Professor thanks for being with us tonight just your basic reaction we all knew she was battling cancer, but it kind of caught everybody off guard tonight didnt it. Yes, i mean i think like so Many Americans i was shocked even though of course she was 87 and had had a lot of mental, i mean excuse me physical Health Issues when i when i heard the news like many people i got very teary eyed because it was shocking and we thought of her as kind of a rock and someone who even though shes been through a lot of physical adversity an emotional unversity her husband passed away had been someone who we thought and we would be here forever. The second woman on the United StatesSupreme Court made quite an impact more than many of the men over these many many years why do you think that is. I think she had this really extraordinary combination incredible forward thinking this with respect to the kind of race that she wanted to promote and that was especially the rights of people who are marginalized on the rights of women and i also think she was known for her collegiality that she was someone who forged relationships across party lines most famously in her very deep strong friendship with Justice Scalia who in many ways could not have been more opposite from her in terms of his views but shes really known for championing the causes of women and really for advancing the rights of women under the law. You know its interesting you say that because even President Trump today had some very nice things to say about her and thats something that he sometimes does not do as we know. But but she did get along with scalia very well and and the the praises shes getting from the other side of the aisle. Dont you think its rather remarkable giving what this country is going through right now. I do and i think it speaks to her legacy. I think over time she became not only an advocate. For women, but someone that so many people look to as a story of coming up. From the trenches from battling for in the trenches of the courts and then advancing all the way up to the highest level imaginable and of course she was the only the second woman who made it to the Supreme Court and so i think for millions of americans she stands for this idea. That theres no Glass Ceiling for women because she peers so many of them and i think her beloved masks, the fact that so many people just think of her with warmth regardless of their political views also speaks to the kind of a human being she was that she was a truly wonderful person that was in passing and look for the humanity and everyone certainly not to take anything away from her legal standing, but what about her standing in the. Pop culture of america which was pretty amazing. I love that she had this late in life rock stardom mean she wasnt appointed until she was 60 by president bill clinton and before that i dont think very many people outside of legal circles who never heard of her. But she was just even though she was only 5 feet tall 100 pounds this force of nature and she did have a cold following i think a lot of that was because again shes history of championing womens rights in taking these really all positions and not holding back at a time when many many women felt like that was not possible for them so she was breaker but also in a way that was very gentle she was a very wonderful person in the sense that she never came across as an adversarial or unpleasant person she did everything with grace and also with a great deal of intellectual rigor and so it was just hard to find fault with her even though you might disagree with her with respect to some of the positions that she truck there were very few people that didnt walk away thinking what an amazing human being. Nprs reporting tonight that she apparently left a note that are grand daughter. I said that she had urged that next Supreme Court justice not be voted on until after the election. It seems fairly unlikely tonight that thats going to happen what do you think she would make of what is sure to be a very. Bruising to say the least of not ugly. Campaign for the next seat on the Supreme Court. Its hard to to speak for anyone, especially for Ruth Bader Ginsburg, but i believe that the sentiments and that note or genuine and i think what she was trying to say is that the appointment of a Supreme Court justice is very serious and monumental events and then it should not to the extent possible be politicized and i think yes she would be quite concerned at the idea that a Republican Controlled Senate would ran a rightwing nominee. On the eve of what is potentially the most consequential election of our lifetime. As a law professor you may be able to answer this one of our earlier said that there really are no rules when it comes to whats ahead for us now and predicted he was predicting the potential for a real constitutional crisis, what is your view. I think we are in unchartered territory in the sense that of course the Senate Majority leader Mitch Mcconnell refused to confirm Barack Obamas nominee Merrick Garland when barack obama had more than a year remaining on his term with Mitch Mcconnells justification being that we were essentially on the eve of the consequential election and so i think it is fairly hard to swallow that now this very same Senate Majority leader when its a republican. Who could potentially score of what liberal. Justice should just be sort of. Rams through again at the last minute were having an election in november and i think that is troubling at the same time it doesnt seem to me. There are any legal mechanisms in place to stop that and i think that if Mitch Mcconnell has the votes in his Republican Controlled Senate for a nominee that President Trump puts forth. I. Imagine that that person will in fact be confirmed and yes to me. That is troubling for a number of reasons including the past positions, Mitch Mcconnell, which seems completely at odds with the position that hes taking now and what we are hearing from the right side of the aisle is that this is going to be a battle over abortion. To overturn roe versus wade and that is the kind of justice they want on the court is that something youre hearing. Yes, but i actually think its a mistake to just think about this in terms of abortion thats it thats an important issue of course, but it is not absolutely not the only issue and there are so many issues in which it really matters to have balance on the court and yes abortion is one issue there are many many others including decisions like citizens, united unlimited spending and campaigns, including there is decisions sharply sharply curtailing the rights of people who have been imprisoned and claimed they were wrongfully convicted or rightfully convicted but deserving of a second look and so i could go on and on and the ways in which various individual rights are implicated by having a court that is very very far to the right and certainly abortion is i think the galvanizing issue for many people because its deeply embedded in their psyche that there is one segment of the population that thinks its morally completely wrong. Another segment think its permissible under certain circumstances, but i think its a mistake to distill it down that single issue. So while out of time but one last political question what do you think the strategizing is tonight on both sides of the political aisle. So i think the started dressing on the right is pretty straightforward. Its just mustering the number of votes that they need to confirm trumps nominee and i think that thats the same strategy that they had with Justice Gorsuch and its the same strategy that they had with Brett Kavanaugh which they used to to great effect in the wake of the lot of opposition. I think what the democrats are left with is trying to appeal to very few people who are republicans who claim to be moderates. So that would be Susan Collins and Lisa Murkowski specifically those appeals have fallen on deaf ears in the past and i cant count the number of times that Susan Collins has said that shes court of polk concerned about the various position or nomination. The trump has put forward only in the end to do exactly what he has wanted her to do and sell. I think the democrats are on a mission to try to move these few moderates that are remaining to not go along with what the rest of their party wants but ultimately i dont see that working. Hurricane maria, you may remember hit puerto rico as a category 4 storm back in september of 2017. And it killed at least 3,000 people essentially destroying an electrical system on the island which was already unreliable parts of the island remained without power for almost a year. But today President Trump touted his administrations action in puerto rico by sending additional federal assistance. And then obama came in and it got worse. So for the people of puerto rico. They were disaster for you. And i have to say in a very nice way very respectful way the best thing that ever happened to puerto rico. Nobody even close. The grant money also comes as former Vice President joe biden is scheduled to meet with voters in the crucial swing state of florida. Florida is home to a large number of Puerto Ricans including many who fled Hurricane Marias destruction speed of hurricanes along the alabama coast in florida panhandle, hundreds of thousands of people are still without power after Hurricane Sally devastated, those communities. A big story out of the east bay, the city of martinez has decided to pave over the black lives matter mural which was painted on a street in front of the citys courthouse, the mural has attracted a lot of the local attention and National Attention since it was painted in july. The city Officials Say that this is a part of a larger citywide projects are going to be pain over the black lives matter mural next month now again and talk to people many people happy that the mural was up in some people, not so much now again you might remember this mural when up back in july was painted by a team of about 100 volunteers from a local black lives matter chapter. And this was after white power flyers were found on a sidewalk. Nearby after you had several incidents take place around in the mural including the one that garner National Attention you see that right here after a man and woman who defaced it with paint the same day it was actually created and the city says the local black lives matter group has asked for permission to repaint it a few times but they were denied actually spoke to some local residents and heres what they had to say about the city painting over the mural. If the city have decided to train over black lives matter. Thats fine they can also have you can you can do is sign or something a little smaller.
