we can't stand by when millions of young people are already saddled with debt just as you are starting off. your parents, your grandparents, and oftentimes, they were in a position where when they got that first job, the first thing they are thinking about is how do i save to buy a home and start a family. if you are already dealing with a big bunch of debt before you even get started, that is a problem. and it is mind boggling that we've had this stalemate in washington that threat ens to make the situation even worse. so, the reason that you are all here, and the reason that all of these fine looking young people behind me are here is that in just over a week the interest rates on federal student loans are scheduled to double. i have been talking about this for what, a month and a half, two months, three month, five months -- i have lost track. we have been talking about it for a long time. if congress does not get this done in a week, the average student with federal student loans will rack up an additional $1,000 in debt over the coming year. if congress fails to act, more than 7 million students will suddenly be hit with the equivalent of a $1,000 tax hike. that is not something that you can afford right now. now, as i said, this warning sounds familiar, we have been talking about this for months. congress has had the time to fix this for months. it is part of the reason why everybody here looks impatient. [ laughter ] this issue didn't come out of nowhere. it has been looming for months. but we have been stuck watching congress play chicken with another dim light. so we are nine days away from thousands of american workers have to walk off of the job, because congress has not passed a transportation job. we are ten days away from nearly 7.5 million students seeing their loan rates double, because congress has not acted. this should be a no-brainer. it should not be difficult. it should have gotten week done weeks ago. now, the good news is that there are folks in congress trying to do the right thing. last month the democrats in the senate put forward a plan that would have kept these rates in place without adding a dime to the senate, and unfortunately the senate republicans got together and blocked it. over in the house, the republicans said they would keep these rates down only if we agreed to cut things like preventative health care for women which obviously would not fix the problem, but it would create a new problemchch. this is even as they were voting lock step for an economic plan that would cut financial aid for 9 million college students for the average of $1,000 and give $150,000 tax cut to wealthy americans. so, i recognize that there has been some effort to change the subject from this rate hike. one congressman warned that this is all about giving college students free college education. which doesn't make much sense, because the definition of a loan is that it is not free and you to pay it back. [ laughter ] others have said that we are just talking about student loans to distract from the economy, and that doesn't make much sense, because this is the economy. this is all about the economy, this is all about whether or not we are going to have the best framed, best educated workforce in the world. that improves our economy, and higher education cannot be a luxury reserved just for a privileged few. it is an economic necessity for every family, and every family should be able to afford it. so, you know, you guys during this period when you have been in college been some of the toughest economic times since the 1930s. there are still a lot of challenges ahead globally. we can't control every economic headwind that we face. but this is something that we can control. this is something that we can do something about. stoppitudent rates from doubling at the end of the month is something that we can do right now to make a difference in the lives of all the american people. so there's still ten days for congress the do the right thing, and i understand that members of both parties say they want to get this done and there are conversations taking place, but they haven't done it yet. we have to keep the pressure on. that is where all of you come in. with the past few months, there are so many students and parents who have been working hard to shine a light on this issue, and you have rallied on campuses, in your communities and campuses and e-mailed and tweeted your representatives in washington, so you have play ed your part i making sure that the voice is heard and the democracy is responsive. my main message is as you have embarked on this day of action, i want to make sure that you keep this going. don't stop until it is actually done. there's nothing more powerful than millions of voices calling for change and all of your voices can make a difference. keep telling congress to do what is right to get this done, and tell them now is not the time to double interest rates on your student loans, and tell them to double-down on the investment in a strong and secure middle-class and that means your education. tell them now is the time to double-down on america where everybody who works hard has a fair shot at success. all right. and for those who are not here and are watching, if you tweet, use the hash tag don't double my rate. don't double my rate. but, i tell you when i look out at this group right here, you give me confidence in america. you make me optimistic, and not only because you are getting a great education, but also because all of you are p participating in making sure that the democracy works the way it is supposed to. we need outstanding engineers and we need outstanding profit leaders and entrepreneurs -- president obama in the white house in the east room encouraging congress to keep interest rates for student loans low which is a critical time where he is seeking votes for young college students. and p sshgpstd says that so heart attack patients are getting this disorder as well. we will explain. and real beef and egg. to help you put more play in your day. yoo-hoo. hello. it's water from the drinking fountain at the mall. [ female announcer ] only from aveeno. we asked total strangers to watch it for us. thank you so much, i appreciate it, i'll be right back. they didn't take a dime. how much in fees does your bank take to watch your money ? if your bank takes more money than a stranger, you need an ally. ally bank. no nonsense. just people sense. the dow is down triple digits today despite the fed announcing a $267 billion program yesterday to keep interest rates low and to pump life into a stagnant economic recovery. alison kosik is at the new york stock exchange to tell us a little bit about this. now, considering the reaction since yesterday, simply, the markets saying the fed hasn't done enough? >> that is part of it. you know, also, the other part of it is, you know, with the fed going ahead and trying to push down long-term interest rates, it's an effort to try to boost demand. but you can't force businesses and you can't force people to borrow money and to lend money, if they don't think the economy's going to improve. so that's really kind of why the fed is kind of between a rock and a hard place. but it's giving it another several months to see if it can may be spur some of that activity. suzanne? >> reporter: alison, do we think the recovery continues to stall, do you think the fed will actually do more? >> that's actually what the market is hoping. but if you go either way, because the fed takes even more aggressive action, it shows that the economy is worse off than everybody thought. but at the same time, the market wants to kind of get that boost from the fed, and believe it or not, another bad jobs report may just sort of be the medicine or the push for the fed to actually take more aggressive action. suzanne? >> all right. alison kosik, thank you, alison. so this is interesting for a status update. in one state, convicted sex offenders are going to soon have to out themselves to the public on their facebook pages. the top academic performers surprised some people. so did the country that came in 17th place. let's raise the bar and elevate our academic standards. let's do what's best for our students-by investing in our teachers. let's solve this. assure my patients get evthe very best care.ake but look at our health care system. everyone agreed we needed reforms -- but this new health care law -- it just isn't fixing things. president obama promised my patients that they could keep me -- but what if because of this new health care law -- i can't keep them? i've looked at this law. i know the consequences: delayed care and worse yet -- denied care. studies show the president's health care law is projected to add hundreds of billions of dollars to our deficit -- and increase spending by more than a trillion dollars. and the truth is -- we still don't know how much this law will eventually cost. i don't want anything to come between my patients and me -- especially washington bureaucrats. we need real reform that improves care, and the president's health care law just isn't it. it just isn't worth it. this is where health care decisions should be made. not in washington. a syrian military pilot has defected. we are told the pilot took off in a fighter jet, landed in jordon today, and was grant aid sigh lumb asylum. it comes one day after the u.s. warned members of the syrian military they could face international prosecution for attacks on civilian. a civilian opposition group says the regime has killed 81 people today alone. the government reports 20 army, law enforcement, and civilians killed by rebels. sex offenders in louisiana will soon have to reveal their criminal status on their facebook page and other social networking sites. a new state law requiring the posts takes effect august 1st. it is the first law of its kind in the country. facebook already bans registered sex offenders from their site, but louisiana now says that predators who lie about their status could face up to ten years in prison. "cnn newsroom" continues right now with brooke baldwin. hey, brooke. >> hey, suzanne, thank you so much. i'll take it from here. hi, everyone, i'm brooke baldwin. developing right now, the fate of jerry sandusky in the hands of a jury. closing arguments wrapping up as the defense and prosecution made their cases today. the former penn state coach faces 48 counts, including the rape of children. the verdict, it could come down quickly. we're monitoring that for you from pennsylvania. meantime, politics, fresh from taking on the gop over immigration policy, moments ago, president obama really stepping up pressure here on republicans to renew a intere student loan program before it expires the first of july. >> we've been talking about it for a long time. if congress does not get this done in a week, the average student with federal student loans will rack up an additional thousand dollars in debt over the coming year. if congress fails to act, more than 7 million students will suddenly be hit with the equivalent of a $1,000 tax hike. and that's not something that you can afford right now. >> perhaps you remember the battle from last month when senate republicans blocked a bill to extend those low rates. their sticking point, really, how do you pay for this? here's what i'm talking about. if congress does not act before that deadline, as we mentioned, the first of july, interest rates on new government student loans, they're going to double from 3.4% to 6.8%. the president just wrapped up his remarks at the white house. we want to bring in chief white house correspondent jessica yellin. you know, jessica, the president pretty jovial today with some of those students, that he was standing right in front of. but obviously, this is very serious stuff for a lot of these young folks. what was really the crux of what the president said today? >> hi, brooke, he always seems to enjoy himself around college kids. >> he does. >> he essentially called this a concocted political standoff and called on congress to get it done. and you heard him tie the student loan issue into the larger message he has been driving since late last year, lunging it to helping the middle class get ahead. the bottom line here is, there is a stalemate, both sides are playing, you know, politics here, but everyone, essentially, believes that this is going to get resolved, because this is such a popular issue. >> so we're hoping it gets resolved, whichever side you're on, but the sticking points with the republicans, as we mentioned is, how do you pay for this? how do you keep the loans at the rate that they're at? what is the president proposing? >> right now democrats are working on a plan that would essentially increase certain pension payments and that would help raise the money. republicans had initially proposed something that would have touched the affordable care act, which outraged the white house. now theye offering a number of other proposals that include increasing the amount of money that federal workers would pay into their own pension. so, bottom line, there's this back and forth going on about the payments. as i said, in the end, it's expected that there will be an agreement. republicans on the hill is fuming because they say the white house isn't negotiating with them. one thing we all know, brooke, when the white house and congressional republicans sit down to talk about raising revenue, these days it doesn't go so well. >> doesn't go so well. add to this the fact that last week, huge news, you were all over this, the fact that the president moved to end the deportation of students brought to the united states through no fault of their own, you know, coming over as young, young people. now he's talking again about student loans here. i'm sensing a theme, the youth vote. >> right, so, big picture, the obama campaign has been expending a lot of effort, targeting key groups of potential supporters, as you point out, latinos, also african-americans, women, and then young voters. you see that the president doesn't have the youth wave that he had last time, but assuming that this student loan legislation does pass and this gets extended, you could expect the president to say in the campaign, for example, that he put this student loan issue on the front burner and that was one way he stood up for young voters and that could be a rallying cry to help get more of the youth vote out and energized and on that campaign trail. brooke? >> jessica yellin, thank you very much. one of the most sought-after groups here, in addition to the youth group, as jessica was just laying out, is latinos here in this country. right now in florida, specifically, there's this huge showdown over those voters. it's playing out right now at the country's largest latino convention. it's the gathering of the national association of latino elected officials, naleo is the acrony acronym. president obama will be speaking there, pledging to stop deportation efforts against young illegal immigrants who were brought to this country as young children. but mitt romney just wrapped up his speech to this group. let's play a little bit of what he said. >> i will prioritize efforts that strengthen legal immigration and make it more transparent and easier, and i'm going to address the problem of illegal immigration in a civil and resolute manner. we may not always agree, but when i make a promise to you, i will keep it. >> i do want to show you some numbers here. this is the latest gallup poll against president obama. 66% support among hispanic voters. you can see the number there for romney, getting just 24% of the vote. again, the latest poll. huge show in store for you. watch. a little girl cries as a molester attacks her. then her dad comes to the rescue and kills the man. now he's off the hook. the prosecutor behind the decision tells me why. plus, as we get word syria's leader won't quit, a new report says the cia is operating secretly with the men looking to take bashar al assad down. and -- ♪ baby, tonight, just falling in love again ♪ >> usher joins me live on his effort to give all kids a chance. "you're going to die tonight, mother [ bleep ]." i felt his hand going down on my side, and i grabbed my firearm. and i just grabbed it, i grabbed my firearm, and i shot him. and i just shot him, and he falls off, and he's like, all right, you got it, you got it. i didn't think i hit him. because he sat up, and he said, you got me, you got it, you got me, you got it, something like that. >> so that is just a sampling of what you, martin savage, have been sifting through these videotapes, these audiotapes. again, it is obviously one side of the story, but it's quite a side. >> yeah, it is. and you can say that i've probably been covering this story too long and too deeply, but i find it allfcinating, pause it's in the words of george zimmerman, thee tim frame is, we're talking about those interviews were conducted either within, in some cases, just a couple of hours, and the visuals that you see, the video, that's 24 hours, from the time of the shooting. and it is so fresh, it's so raw, and most of all, it's george zimmerman giving his own account. as you say, one side of the account. let'listen to this chunk, which is of his walk-through that he gives authorities the day after he admits to killing trayvon martin in the subdivision. listen to this. >> when i got to -- i passed here, i looked, i didn't see anything again, and i was walking back to my truck, and then when i got to right about here, he yelled from behind me, to the side of me, he said, "yo, you got a problem?" and i turn around and i said, no, i don't have a problem, man. >> where was he at? >> he was about there, but he was walking towards me. >> this direction here? >> yes, sir, i believe -- like i said, i was already past that, so i didn't see exactly where he came from. but he was about where you are. >> okay. >> and i said, "no, i don't have a problem." and i went to grab my cell phone, but it wasn't in my pocket -- and he said, "you got a problem now?" and he punched me in the face. >> right here? >> right around here. to be honest with you, i don't want remember exactly. i stumbled, and i fell down, he pushed me down, some how he got on top of me. >> on the grass or on the cement? >> it was more over towards here. i think i was trying to push him away from me, and then he got on top of me somewhere around here and, that's when i started screaming for help. i started screaming, help, help, as loud as i could. and that's when he grabbed -- oh, i t to sit up, and that's when he grabbed me by the head and tried to slam my head down. >> were you -- [ inaudible ] >> no, my body was on the grass and my head was on the cement. what's going on? >> pick your poison. you know what, brooke, as we watch the dow drop 210 points, a lot of bad economic news today. jobless claims are kind of treading water at a high level. issues about spain are really upping the ante as far as the selling goes here on wall street and of course greece and europe continue to weigh on the markets. brooke? >> as we keep our eyes on the dow, some other numbers we've been looking at. something that really stands out to us is the fact that private firms, they are doing some hiring, but it's being offset by these continuing layoffs we've been seeing from private sector employees. i'm talking teachers and firefighters and police. why is that? what's happening? >> yeah, and you're right about that. what's happened is that the recession caused huge declines in the amount of money that state and local governments actually take in. look what governments did. they took in less tax revenue because people lost jobs, businesses closed, people lost their homes, which means everybody's not paying their taxes like they used to. so that led to budget shortfalls and ending cuts. and when you cut spending, the chances are the money is coming directly out of someone's pocket. since 2009, the public sector has lost over 700,000 jobs. that's huge. so, clearly, the public sector, brooke, continues to drag on the jobs recovery today. >> and, you know, in addition to that, we were looking at this other report today that basically says that states this year, they're looking at a combined budget shortfall of $100 billion, give or take, and these states, unlike the fed, are actually trying to close the budget gap. so what you're talking about then is more layoffs, right? >> exactly. exactly. and here's why. because unlike the federal government, brooke, states actually are legally obligated to close those budget gaps. and guess what, cutting jobs, it happens to be one of the fastest ways to do that. but state and local budget cuts, they've got a ripple effect. ironically, the other way to close the gaps is to increase revenue, which means raise taxes, which is highly unpopular, or increase the number of taxpayers. that is just hard to bank on. so each time local governments play somebody off, they lose that person's income tax. so what you see are these governments pretty much getting caught in this vicious cycle. brooke? be happy. be healthy. we've got some news here. and we're looking at some tape. this is just moments ago. this is mt. hood, this is oregon, and there is a rescue underway. so here's the deal. this climber has fallen about 800 feet. if you know mt. hood, this is the hogs back area. this happened this morning. clackamas county dispatchers got this 911 call right about 9:30 oregon time here. and they are saying that these rescue crews, and you see them here, they are slowly making their way up the mountain to try to help and find the climber. we still don't know whether this climber is a he or she. we don't know his or her condition. but we do know, according to this affiliate in portland, katu, that the climber did, in fact, survive the fall and we also know that this rescue team was actually on the mountain at the time and have now, possibly, reached the climber. so we're keeping a close eye on this and as soon as we hopefully get some good news for you, we'll pass that along. meantime, james durbin wowed fans -- wowed fans during season 10 of "american idol." and you might not know, he actually suffers from tourette's and asperger's syndromes. and in this week's "human factor," durbin tells cnn's chief medical correspondent, dr. sanjay gupta, how he saw his symptoms disappear. >> you lost your father at a pretty young age? >> yeah, i was about 9 years old. he got into drugs, he was an alcoholic. >> shortly after your father passed away, you were also diagnosed with tourette's and asperger's syndrome. >> -h had had fferent facial tics and made different sounds and stuff growing up. >> it sounds like a really rough, awful childhood, frankly. losing a parent, being bullied, and now being diagnosed. what does a 10-year-old james do? >> there was things that i thought about doing. >> you thought about taking your life? >> yeah. it definitely crossed my mind. >> you did find another way out, so to speak, of that darkness. and what was it that caused that? >> it was music. it was music and theater. >> so let's say you're in a very stressful situation. what happens to you? >> a lot of like, violent head shaking and sometimes like yelling and squeaking and barking and coughing. ♪ i don't know where i'm going >> when you're on stage, and obviously, lots of cameras and there's nowhere to hide, so to speak, at that point, so what do you do then? >> i feel in control. like something's going on and i'm on stage, and you're down there, and i'm up here, i'm okay. >> interesting. >> there's nothing wrong. i can stand here the whole interview -- >> just the physical act of being in that -- i mean, you're on stage, you're performing -- >> having to be social on stage with someone, even though you're just playing a role, you have to have chemistry. so that opened up a whole new world to me. >> you recently got married to the mother of your child. tell me about heidi. >> she had dreams and goals and aspirations and i just looked at myself and said, i got to change, and thank god for her, because she really helped me through it. >> thanks so much, really. enjoyed it. thank you. >> absolutely. >> appreciate it. >> so interesting, dr. gupta. just seeing your reaction, on your face, as she's jumping up on that chair, and the fact that he sang, you know, by being on stage helps him manage his symptoms. >> it's a little -- >> it's a bit counterintuitive, and tics are completely involuntary. i don't know if you would pay attention to this, brooke, he would cough every now and then, it almost seemed like he was ti sick, but it was a tic that he had, and certain movements of his head. but you're absolutely right, being in a high pressure, high anxiety, high excitement situation like being on stage, usually makes people worse, but he says it helps him. >> why? [ slap! ] [ slap! slap! slap! slap! ] [ male announcer ] your favorite foods fighting you? fight back fast with tums. calcium rich tums goes to work in seconds. nothing works faster. ♪ tum tum tum tum tums but i tested it out, and bayer advanced aspirin relieved my pain fast. it helps me get back in the game. but don't take his word for it. put bayer advanced aspirin to the test for yourself at fastreliefchallenge.com. well, live tv can be kind of fun, can't it? we do have heather mcminn. she is back up for us in texas again. she is the d.a. who presented this case to the grand jury involving this father who ultimately killed the man who he says was sexually assaulting his little girl. back to you, you were saying that you really had never seen any case quite to this extreme before in your tenure. was it clear to you, heather, that from the start that this was a case of justifiable homicide? >> from the beginning, we thought that the case was justified. that the use of deadly force was justified, because the father caught him in the act of committing sexual assault. but the texas rangers in the lavaka county's sheriff's department wanted to make sure that a thorough investigation was done to make sure that was what was occurring during the time that the attack occurred. >> so what evidence were you able to give the grand jury that this guy doesn't have to face any charges? >> one of the things that was most showing to us and telling was the 911 call that the father made. the father was very emotional and he was trying to get assistance for the man who just attacked his daughter. that was something that we thought was very important in showing his emotion at the time. in addition to that, the family also tried to provide cpr and some life-saving measures to the perpetrator. in addition, the little girl did sustain a lot of physical injuries that substantiated what the father and what witnesses had said that they'd seen. >> so it really was the 911 call, it sounds like, was that really sort of crucial piece of evidence. we're talking texas specifically, but is this definition of justifiable homicide, heather, is it unique to texas? i know people are watching in other states thinking, can parents elsewhere look at this decision here and expect to be vindicated if they ever, heaven forbid, find themselves in a similar situation. >> sure, i think each jurisdiction is different. in texas, as in many states, you are allowed to use deadly force in order to stop a sexual assault. it is not -- it wasn't because he sexually assaulted his daughter that he was attacked, it was because he was in the process of doing the sexual assault. and the father was absolutely justified in using lethal force to stop that. and i think that, in many states, that it would be ruled justified under these exact circumstances. >> in texas, it's a law, on the books. district attorney heather mcminn, thank you. we have taken in some new video. savage fighting in syria. and it's relevant to something we're about to talk a little bit more about today. something we're hearing. first, i want to play some of the video and then we'll fill you in on this report on arming the rebels in syria. first, watch this. [ explosions ] [ screaming ] >> so what you're looking at here, this is actually shot yesterday. this was syria, and as we mentioned, it is truly savage fighting. these are syrian rebels armed with automatic weapons and we see a man firing rocket-proprinciprocket-prope rocket-propellrocket-prope rocket-propelled grenades. so "the new york times" reporting that the cia has began to play a role in the flow of arms to these rebels in syria. it says a small team of agents are steering weapons across the turkish border. but "the times" says that these weapons are not being provided by the u.s. government, they're being provided by someone else, and then the role of the cia is to funnel tomorrows to the right people. we here at cnn, we're trying to confirm that report as i speak. meantime, a sign of possible cracks within the assad regime. arwa damon is in beirut to tell us about this the pretty tremendous defection, arwa? >> reporter: most certainly was bold, brooke. a fighter jet pilot defecting during a training mission earlier this morning. he flew his fighter jet into jordan and then asked to be allowed to conduct an emergency landing. he was allowed to do so. and then he asked and received political asylum from the jordanian government. this is, of course, just a single isolated incident at the state, but this particular fighter pilot was a colonel and could potentially be the resource of some pretty valuable information. some insight into the exact size and capability of assad's air force, and potentially, about what he intends or how he intends to use it against members of the opposition, brooke. >> and also, just speaking to the timing here, this defection, arwa, it's interesting timing, because we know that just yesterday, u.s. ambassador robert ford issued a warning of sorts, via facebook, to the syrian armed forces. let me just read some of that. ford says, "members of the syrian military should reconsider their support for a regime that is losing the battle." he goes on, "do they want to expose themselves to criminal prosecution by supporting the barbaric actions of the assad regime against the syrian people?" so, clearly, the u.s. trying to stir things up, encourage defections, just as the one that you were just reporting on by this particular pilot. is there any way, though, to really no how effective that might be? >> reporter: at this stage, no. and it's always been quite difficult to track exactly how many individuals have defected. the numbers of the free syrian army, this rebel fighting force, do vary greatly. but we are seeing defections by the day, we're seeing the free syrian army growing in numbers. their attacks growing even bolder. they're going directly now and attacking syrian built millet bases, at times causing devastating casualties. they are becoming more sophisticated in their tactics as well, and we're really seeing this morphing into something of an insurgency against the syrian regime at the stage. as you were mentioning earlier, the great concern for the u.s. is exactly who are these individuals who are potentially fighting? america wants to make certain that they are not members of extremist organizations like al qaeda, brooke. >> arwa damon, thank you. just into us here at cnn, we are getting word of a chemical spill at a public pool. that's just coming in. we're making calls and we're going to get some details on that for you. also, right this moment, a jury is deciding the fate of jerry sandusky. we are awaiting a verdict now. folks, this is in the hands of the jury. stay right here.
