Of President Donald Trump. This time, hes accused of running a criminal enterprise to keep him in power for violations of georgia law arising from a criminal conspiracy. Donald trump, an 18 allies indicted for scheming to overturn trumps 2020 election loss in the state of georgia. Good evening, everyone. Im mike mibach. And im greg lee. This is his fourth indictment in four months. Ctvs Jana Katsuyama has been following breaking details coming out of georgia tonight. Joins us now with the very latest. Jana, greg and mike, all of this happening very quickly just in the past couple of hours. The grand jury deliberated until 8 p. M. Tonight, georgia time. It was almost midnight on the east coast when the District Attorney came out and announced these charges against the former president. The da released the 98 page indictment tonight. It charges 19 people, including former President Donald Trump, and lists 41 felony counts against him and other top republicans, including local leaders in georgia and Trumps White House chief of staff saying they were all part of a criminal conspiracy, along with former President Trump. His attorney, Rudy Giuliani, and former chief of staff mark meadows, who are among those named charging 19 individuals with violent versions of georgia law arising from a criminal conspiracy to overturn the results of the 2020 president ial election in this state. Fulton county District Attorney fani willis announced the charges late monday night, wrapping up an investigation that lasted more than two years. The charge is alleged interference in the 2020 election by former President Donald Trump and his supporters to illegal keep President Trump in office. Former President Trump is named in 13 counts, which include trumps phone call to georgia secretary of state Brad Raffensperger asking him to find enough votes to overturn bidens win in georgia. I just want to find. 11,780 votes, specifically , the participants in association took various actions in georgia and elsewhere to block the county of the votes of the president ial electors who were certified as the winners of georgias 2020 general election. Among the others indicted trumps attorneys, Rudy Giuliani and john eastman, as well as white house chief of staff mark meadows and georgia gop officials as well as campaign attorney sidney powell. Charges include false statements impersonating a public official , forgery and conspiracy to submit false documents. There were also dozens of coconspirators who were not indicted. And mike, the District Attorney is saying that she is giving the defendants the opportunity to surrender no later than noon on friday, august 25th. All right. Two quick ones for you, jenna. When it comes to the timeline for the trial, what are they thinking . And then also, if they dont surrender, you said next fridays the date. Its up to the da, then to have them arrested. The da says that she will take whatever steps are necessary, and she also says that she wants to move these proceedings along. So she says she will be asking for a trial date within the next six months. Jana katsuyama live tonight here in studio. Jenna, thank you. All right. For more insight into tonights indictment, were joined by laurie levenson, law professor at Loyola Marymount university. Laurie, appreciate the time. Lets start with this sweeping set of charges, 41 counts total, 13 against trump. How big is this . And what do you make of these racketeering charges now . Its huge. I mean, this is a stunning indictment. We thought that the case in washington, d. C, by special counsel John Jack Smith was going to be the big case, but its not even close. This racketeering indictment brings in so many charges and so many defendants and takes it through every single lie that trump made or people made on his behalf. So we have well over 100 acts in furtherance of the racketeering charge and this is a really powerful charge because it allows them to put together many different conspiracy schemes. It also carries with it, frankly, a mandatory minimum. So if trump or the other defendants are convicted and they dont have a chance at probation, theyll do at least five years in prison and maybe up to 20 or more. Yeah laura, you mentioned the number of defendants, 19, including the former president. How much of an issue will that be for the trump legal team, especially if any of those turn on the former president . Well, youve heard of it on the nose. I mean, its a real problem, i think, for former President Trump, because there going to be a lot of people trying to save their own skins by offering to cooperate against him and especially the many lawyers where hes likely to say its their fault. Thats the advice they gave me. I think it comes a point where they stand up and say, no, not exactly. And they dont take the fall for trump. Its also true that you have people who will say, you know, look, maybe i did something, but i shouldnt be part of such a huge conspiracy. Give me just a little bit of conviction. Not this case that can dramatically change my life. Yeah. Lori, there are a number of differences between this case and the two federal indictments, including no chance of a president ial pardon. How do you rank this in the scope of his legal troubles moving forward . This is very significant because i think that some people think trump is running for president so he can avoid being convicted on the federal charges. But it wouldnt help him even if he gets elected president again. He doesnt have any power to pardon himself on a state offense. And in fact, in georgia, not even the governor could pardon him. It would have to be the pardon board. And after serving five years in prison. So this is a really significant case against him, both in scope, the potential for exposure and the fact that itll be very hard for him to keep a whole group of 19 people together in solidarity when they go to trial. Yeah, you mentioned that exposure earlier. Lori, i also want to ask you something the da talked about from fulton county. Was the difference between overt acts and predicate acts can you speak to that a little bit . Sure. For a conspiracy to exist, you have to show that it got off the ground and not every coconspirator has to do acts, but you have to show that at least two acts were done and in that regard, those acts in themselves dont have to be criminal. They can be as alleged in the indictment, making phone calls, predicate acts are criminal acts that are in furtherance of the racketeering conspiracy. Theyve got both of them listed here. They have nearly every phone call listed. And i think thats a showing that they have recordings thats going to come as a surprise, frankly, to trump and the fellow conspirators. Theyve got recordings of so many of these calls and theyre not just calls in georgia, theyre calls to other states, whether it be arizona or pennsylvania, to try to get those people to help them with their scheme. Yeah a very significant indictment indeed. Laurie levenson, law professor at Loyola Marymount university, certainly appreciate you joining us tonight. My pleasure. Former President Trumps legal woes stretched beyond this case. Weve been saying a federal indictment is tied to his involvement in the january 6th riot at the us capitol. Prosecutors have proposed that that trial start in january of next year. A judge is expected to make a decision on a trial date later this month. The former president is already scheduled to stand trial in march in new york. That case stems from hush money payments made during the 2016 campaign. Then in may, he set to face trial in another federal case in florida. That case stems from classified documents found at his mar a lago estate. You can find extensive coverage of this indictment on our website, ktvu. Our online coverage includes a link to the full indictment. You can read. New at ten shop owners in uptown oakland tonight. But he says a lot more Research Needs to be done before any official decision is made tomorrow. Even if it passes. The city is not committing itself to having a san jose power or a municipal utility. San jose mayor matt marin says Tuesdays City Council vote is about the citys ability to create a Utility Company. And its the first of many steps in the process. Theyll take a look at the Economic Impact and other key factors before finalizing any decision as the state expands transmission lines into san jose. If we were to tap directly into those, we may have more direct control over our destiny in terms of priorities and projects ensuring they get connected to the grid faster. There could be some real benefits there. Currently the city of san jose is serviced by pga and mehan says he has discussed with them the citys needs and concerns. He says the council will discuss if creating a san jose Utility Company may avoid more construction delays and lead to future savings. Right now what were looking at in the short term is interconnection rates. How quickly can new housing and jobs get connected to the grid . So that we can continue to facilitate Economic Development in san jose . Demand for electricity throughout the state continues to grow, which is one reason new transmission lines are being installed throughout the south bay region. The primary line were looking at would be coming down from newark through North San Jose near our Wastewater Treatment facility, which is a Major Energy User would then come down past the airport. Another major user of energy down into the grid on station area where we anticipate Downtown West eventually being built out. Now, the mayor says although they are considering creating a Power Company, he also doesnt want to overburden the city with more responsibility than it already has. New at ten, a fire in houston could be smoldering for the next week. A large mulch fire started yesterday afternoon at an organic waste company. Houston fire says it was extinguished actually for about an hour, but then gusty winds whipped it up once again. Firefighters were able to isolate the flames so that they say the fire will not spread. The caldor fire in El Dorado County started two years ago today. The fire destroyed more than 400 homes in Grizzly Flats and burned 220,000 acres. It has been a slow road to recovery for many residents. Theres still no post office, no school or community church, and many people are still living in rvs. Ryan right. At sierra vista winery, recalls the day the fire started. I woke up in the light. The sky just kind of looked funny, like it looked like it was going to rain or something. And then i walked out my front door and realized it was smoke, not clouds. We were evacuated for two weeks, so we had wines fermenting and tank that we had to check on every day and we werent able to access. David smith and travis smith, a father and son, are charged with recklessly starting the monthslong fire. Theyve pleaded not guilty and are expected in court next week. Isolated storms rolled across the sierra last night and into today, bringing the possibility of dry lightning in Northern California with that, we turn to chief meteorologist bill martin. A little humid out there today bill. Yeah really was. And temperatures today, these temperatures were cooler than yesterday by a few degrees, but with that added humidity that we saw today, even the showers that we saw in parts of the central, the Central Valley and even near the bay area and offshore off the coast, that with all that activity in the humidity, it felt a lot hotter than it really was. The outside. Right now, weve got a big city. I dont know where that is exactly, but its the bay area. And i can tell you, weve got fog right at the coast. Weve got clouds overhead, more of that subtropical moisture. But most of that moisture right here has cleared out. Heres the last 12 hours. And all those those white pops are lightning strikes. Doppler most of them are doppler reported lightning strikes. Some maybe not showing up here, but you get the idea that the moisture plume is asking from east to west and over to the north of us so that were missing out. We did have a cell down here around monterey that came up the coast this afternoon that looked like it might deliver a thunderstorm form out towards eastern san jose. But that fell apart pretty, pretty quickly. So that tropical moisture is moving away. But its going to continue to linger a little. So tomorrow, temperatures a lot like today, but less humidity. So it wont be quite as muggy. Itll be half about half the humidity that we had today. Current temperature is still pretty hot in the inland bay valleys, 84 in brentwood, around the bay. Its cool. The fogs at the coast, you know the rest. Tomorrow is going to be a lot like today, less humid. Ill see you back here with that and the five day forecast coming up. Sounds good, bill. Thank you. Police are investigating another Mountain Lion sighting, this time in menlo park. A person reported seeing the Mountain Lion about 730 this morning right near sandhill road, ktvu. Jesse gary has the latest. Menlo park Police Detectives say they received a call around 730 monday morning. One person reports seeing a Mountain Lion walking along a back fence at the sharon hills golf and country club sent officers out to check the area. Officers were not able to see any Mountain Lion or make any kind of contact with any animal that matched that description. And out of an abundance of caution, we made a message out to the Community Officials with the bay area puma project say so far this year there have been 89 Mountain Lion sightings in the bay area, 66 of those are in San Mateo County. Its the county with the most sightings. Experts say a search for habitat and food is likely the driving force prompting the animals to move near populated areas. Mountain lion habitat is often splintered by urbanization. Right. So its possible that this Mountain Lions habitat is just as dissected by 280. Right. Or dissected by the golf course. And its possible the Mountain Lion was simply moving from one patch of suitable habitat to another patch of suitable habitat. The one call did not produce leads and employees doing renovation work at the sprawling club say they never saw a Mountain Lion. Officials say theres no danger to people at a nearby strip Shopping Mall or in downtown menlo park. Hopefully, if we if we take appropriate precaution, the Mountain Lion will go back to its habitat, pass on through and keep living a life in the wild. People that do see that animal stay away. Obviously dont put yourself in a dangerous situation and just notify the Police Department. You can report Mountain Lion sightings directly to the California Department of fish and wildlife. Just go to our website, ktvu. We will provide the link in menlo park. Jesse gary ktvu, fox two news. Tracking that subtropical moisture out of the bay area, you see the lightning strikes, those white pops. The flow is like this kind of coming back from the east to the west. And its been doing that all day. And its actually going to continue to bring this low the way the rotation is or that flow is going to last through the next few days. So tropical moisture is going to continue to come our way and keep the humidity is relatively high. I dont think its going to be as aggressive. The todays humidity was pretty, pretty high. I think tomorrows will not be itll still be humid, but not as these are the highs from today. And again, cooler than yesterday, but just with the humidity, it felt warmer. Most certainly with 98 degrees and an antioch or livermore 97 in antioch and 45 humidity that is very, very noticeable. And im sure you did. The temperatures outside right now are cooling off. The fog around the bay is pushing back in. You can see the fog here, which is always a treat to see, especially if youve been sweltering in the heat and humidity. The fog at the low level above that flow i showed you coming back that its the high level subtropical moisture. And so this is one cloud deck and that other ones way up there. The flow will continue at the surface, slightly onshore, aloft where the subtropical moisture is more of that easterly flow. So 74 in fairfield is still pretty warm. Brentwood, 84 degrees. Its still pretty warm for this time of night, a little cooler than last with the minus one in napa, minus two in novato. Heres a computer model. And what you see here is tomorrow all day that moisture streams to the north, maybe a scattered shower. Certainly some thunderstorms possible in the mountainous areas. But the main swath that you can see there stays north. So thats the forecast model for tomorrow here comes wednesday morning. You still see theres some flow, not as much moisture , but its still pulling from the south. So that is wednesday morning. And then again, boom, right. Another plug comes in a little further to the east of us and thats going to set us up with increased humidity and a shower again. So as you look at the temperatures for tomorrow, theres the setup in the morning. The high clouds come in, forecast highs, red, the 90s purples are one hundredths. Get a couple of those in there. So as we look at the forecast highs tomorrow, 100 in fairfield, 99, the antioch so very very warm humidities are going to be a little bit on lower side when i come back to 911, well update the forecast. I built. Thank you. Governor newsom took time today to highlight some of the States Education issues. The final score the 49 ers will play their second preseason game of the year on saturday at levis against denver. One of the issues the 49 ers wanted to decide before the regular season is the identity of their backup quarterback. Trey lance was the starter last year at this time. His injury in week two and then the emergence of brock purdy after Jimmy Garoppolo was hurt, his relegated him to backup status. Lance ran the 40 niners offense in the first half and yesterdays loss to the raiders. His stat line wasnt bad but his indecisiveness cost him four sacks. Sam arnold played a quarter. Arnold who drilled that a number three overall pick in the draft looked sharper but hard to make such determinations in the preseason because of the different personnel groups on the field. One thing yesterdays game did point out the 40 niners have some cleanup to do that was definitely frustrating but obviously put it on myself. If you continue to be better, make sure the guys around me are ready to go. Im ready to go. It starts with me. I feel like i manage things well. You know, i think at the end of the day, you know, we just as a team, we just need to play better as an offense. We need to operate a little bit better. It was nice to be able to get trade the whole first half, get sam a little bit and hopefully sam will get a little bit more time next week. The 40 niners spent a few days in las vegas practicing with the raiders. They also had little time for the kind of thing that builds team unity during Training Camp sunnyvale. Randy boyle.
