all right. we will continue to watch these pictures. top of the hour and right now hunter biden's legal team is making closing arguments in his criminal gun trial. hunter himself did not take the stand. he faces up to 25 years in prison if convicted on all three counts. at this pace, because the prosecution has finished closing arguments and the defense has begun, the jury could get this case before leaving tonight. hour two of "america reports." this case is moving at lightning speed. to be too good to be with you, i'm sandra smith in new york. the prosecution gave closing arguments i made it clear to the jury that only one things mattered when deciding the fate of the president's son is evidence. >> the prosecution open with a bang and this is what they did. they pointed to where the first lady was sitting, where all of hunter biden's family was sitting to support him, and they said this. the people sitting in this gallery are not evidence. to be able to present to the jury the sound of the defendant and his own words admitting to all kinds of drug use during the time period in which he purchased this gun which of course is against federal law." >> sandra: jonathan turley on developments in that courtroom. rich edson's live outside the court in wilmington, delaware. what's the latest? >> good afternoon, sandra. the defenses up making its closing arguments, you heard a little bit of that from carrie. as you mentioned, this thing is really moving quickly and there's a chance that the jury could begin deliberations this evening. when the prosecution began its closing arguments focused on hunter biden's active drug use from 2015 through 2019 and presented a summary of his text messages, bank records. prosecutors highlighted his ex-girlfriend and sister-in-law's testimonies of his drug use. they also said gordon cleveland, he's the firearm salesman that the quote only relevant witness from the gun shop" since he was the only person to testify he saw hunter fill out the federal form swearing he was not a drug user. all attempting to prove beyond reasonable doubt that prosecutors allegations that hunter was a drug user when he signed that form, bought that gun and possessed it for 11 days. prosecutors let off the presentation referring directly to biden family members including the first lady saying people sitting in the gallery aren't evidence that nobody is above the law. the defense is arguing that no witnesses testified they saw hunter doing drugs in october 2018. hunter's attorneys maintain he was drinking at the time, not using illegal drugs, and stressing drug use before or after does not prove drug use the week the week and a half that he had that gun. after the defense finishes its closing, prosecution has an opportunity to offer a rebuttal and then jury instructions and deliberations. if he's convicted, there's a maximum penalty up to 25 years in prison. $750,000 in fines. if he is convicted would be a first-time nonviolent offender. sandra. >> sandra: rich edson outside the court for us. thank you. >> john: let's bring in jonathan turley, constitutional law attorney and fox news contributor as well as a law professor. an esteemed one at that. this is moving quickly. this morning they had arguments and discussions as to whether or not hunter biden would appear. they decided that wasn't going to happen. the prosecution completed its closing arguments, another defense is going and prosecution will get a rebuttal and then it's off to the jury. from what you know of this, has abbe lowell in any way, shape, or form been making a compelling argument to the jury to a quick hunter are the very least go easy on him? >> i think the most compelling argument that lowell made to the jury was stating the last name of his client. this is biden town. i think if you look at the defense, this is just as clear as you can get for a jury nullification case. the defense that lowell put up in the opening argument collapsed within 48 hours. the prosecutors just made mincemeat out of these arguments. there was a series of them, all of them implausible. that's not the point. these are placeholders and they are hoping that the jury will nullify this evidence. they are not asking for the jury to -- they are asking for them to ignore the evidence. many -- all the juries said that they had experience with people with drug problems. it was very emotional testimony from hunter himself as to what he went through. but also you have a sizable biden contingent in that courtroom reminding the jurors that this is biden town. this was their hometown. i think the prosecutors are worried that no matter how strong their case they might not be able to overcome it. >> john: abbe lowell seems to be trying to thread a needle here to say okay, there's all this talk about drug use but in the time period literally down to the week that he bought the gun he wasn't doing crack cocaine or anything else. he was drinking. but if you sign "no" on that federal gun purchase form. to this idea, are you addicted to or using drugs, is it on that day? is it that week? or is it more in general? >> according to abbe lowell it appears the question was, are you doing drugs right now? he did this so that he'd have to be doing lines of coke on the revolver in the courtroom. obviously that's not the intention of the question. the government really slammed this argument by putting up texts that hunter put out the very next day trying to score, he said he was trying to score drugs with a guy named mookie. he had these witnesses that said when they saw him he was doing crack every 20 minutes. so you have this sort of immaculate period that lowell is suggesting where he might have just been drinking heavily. most people would say that's completely implausible. that's not the point of the defense. the point of the defenses to give some jurors an excuse to say "i'm just going to acquit," even though the defense collapsed days ago. >> john: all the data. i was on with dana perino earlier today on "america's newsroom." andy mccarthy does not think hunter biden is going to be looking at the inside of a jail cell. listen to what he said. >> looking at his potential sentencing guidelines it looks to me like even if he gets convicted here he's got a good chance of avoiding a prison sentence. >> john: what do you think, professor? >> i try never to disagree with andy and i don't disagree with that comment. i think the odds are that he will not get jailed. but this was an open and shut case and this defendant put this court through this trial. if he is convicted, some judges actually do not look kindly upon that. if you put everyone through a trial on a case that seemed strict liability, you check the box. some of them may feel you have to do a little time in jail even if it's a brief stint. i would not discount that possibility because of what he went through or put the court through by challenging overwhelming evidence of guilt. >> john: ten seconds on this. can you believe this is a guy who almost got away with a plea agreement that gave him lifetime immunity? they gave me a pretty concise description of what he said. he's going to bring our jobs back. he's going to build a wall. he's going to kick isis. they got the bullet points. >> john: he's currently making inroads in nevada. new fox news poll has him about five points. 50% to 45%. he said something over the weekend it would probably grab the attention of a lot of people in the service industry. listen. >> so, this is the first time i've said this. for those hotel workers and people that get tips, you're going to be very happy. because when i get to office we are going to not charge taxes on tips. >> john: here's how the culinary workers union reacting saying for decades the culinary union has fought for to maker's rights. relief is definitely needed. nevada workers are smart enough to know the difference between will trickle real solutions and wild campaign promises from a convicted felon. >> [laughs] if you are in the union in nevada they will take you to the polls and you're going to vote for the democrat, i think that's all there is to it. one thing that is striking about that speech in nevada but a number people seem to have their hair on fire about, he spent an enormous amount of time on the border, illegal immigration, on economic issues, inflation. the thing that doesn't get reported in trump's speeches is how much he talks about the actual issues that very closely mirror the polling on the issues people care most about. >> john: most people talk about him saying that he's not going to pay the company that did the teleprompter. >> he will throw in something kind of off the wall. >> john: there's an awful lot of animosity toward trump. noted canadian psychologist jordan peterson waited on that, listen to what he said. >> the degree of animosity people have for trump is actually somewhat of a mystery to me. i can't quite crack it. there's a class thing there i would say. elitist people are annoyed that someone like trump or someone who they think trump is has dared to enter the upper echelons. there is something about it that's very classist. >> john: basically saying how dare he try to become president. >> that's a really big question that's been around for quite a few years. i'm not sure i have any better answer myself. i know now, i think you're seeing an intensification of that. for one big reason. trump has been leading joe biden in the polls for quite a while and then the biggest thing for democrats that could happen happened which is trump was convicted of 34 felony counts. so far they haven't seen that huge switch they were looking for. >> john: in fact it's going the other way. >> they might see a bump. they might not but it's not turning out to be salvation for them. still warm the reasons why voters are going the opposite direction, the tall tales and the other things associated with him when he gives public speeches, like this. listen. >> besides, i used to drive an 18-wheeler. you know what i did? that's exactly right. first organization i rejoined was the naacp! didn't get to vote until you were 21 of those days but i got involved in civil rights when i was 15. i come alike a lot of work a lot of people in the audience, whereas the first and my family to go to college. >> got shot down in new guinea and they never found the body, there are a lot of cannibals for real. >> john: mechanical stories my favorite. he's getting a pass from the left-wing media but "the new york times" took a look at this. "biden loves to tell tall tales. we cut them down to size." he was a teenage civil rights activist, former trucker, the first and his family to go to college on the nephew of the cannibalism victim. all these claims stretch the truth or are downright false. that mr. biden persists in telling personal tales with rhetorical flourishes and factual liberty when he works our room or regales an audience. why aren't posts on other networks talking about that? >> i like the "factual liberty" part. the times did everything they could to soften this. the president tells tall tales. later they said he tells yarns. it's like, what can you say? they've done millions of stories about the thousands of lives donald trump -- lives donald trump has told every minute and they just completely soft at all this but you don't have to compare the two to think that the biden thing is serious. he's claiming biographical assets that he doesn't have. he goes to a civil rights meeting and says i was a member of your organization when i was 2 years old and nobody checks it out. it's a serious issue. >> john: ronald reagan used to tell stories as well but they were actually jokes. i like the one about the three leggett chicken. byron, thank you. >> sandra: all right fox news alert, this just in. brand-new video from the helmet camera of the police special anti-terror unit during the rescue of those three hostages over the weekend. because the goal is to get people to watch team usa in the olympics. the only reason, to be perfectly honest, the people are watching the wnba, the only reason the wnba is likely to turn a profit for the first time, the only reason teams are getting charter flights is because of caitlin clark. it was very stupid on the olympic committee's part to not put her on that team are very selfish reasons. >> sandra: no matter what the reason is, everybody's got a reaction. >> i think they whiffed. they believe they lost a golden opportunity. the undeniable thing about caitlin clark is how popular she is, how many i have all she's brought to the sport. people are discovering women's basketball for the first time. for many, many people, because of caitlin clark. >> sandra: the ratings speak for themselves but gosh, you just have to have a set of eyes to see just how spectacular she is on the court and a great representation of the sport in general. so is there a chance that anything changes here? >> there is the potential. the olympic committee still has time to say you know what, maybe we didn't mess up. maybe we do want to walk it back and put her on the roster. those 12 spots. one of which could certainly be hers. then there's talk of her being an alternate. my opinion, it's not enough because alternates are rarely going to be used on the team unless something suddenly happens, somebody gets injured. falls into poor health, has travel issues, who knows. the fact is she needs to be on the team because people want to see caitlin clark play. they want to see or represent team usa. it's not uncommon for rookies who come into the wnba who have that level of greatness, that clout to be put on the olympic roster so this one especially does not make sense in the case of caitlin clark. >> sandra: there are some people saying there's no way they can take off and head to the olympics without her on the plane. but there's also takes like this. i will get your response. this is the former iowa women's basketball coach. here we go, let's listen. >> she's won three gold medals. but we have to remember it is the hardest game, team to make. anywhere. it's the hardest team to make and the 12 women they have chosen our exceptional women. >> sandra: exceptional. how else do you describe her?
