welcome to the beat, let's get right to it. we begin with the unprecedented collision of law and politics that america is facing in 2024 whether we like it or not, whether we are all tired of, which i get that the nation has never never put a former president on trial. prosecutors are working on that task even as donald trump's civil fraud trials go through 2023 and on 2024, he faces several criminal trials in different jurisdictions while running for president. again special counsel jack smith in the prosecution of trump's two in washington and the intelligence documents cases in florida, the atlanta ea pushing for those rico trials after winning convictions of trumpet aids through 2023 and the smaller criminal case in new york. you've got over 90 felonies charged. that's not normal even if it has been normalized. first the trial initially slated for march, while the schedules can change, america is facing more serious warnings from people who know about this, actual legal experts discussing a very real possibility that one of the major political parties in america, the republican party, will ultimately rally around and keep a nominee who might also be a convicted felon who has legally lost his right to vote. >> even half of what is alleged is accepted by a jury, he will be convicted. >> if the judges are right, i think he will be in deep trouble. >> this is game over. >> election day, you will be heading to the polls to vote and that something that donald trump will not be able to do because he will be convicted of felonies before then. >> oh snap, if you want to take that political you say that was a rival pointing out the indignity that donald trump could be a convicted felon not allowed to vote on election day but the more serious point is not just that chris christie is a rival, he's a former prosecutor and he saying something that if you are not in the maga bubble would normally penetrate every other part of thinking serious america which is with so many people available to run for president, why would you go with the one who's not only potentially a convicted felon but convicted for trying to overthrow a democracy? that's one wing. then against that backdrop, trump and his allies are clear that he has plans if elected, to wipe out the cases against him, abuse power, courts are supposed to stop that but trump has even floated the idea of pardoning the violent felons involved in the insurrection against america. convictions, usually drive american politicians from office and we should note, their independence who tell pollsters that the last straw would be a ump conviction but more and more publicans are saying the opposite. there has been a rise in those who don't want to ditch trump even if he were convicted by a jury of his peers of actually trying to end democracy as we know it. the flipside is you still have a large chunk of republicans who said they would not support him if convicted and that matters. there are clear warnings about what he would do, about being more authoritarian in the second term and the polling goes to a final point about the math. for all the talk about trump sticking around or getting away with stuff, there's still not here, he may not what you told learn the math but trump lost to joe biden by 7 million votes last time. he can't afford to lose more votes which is what the polling just showed, that some republicans would abandon him, if anything he would have to claw back more support in 2024 to get near the white house. a convicted nominee would be new but i also want to mention that it's also true american politics has faced all kinds of legal and legal issue type of drama before. indeed, in the last few decades we've seen a spike in what you may call legally adjacent policy , some may be more justified than others but it's happened more often and sometimes the seemingly endless rounds of dc- based congressional and sometimes partisan investigations. i mentioned that because her next guest knows all of those roles as a criminal prosecutor and former counsel to congressional investigations, we are joined by our friend john flannery. i walked through what we might see here, looking at 2024, your thoughts? >> i thought you did a great run through, all the key points that suggest to us that we are at a critical election and we say this often in elections but this one is so disproportionate, looking through the history of this country from our revolution to today, that there's nothing that compares with the outrageous conduct of a man who lied to america to become president, now lies to try to get elected again claiming he didn't lose the last election. richard hofstetter was a terrific analyst, both historian, and he looked at these kind of things. and he called it the paranoid style of politics. and he asked, what is your style of mind. and the question that he really raised which is the most pertinent and what we are observing today, is that, how much can you leverage the passions and hate of a minority to control a political atmosphere. we see it in the small way, mccarthy, but the sky, trump, he wins the sweepstakes. he, or abandon, has read enough to munich these bad past movements, and it has compromised america. i agree with you, the numbers are still good, and what we see is a shift against the money that they need to continue the fight -- >> yeah, i will jump in, i will jump in and say, john, you call the numbers good, my observation is that the numbers are still pretty anti-felons as presidents, which i think is a very low bar and a reasonable one. you mentioned hofstetter, he also wrote anti-intellectualism in american life and by your bowtie, i can tell you like that one, too. let me talk about the wider pressure. take a look. >> if you ever got another donald trump term, he's letting you know, i am your retribution. >> i am your retribution. >> donald trump won't deny that he has plans. >> uses you're not going to be a dictator i say no, no, other than day one. >> he's not a conservative, he's an authoritarian narcissist. >> if i see somebody who is doing well and beating me badly i say go down and indict them. >> the lesson of donald trump, of the last several years, the lesson has taught us that we have to take him seriously. >> that includes conservatives, i've got about 45 seconds, john, your thought on tying this together? >> you are not it for one day, and it's a message clear to all of his supporters that we are going to kick and take names and we are not going to accept the inside group, the deep state and all of the other things that drive the minority of maga people crazy. >> as you say, to properly understand, we look at this and say yes, we all understand there are politics, if somebody listened closely to you and studied your career, they might know where you stand on certain issues of liberal progress or civil rights, but we are not talking about that right now. that altitude, we are talking about the deeper question of, are we going to keep this republican are we going to have an informed citizenry that pushes back against a public authoritarian campaign that's running itself quite brazenly, or does that dissipate because we are too divided or two brain rushed to say. we appreciate you, if you want to end it, what is your final hope for the year? >> well, my hope is that we can answer the question that franklin asked, you have a republic if you can keep it. we have to fight to keep it. it's worth it. we need to see what it's like without democracy. >> yes sir, counselor, thank you. i appreciate it. we have news in the atlanta rico case, the da is speaking out and kevin mccarthy, he had a tough year as mr. t might say, he brought it on himself but he had a humiliating year, tonight he says goodbye and we have a fact check about why he went out with a whimper. after all this talk about what is going on in your actual economy from stocks to jobs, there's been a lot of problems this year but the biden white house says they are winning. we will explain with some special guests. i am back with you in just 60 seconds. 60 se cond s. me stops. (♪♪) gain flings. seriously good scent. kate is going big and going home for the holidays. that's the plan. at michaels she got everything to make cookies that were anything but cutter. turn ideas into i-did-its. ♪ (holiday music) ♪ whether you like it or not we are facing an election next year and as you probably know, the economy and how people are doing is one of those big issues, separate from what we've been talking about including authoritarianism and cruise, there's the question of how your job life is going, whether it's easy to get another one. do you feel stress, these are all standard campaign things, and if you look at trump as far back as 2019, one of his big that's has been that the incumbent president was, people trust the republicans more to keep taxes low and he would do a doomsday about how if biden got in charge, it would be bad for the economy. a prediction that has proved to be wrong. >> if you selected the stock market will crash. >> that marks a record high for the dow jones average. it will close above 37,000 for the first time ever. >> there it is, not exactly a stock market crash, the markets change, they go back and forth but we can tell you the dow is hitting record highs this week and went up again today. part of the reason is that inflation is slowing, that's macro economic, no one politician can take credit but it's certainly good news. meanwhile, there's been a jobs search, unemployment falling below 4% to near historic lows. that's great news for any incumbent president and the incumbent happens to be biden right now. the u.s. has added 14 million jobs. remember, nothing about this is automatic because a lot of people and economists have been predicting that this year right now i would be on the news talking to you about a recession. >> i'm suggesting that there's a very high risk, 65% or better of a recession next year. >> likely headed to a recession towards the end of this year. >> economists are now saying the u.s. will enter a recession within the next year. >> there is an extremely elevated chance of a recession and if you had to place your money, i would bet it be within 12 months that the economy would be any downturn. >> now, we haven't seen the recession yet and i'm not here trying to tell you what will happen tomorrow but the pendants did and it didn't tear out yet but we can't really look in any crystal ball and know what will happen. on the political side we know the fear or talk of negative financial and economic information makes people nervous, and some of those people were just giving their expertise but on the right leasing an effort to fan the flames, to try to override the good news that the titan white house is touting. the time said it's too soon to declare victory but the outlook is sunnier than it looks a year ago. so that's what's going on out there. we like to begin with the evidence and facts, that's what's been happening. is the economy strong and in the political domain we hear a lot of things. indeed, i'm not just hanging this on the beltway which has all of its shortcomings, you can also see a debate raging among general americans around the country depending on where you live, the economy may not be good yet or the biden beating inflation narrative doesn't need that your life and the food on your table is good enough, so if you check one of the things that people use most to talk today, tiktok, here is what you hear. >> i know you are not tripping, you're asking why do i want biden as president again, jobs created, 13.2 million, unemployment, down to 3.5. >> some change? >> sure. >> you didn't put anything in there. i put hope in there. >> biden's economic policies have been a disaster for our country. >> riding on it just works, the november jobs report came out and under president biden's leadership saw a gain of 199,000 jobs. >> so, those are actually real people, having the debate. and it goes to something that we are seeing out here which is a wider gap perhaps unusual, the ap said that the economy is getting stronger but voters feel, quote, horrible about it, and many americans would even say their personal finances are decent but when they're asked about the broader economy they still say it's bad. our colleague here at msnbc chris hayes was reporting on the same issue here. this gap between what we can understand with economic data, even with the caveats that it's complex and how everyone is feeling. >> you can see on the chart, the blue line, how you would expect people to feel about economic numbers and the redline, how they actually feel, have usually been insync. when things get worse people feel worse. right now there's a huge between them. that golf does not exist in similar wealthy countries like france or germany and the uk. it's only here. even though we are doing better than those places. >> chris is making a very fair point with the data and the gap and as our friend marvin gaye said, what's going on? well, i'm sorry the story ends this way but we are just charting this out. if it's not happening in other places that don't have well this kind of right wing echo chamber, that could be a big factor, which is, facing what i showed you that trump's predictions didn't come true and inflation to drop and the wall streetlly is happening this week exceeds me, so dramatic, i'm losing my voice, amidst all of that, you can deal with that so you might have to just lie about it or spin it or have a relentless conservative onslaught suggesting there something wrong with "bidenomics". >> between his endless reckless spending and soaring inflation, "bidenomics" is crippling our economy. >> we've just seen disastrous results. >> when it comes to economics, president biden is like a hog on ice. >> their agenda, can be summed up in the acronym, spd, scarcity, poverty and depravity. >> inflation loves present biden like the devil love sin. >> okay. what's going on there, those are clips and if you keep your sanity, they might be laughable but what if that is what you watch for hours and months and years on into even at the point where your 401(k) might go up a little bit or the job market improves, that doesn't fix everything, you see that so much you don't even notice the other data points. we have obama veteran jake, and journalist michael hit sick for the wider view, next. delectables. delickables? >> i don't think it's a riddle. the biden economy is great. when people say they are unhappy with the biden economy, what they really say is they are unhappy with his age. they simply do not want to look like a just tickets, who are constantly harping on how this guy is too old to be president, so there justifying their disapproval by saying, i don't like the economy either. >> do you think they are insecure when the pollsters call? >> you have to understand how presidential feelings work. people often lie to themselves as well as lying to others about their actual feelings when it comes to bigotry and prejudice. >> michael did you know it would give this deep right after the that? >> certainly when it came to the political issues here, i think there are two economic issues that really play into this. one of them is something that jerome powell, the chairman of the fed mentioned just yesterday, when he announced, he gave his press conference after the fed decision on interest rates. and that is that even to the extent that people are aware that inflation has come way down over the last six months or a year, what they are looking for, is for prices to come down. and that's not happening everywhere, it's happening in some sectors, certainly gasoline has come down and in parts of this country can get a gallon of gasoline in the two dollar range. fuel and oil as we enter the winter, that has come down, used cars are cheaper, the inflation rate on food is really very low, but prices of food having gone back to what they were in 2019, and that is what i think a lot of people focus on. now, the other aspect of this is that what we know just from history, is that people's perception of the economy, always has a lag, especially when there is an inflection point going from high inflation to low inflation, from no growth to high-growth, and i think that's where we are right now. -- >> let me jump in, what portion is the price thing and what portion is the lag and what, if any, is the echo chamber that we discussed, just to drill on your analysis. >> i think the echo chamber has a lot to do with it. as you showed, if you were listening to fox news, you are being told constantly that the biden economy is a disaster and you don't get many details about what is disastrous about it. and i think if you are watching tv generally are listening to radio, you are getting a lot of advertisements from investment promoters, who are basically constitutionally, leaning toward painting the economy as bad, so that they can sell you on something new, they can say, we know the economy stinks, so you should buy gold or bitcoin or something like that and that gets drummed into people's minds but over time, you know, more of the public will recognize that things are actually pretty good. >> people are not acting in terms of what they are saying they are feeling, you know, we are in the midst of a record christmas shopping season, business startups are at an all- time high. if people were really worried about inflation and the economy, those things would not be occurring. when i think is happening is people are claiming and unhappiness with the economy that is really about how they feel about joe biden and his age. >> let's put a number up and see what you say. the pulling on who do you trust in the economy, you are saying it could just be this leaning indicator, trump and 47%, biden, 36%. some of your former colleagues at the white house, they are banging their head against the wall looking at this. you are saying to only look at this on what it's claim to be is a mystery. >> people rationalize their presidential feelings in different ways, lots of times they believe in conspiracy theories when they really don't believe in them, they say i support from because of the deep state, they don't want to say, there's too many brown people in my neighborhood. that's the way this works. i can attest to that, i am an indian american, i'm a husky gentleman. >> a husky gentleman? >> certainly people judge you based on your body, based on your appearance and that has this comes out in ways that are not wholly rational, that are not wholly forthright but they do come out, so when people say they are unhappy with the biden economy, what they are unhappy with is his age. joe biden need to talk frankly with the american people. >> michael, do you see how real jake keeps it?
