Been postponed until the 2024 election. Trump was set to be sentenced two weeks from now after being found guilty of 34 felony counts in his new york hush money case back in may. The case had widely been seen as the only criminal case against trump with the potential to cross the proverbial finish line before the election. As of today, we know that will not happen. Trump will now be sentenced on november 26th. Three weeks after the election. Here is how the judge overseeing the case judge marchand explained his reasoning for that dehraeufplt this matter is one that stands alone in a unique place in this nation's history. Unfortunately we are now at a place in time that is fraught with complexities. Rending the hearing difficult to execute. Thus the imposition of sentence will be adjourned to avoid any appearance however unwarranted, that the proceeding had been affected by or seeks to affect the approaching presidential election in which the defendant is a candidate. The court is a fair, impartial and a political institution. Judge marchand issued a little more detail behind that reasoning. The integrity of our judicial system demanding a hearing the weighing of mitigating factors. The members of this jury serve diligently in this case and their verdict must be respected and addressed in a matter that is not diluted by the enormity of a presidential election. All of that would be problematic even if unintentionally so in the middle of a presidential election. But that the circus of the political environment might detract from the very serious work of sentencing donald trump. The judge machand has decided to delay that work until november 26, three weeks after election day. And that is very nearly the opposite approach of a judge in another one of trump's criminal trials in a decision rendered yesterday. Yesterday the judge overseeing trump's dc federal election interference case, took essentially the reverse position. While she was trying to schedule motions in that case. This is the judge responding to trump's lawyers in their assertion that the election is a sensitive time for court business. Judge, let's just discuss what the sensitive time is. I understand there's an election impending and i said before and i say again, that the electoral process and the timing of the election and what needs to happen before or shouldn't happen before the election is not relevant here. This court is not concerned with the electoral schedule. The judge's approach is the opposite of judge marchand. So in the course of the past 24 hours, we have gotten two very different judges in two different historic criminal trials of a former president taking two remarkably different positions on the intersection of politics on the law. All of this leading the big question about how the courts should be treating trump in the approach to this election and how all of this will affect the american justice system in both the short term and the long term. We're going to get some expert help on packing those questions in just a second but first, it is worth hearing what donald trump himself had to say today about judge marchand delaying his sentences. Marchand said to avoid any appearance that they seek to affect the approaching presidential election. Before we begin big news today, that the manhattan da witch hunt against me, has been postponed because everyone realizes there was no case because i did nothing wrong. It's a witch hunt. An attack by my political opponents in washington, d. C. And, comrade kamala harris and radical left opponents. For purposes of election interference that's all that was. Joining me now are duncan levin, and the das office and kristin leeburg. It's good to see you guys, it's been far too long. I worry it's going to be a long time again. Duncan, can you take me inside the mind of marchan to the degree that you can. Explain to those of us who don't understand the back and forth. What is sentencing is. And why does judge marchand think that it will affect the presidential nominations. It's the prosecution to make oral arguments for the defense. You get to talk. Because throughout this whole trial he had the right to testify but he didn't. This is his moment to talk and he gets to make a statement to the court and express remorse or not. And i don't think he will. But he's allowed to talk to the court. Something tells you. Something tells me. He's allowed to talk and then the judge is going to pronounce sentence oraly and it's being done very formally. Sometimes in state court it's not. There are a lot of swirling things here going on for judge marchand. I think a lot of people have been saying this is a huge win for trump but i think it's anything but. It looks like the use is tightening in a way because, if he loses the election this makes it far more likely that he's going to get some kind of sentence with confinement. I know i've been talking to you. Yes you have. For the whole summer sort of off stage about the fact that i think that's going to happen. But i think this makes it much more likely because, judge marchand is in a very difficult position to put him even in house arrest during the final stages of the election. Once the election is over if he loses, if he wins the election all bets are off. If he loses the election i think it makes it much more likely to do that. There's also other appellate issues going on right now. Mr. Trump has a 330 10 motion. A motion to set aside the verdict. There's an appellate issue. There's something severe enough that he doesn't want to show the sentence. It's hard to tell and nobody knows. But i'm willing to, i'm not willing to put money on it but i'm. You're saying it on national television. I'm going with the odds that are going way up. Because once the election is over. It makes it much easier for the judge to do it. I think that this is the case that. Assuming that trump hasn't won the election. Assuming trump hasn't won the election. I think it all very likely goes up to the supreme court and could get stayed. If he loses the election. The prosecution is going to be asking for some kind of incarceration, home confinement, some split sentence with probation. I'm going to be very surprised if they don't. And this just makes it way easier for the judge to, enclose that kind of a sentence on him. If it's taking place after the election. Christie, the das office didn't like fight to make a case that this hearing should not be postponed. And judge marchand sort of called them out about that. Can you talk a little bit about the relationship between the prosecution and the judge and how this decision was made. Yeah, so, i mean, generally speaking. A judge is not going to keep a sentencing date that both sides say they want moved. And so trump says, was put on a mission we take no position that it's your case as a prosecutor. You take positions on these kind of things. They say we take their position but then they basically say it's about trump's reasons here about why they want it delayed. Yes that makes sense. Didn't elaborate on the reasons. You're really joining trump's delay request. It's basically cosign. You're cosigning this and therefor with both of you on that side, made his job a lot harder. They forced his hand here. I'm not necessarily surprised he made this decision. I don't necessarily agree. I'm more in the judge camp of the election should not matter. Your case schedule is your case schedule. But again, i think if the manhattan das office had opposed this delay request from trump. I think marchand would have kept it. Judge marchand knew about the election date. He knows they made this motion. And even after trump made that motion to set aside the verdict based on immunity. He kept the schedule for september and told the parties, you better be ready. It's so high stakes for everyone involved. And just for this case but american history. You're getting death threats and your daughter is getting death threats. You must assume you need the das office to back you up in terms of expediting this. I think he made it clear with the tone of his decision. He was upset that the d. A. Has put all of this. They've been getting these death threats. They're scared. This must be taking an effect on this. Don't impose the jail time until after the election. That's fine with us but go ahead with the sentencing. That's on them. They're basically dumping it on the judge and putting it all on him and that's really not fair to them. Not the discrepancy just completely opposite interpretations at least publicly about how much politics should factor into the decision's court. Chuck said what election. This court does not see politics. And naming the election as a factor in delaying this sentencing hearing. Yeah, look, i think judge marchand is saying the quiet part outloud. I think, i think you see often that prosecutors whether they see or not at any stage. Whether choosing to get investigative decisions. Whether they're choosing to charge certain individuals. Even at sentencing. Politics are out there. How much do you really let that affect your decision making. Judge chuck again said is correct in saying it really shouldn't have an impact. A case is a case. You are a defendant. Your not, your candidacy is your day job. I think that's the way they put it. Judge marchand recognizing here that i agree with duncan. I think the manhattan office will seek a jail sentence. I think that is appropriate under the effects. Michael cohen went to jail for three years for the same thing. So, i think they'll seek it. I think the judge is likely to impose it. And then, you know given the gravity of that. They know they can't do that before the election. Do you really think 41 days before is less. Now it's 41 days before the election you impose that sentence and really look like you're tipping the scales. You're going to have both sides either way blaming the judge and prosecutors. The left is going to. Let's be clear though. The left is not threatening the lives involved in these cases. One can imagine those calls the death threat would increase if judge marchand would deliver a sentence for trump three weeks after the election. If trump were to win, i could see plenty of people second guessing. Well you allowed him to be a martyr. I can see that happening. Both sides to blame, one is scared and one is not. Do they really want to deal with that. I think that was just a factor likely in the manhattan d. A. 's's office decision to go along with a request. Duncan you mentioned there's other outstanding business. The timing of all this is really different. I myself got confused by this. The sentencing hearing, has been delayed till november 26th. Trumps lawyers have been trying to throw out the decision entirely based on the immunity decision from the supreme court. Right. They're saying, forget this conviction. The guy has, this conviction was based on evidence that would have been inadmissible based on the supreme court's ruling. Right. And marchand today said, we're going to delay that, the resolution of that business until november 12th. Is that right. Yeah, i mean this is part of the rational for kicking the sentencing out. Mr. Trump's file is called a 330so motion which is to set a jury. The jury heard official acts evidence that they shouldn't have heard. The supreme court said, no they can't convict based on that. Judge marchand has to decide was that called harmless error or not. The conviction stands. If he says no, this actually made a significant difference. For that information, he wouldn't have been convicted that's a problem and it could be a basis to set aside the jury verdict. And mr. Trump's lawyers were saying. You're supposed to hand down the decision on that on september 16th. Two days before the sentencing, we wouldn't even have time to appeal that for the sentence. This is politics also in the courtroom. In any other case the judge would say, you know what i don't care i'm going to still sentence it and appeal it after the sentence. There's politics in both of these courtrooms going on right now. But, i think that's part of the reason, he wants to get a little more air between the decision on this motion to set aside the jury verdict. And the sentencing to give a little room to mr. Trump's lawyers to appeal it. So they couldn't complain. Well, right. In one hand it's a win to make their case and prepare it. On the other hand, politically, trump is still convicted of these crimes through the election. Right. He doesn't get to say they overturned the case because the evidence was effectively should never have been admitted. He's still a guy who's been convicted of 34 felony counts up until election day. Right and i think that that is, to the you know favor of i'm sure, i can see a world where a campaign is happy without this development that they don't have to deal with the sentencing. Again he doesn't get to say, this is me being a victim. I'm being politically persecuted. They can just focus on the campaign and political eventings going forward. This is just an extraordinary moment in you know, i mean this is really truly duncan and tara incognity. My heart goes out to, all the people that are forced in such difficult high stakes life threatening positions that have to make. Decisions not just for themselves but for american juris prudence. This is has got to be the hardest job, and my heart goes out to him. This is a very difficult decision to make and he's trying to be as fair as possible. I know november 12th and 26th seem a long ways away but they're not. And with what an extraordinary next three months we have ahead of us. Duncan and kathy, thank you for your analysis. Yeah, and liz cheney's reveal was followed up by a statement. In our nation's history there's never been an individual who's a greater threat as donald trump. As citizens we each have a right to put country over politics. You're a political strategy which might agree decidedly. But these endorsements are often a matter of intense back and forth with this campaign. You know, organization if you will. There's a lot of conversations and a role that is a strategic time. This feels completely native if you feel. But this is not done with the permission of the harris campaign. But this is speaking through his soul then his daughter. To place a flag in the stand. I guarantee the harris campaign has not been trying to woo dick cheney over the last few weeks to hope they would land this one. I did part of me, she said she didn't want to do it in a political setting then she can see the real reason was that she was in london seeing taylor swift. Some things are far more important even than democracy. She answered the question this week. I do think i'm almost certain that there's been some back and forth between her and the campaign. What's interesting to me, well one is what her role will be going forward for the rest of the campaign. And also, adding her dad into this. I think it's to be dismissive but something like this is important and creating a structure for other republicans. There's still tens of millions of americans who voted for dick cheney and george w. Bush. That explains why she wasn't at the dmc other than taylor swift. The job to cheney is not to speak to democrats that probably have someish sures with cheney still. But to help butress that permission structure. To convince other republicans that look the water is fine. This is about democracy not about the green new deal. On that note, there's a high profile republican who has decidedly not taking the path of the cheneys and that is nikki haley. Nikki haley spoke to margaret brennan, it's an interview that's going to air this weekend. Was asked about her involvement with the trump campaign. This is what she had to say. Are you going to campaign for him. He knows i'm on stand by. I talked to him back in june. He's aware that i'm ready if he ever needs me to do that. When i called him back in june i told him i was supportive. I think our teams have talked to each other but there hasn't been an ask yet. If he asks i'm happy to be helpful. I can't imagine nikki haley is delighted to have that interview air in the same sort of media cycle that dick cheney coming out on principle. You run the risk of being embarrassed. The more courageous i would say position than with which the path that she has chosen. I imagine there won't be a lot of phone calls coming her way from the trump campaign saying hey can you go to pennsylvania or michigan because, i mean, you know that was not a glowing endorsement that she gave in milwaukee and my sense was, i mean, if you look at the body language. It was not terribly enthusiastically received. There's a lot of gradationings of support or nonsupport that trump is going to get from republicans. That's one of the more tortured decisions. If dick cheney is going to vote for kamala harris, do you think bush is. That's a question that i got immediately. Is w. Going to get off the sidelines now? i don't know. This has to get his attention. I mean he's been very, very stubborn about you know no i'm out. Definitely. But look, he clearly knows what is at stake in this election. You know, he's made statements before that are thinly vailed. Actually not very thinly vailed but critical of thump. Trump. Certainly around january 6th. That they're pushing this idea of what happened in world war ii but they're saying these quote unquote myths about world war ii under gurd the modern order. And then, toward the end tucker carlson says why don't we have a normburg trial for the people who allowed mass immigration. So they want that to be under as a crime on par if not greater than the crimes of the right. The attempt to normalize what happened during the holocaust, is, it is so staggering and it is being done in broad daylight. I mean, i, i will call everybody's attention to a tweet from darryl cooper this his historian that tucker thinks it's the best historian. The picture on the left was hitler and the nazis in paris, infinitely every way than the one on the right. Which shows. People celebrating in the opening ceremonies of the paris olympics. That was since deleted but this gets to the quality of this revisionism. There is no troll quite like a holocaust denier and in a lot of ways holocaust deniers set the template for modern trolls. I'm just i want to play j. D. Vance's response to tucker carlson's interview. This is but the republican vice presidential nominee had to say. I believe agree or disagree with anything they say we believe in free speech. We believe if you do not like an idea of. The holocaust was a terrible tragedy and is something we have to make sure never gets repeated again. The best way to ensure that doesn't happen is to debate and pushback against the bad ideas. He was not debating darrell cooper or pushing back against darrell cooper. J. D. Vance is going on his podcast. And nobody is saying he does not have the right to deny the holocaust all he wants. But does he have the right to be 1 degree of separation away from the republican candidates for vice president of the united states? the very fact that although he no longer has a show on fox he has not just one of the most popular podcasts in the country, but all sorts of ties to the highest levels of the republican party and will soon be on stage. Basically the holy trinity at the top of the republican party. I just think the degree to which in some ways this ties back to what you were just saying about:cheney earlier. Those people for all their many sins had some sense of limits and patriotism and have been dethroned. I wonder the fact. Is it any kind of comfort or signal that the girls have not fully been demolished that darryl cooper had to delete that tweet? that tucker carlson is getting some amount of public criticism. Insufficient but feels like he needs to kind of not apologize for it, but put a final gloss on it. I think it is too early to tell. I think that what you see over the years is he pushes and pushes and sometimes there is a backlash, but the kind of limits keep moving. If there is no real consequences except for some handwringing in maintaining the level of access of power he maintained until now it will just be another taboo has been breached and it is hard to re create them.
