court has agreed to fast track consideration of a case testing whether former president donald trump has immunity from some of the criminal charges against him. the man in charge of prosecuting the former president on charges of election interference asked the nation's top court today to step in and now the highest court in the land has responded. correspondent david spunt has details tonight. good evening, david. >> bret, good evening. they certainly did. just moments ago the justices instructed the former president's attorneys to weigh in by next wednesday, december 20th. the supreme court is a body of nine that tries to remain apolitical but those justices are now being asked to enter the nerve center of the 2024 presidential election. special counsel jack smith has made an emergency plea to the justices asking them to rule on whether donald trump is immune from prosecution. smith petitioned the court earlier this afternoon asking for a quick decision. the federal judge overseeing the case ruled the criminal trial involving alleged 2020 election interference can proceed and that donald trump does not deserve a lifetime, quote: get out of free pass, end quote. just because he was president. trump's attorneys say even a former president is immune from criminal prosecution for actions that fell within his white house duties while in office. they were expected to ask an appeals court to review the issue; however, bret, smith has gone above the appeals court and now wants the supreme court involved. the special counsel writing it involves issues of exceptional national importance, quote: whether a former president is absolutely immune from federal prosecution for crimes committed while in office or is constitutionally protected from federal prosecution when he has been impeached but not convicted before the criminal proceedings begin. as of now the trial scheduled to begin march 4th with jury selection. that is just one day before super tuesday. smith wants this decision from the high court fast so he can begin the trial and finish the trial before the election next november, bret. >> bret: yeah. david, also next year president biden's son may face two trials in the heat of this election. what's the latest on that tonight? >> well, hunter biden's legal team filed to have the federal gun charges in delaware dropped late this afternoon. his attorney abbe lowell went a step further and said david weiss was illegally appointed special counsel. he said special counsels are supposed to be from outside the government when appointed. weiss also, a u.s. attorney in delaware. local's argument may not hold up because it's happened before, bret. former attorney general bill barr appointed connecticut u.s. attorney john durham to become special counsel. durham held both jobs for a period of time. now we wait to see when hunter biden will be arraigned on tax charges in california, bret. >> bret: we will follow it all. david, thank you. we are not hearing anything from the white house about the most recent developments in the hunter biden case. white house correspondent peter doocy is on the north lawn tonight with the latest. good evening, peter. >> peter: white house republicans believe the white house is holding out on them and when president biden said he never profited from his son's overseas business deals, these lawmakers want him to prove it. >> president biden! >> president biden hasn't said word about his son hunter's latest indictment and his team's responses for republicans looking for records have been unsatisfactory to the house speaker. >> impeachment inquiry is the next necessary step because the white house is now stonewalling our investigation. >> white house officials maintain there is no there there. connecting the president to his son's overseas business dealings. >> he is focused on what matters to american families. not marjorie traylor greene conspiracy theories. >> unclear if he will testify wednesday as his lead attorney accuses the justice department of overcharging. >> what you can say is hunter was late in filing and paying taxes in certain years. that is a given. as are millions and millions of americans who do the same thing. >> peter: president biden raised $15 million for his campaign during a west coast swing telling donors about trump. the other day he said he would be a dictator only on the first day. thank god only one day. the political focus lately has been more on trump than on the economy. as the bureau of labor statistics calculates that most new jobs created under biden are either in healthcare or government. president biden and his team are hoping it's enough to keep unions in key swing states with him. appealing today to pennsylvania firefighters. >> all my friends either became cops, firefighters and priests. here i am. >> peter: yes, here he is hosting volodymyr zelenskyy tomorrow trying to make the case to congress that they need to fund ukraine's military if they want to save democracy. but, because the white house is not playing ball on border funding, that is unlikely to happen before the end of the year. bret? >> bret: we will be speaking with president zelenskyy tomorrow here on "special report." peter, thanks. ♪ ♪ former president trump is beating president biden in another head-to-head national poll. the ages of the two presumptive major party nominees once again becoming an issue. west virginia democratic senator joe manchin made a comment about a possible third party run over the weekend. citing those ages. here is senior national correspondent rich edson. >> facing two federal indictments, the former president of the united states has a warning for the current one. >> they have opened up a pandora's box and i only can say to joe is be very careful what you wish for. >> playing off trump's own words, democrats have warned a second trump term would threaten american democracy. >> i said i want to be a dictator for one day because i want a wall, right? i. a wall, and i want to drill, drill, drill. >> while trump spoke in new york. his g.o.p. rivals campaigned in iowa where the former president has a commanding lead in the polls. "the des moines register" says 51% of likely republican caucus goers choose trump as their first choice. >> florida governor ron desantis 19. former u.n. ambassador nikki haley is at 16. haley touted a different poll. >> how do you get congress to win things if you win by 17 points be that's a pretty good mandate. >> that according to a "wall street journal" national poll showing haley over president biden by 17. trump leads biden in that poll by 4. haley is also securing some major financial support. ken langone, the billionaire co-founder of home depot says he is on board. two weeks ago the coke affiliated americans for prosperity action pledged its support. former secretary of state hillary clinton expected to pitch voters on a second biden term. already forcefully defending the president's israel policy. nbc reports clinton hosted a biden fundraiser last month that raised nearly a million dollars. the president maintains trump would be an authoritarian in his second term saying in a fundraiser last week quote trump is not even hiding the ball anymore. then there are the potential third party candidates. this weekend, retiring democratic senator joe manchin noted that biden and trump are 81 and 77 years old and if voters are ready for them to pass the torch to a new generation. someone closer to 76. big reveal here that's manchin's age. bret? >> bret: just 76 is how old manchin is and he is saying 77 is too old? >> a little tongue in cheek, i think, yeah. >> bret: okay. rich, thanks. today, lawyers for two georgia election workers played audio recordings of graphic and racist threats the women received after rudy giuliani falsely accused them of fraud. >> that trial is underway to determine how much the former trump attorney might have to pay those two women. he has already been found libel in the defamation lawsuit. let's bring in fox news chief political analyst brit hume. brit, good evening. we have just been talking about the former president, his legal issues. and, you know, you look at this calendar versus the calendar of voting, and it is going to come together in all of these different dates. and now you have the supreme court possibly weighing in or at least considering whether to take the case of fast tracking the appeals process. >> brit: yeah, it's been quite a year already, bret. next year is going to be even more intense, i think, with all of this come together. action in the courts on a whole range of fronts. we got the primaries finally starting. i have to say this about the polling that you have been citing regarding trump and his lead over his two chief rivals who are only a fraction of what he commands in the polling, at least. and that is that, you know, something -- it always seemed possible that something could happen and his support would begin to erode. and that one of the other top rifles would start to really gain ground on him. we are getting pretty close to the iowa caucuses now. to be followed immediately by new hampshire and none of that has actually happened. he seems in a stronger position than ever. i think we can look ahead to, you know, it would take something quite remarkable and dramatic now to change the course of this situation. >> bret: yeah. there are polls, there are snapshots in time but "the des moines register" poll this weekend has him exponentially up if you look at the real clear politics average in iowa. take a look 50 rock at new 50 lw hampshire. exponential again over nikki haley and then south carolina her home state and he again has huge leads. to your point, holes are not votes but they do give you an five weeks from tomorrow. >> >> brit: yes. bret, you know in terms of iowa which is first up. i have had people say to me if haley and desantis were to combine forces you add up what they both are holding in the polls we would have a real race but the problem is that polling has indicated that at love desantis support, if he were to drop out of the race, would go to trump. so, you know, it's not even clear that that scenario would unfold in the way that people who are opposed to trump would hope. >> bret: last thing, this is the president over the weekend about abuse of power. taking on this charge by president biden, his administration head on. take a listen. >> every abuse of power, the fake news is ridiculously claiming, being committed by crooked joe and his thugs. they are trying to lock up their political opponents. they want to lock up their political opponents, in particular me, thank you very much. it's an honor. >> you know, he is doing what the former president has done on the stump. how big a deal do you think this is by the time you get to these cases ahead of a convention? [explosion] >> israel is facing more international pressure. accused of reportedly using u.s. provided white phosphorus munitions in an attack that injured civilians in southern lebanon. >> idf and the entire security establishment operate according to international law. >> the u.s. state department calls the report concerning and promises to learn more. >> there is legitimate military use for white phosphorus but that does not include using them on civilians. >> the chief of staff says the country is ready for a full-scale war with hezbollah if needed. griff jenkins thanks. tonight we talk to former wrestler, tyrus. he is the author of the new book "enough said. hey, tyrus, great to see you congrats on the new book. i have read some of it, it's awesome what we saw on capitol hill and how it's being covered. the "new york times" covered it this way. as fury erupts other campus anti-semitism, conservatives seize the moment. the word seize comes up on some of these stories and how it's covered and then you had "saturday night live" big back and forth comedy skit, supposedly comedy, about that hearing. take a listen. >> now, i'm going to start screaming questions at these women like i'm billy eickner. [laughter] anti-semitism yea or nay. i'm sorry, what? >> yes or no, is calling for the genocide of jews against the code of conduct for harvard? >> well it, depends on the context. what? that can't be your answer. >> bret: that's supposed to be congresswoman elise stefanik. what do you make of this and the fallout from it? >> you know, it's -- i watched it the first time and i was just shocked and i'm the first one i don't think there -- i think there is a joke in every situation but it's always timing. kind of makes you just go wow. what was the point? it wasn't funny. it wasn't classy. what that hearing was showed the true face of a lot of so-called progressives and people who supposedly care about everybody. we saw that they only care about their narrative and what is best for them. there is no joke when it comes to anti-semitism. just like there is no joke when it comes to being racist against people of different colors and stuff. so there was no joke in this. if anything, they were trying to make fun of the conservative asking the question and this has nothing to do conservatives seized the day? no, this has nothing to do with politics. this is a human being thing. if you are a brother, a father, a husband, an uncle, anything you saw that happened october 7th should have nothing to do with political believes or how you vote. it is how you feel about fellow humans and seeing people, women and children slaughtered. babies being decapitated. that has nothing to do with politics. that should reach in the core of your stomach and your chest and should drive you insane and you should want retribution for those families and those people that went through that that was a massacre it. has nothing to do with the voting rights. the fact that they are trying to bring that into that and make it about conservatism and liberalism is laughable. that's the only thing funny about the whole thing. there is nothing to laugh about anti-semitism. >> bret: yeah. you mentioned families. and, listen, i have been through some of this book. it's really great like your first one was. i want to ask you about this one chapter. you talk about abusive father and how your mother tried to protect you. you call it sea turtles. the chapter is called sea turtles. and you write if you don't know about sea turtle mothers. they will travel the world until they find the perfect beach perfect sand perfect temperature and perfect environment. she crawls out on to a difficult terrain she is not built to walk upon. she does it. digs a hole deep enough to keep predators away from precious egg. she has set them up for success. exhausted she drags herself back into the water. she will never see what happens to them but she has given them their best chance at a good life. my mother did what she had to do to give us the best chance at a good life. so well-written, tyrus. and have you kind of pour your heart out about your experience. >> tyrus: one of the toughest things and you are so good at this. let me take my glasses off. when i wrote that, it was about sometimes you just can't fix when families break up, sometimes the best thick to do is to let go. and with my particular family, we tried reunions. we tried to put -- but there is some things that you just can't get past. one of the things that my mother struggled with is i look exactly like my father. and it was the face if you read both my books, you know what she went through trying to raise us. sometimes the toughest thing to do is to let somebody go that you love because they are better off without you. you are better off without them. so when i talk about sea turtles, she still prepared me, you know, in the chapter i talk about there is a confrontation with my father where my mother chose to protect me even though having your child say certain things to you in the moment you don't ever want to have to repeat or force them to say, but she was doing it to keep me safe. i have a lot of respect for my mother. i will always love her. our lives are better apart. sometimes we need to focus on everything that was good for your family with you for when it's time to move on you need to move on. if you actually read it, that's not what it means. >> bret: it was really well-written and you said don't be afraid to speak your mind. have you spoken your mind in two great books. congratulations. thanks for coming on. >> thank you for your time, boss. thank you very much. >> bret: up next, the panel with the latest polls in iowa. the activity in the presidential race and all that's going on with the special counsel. that's next. ♪ managers. it is should he be president? i don't think he should be president. >> five weeks to the iowa caucuses and we have a new des moines register poll. they are well respected in iowa and it shows the former president with a big, big lead currently in iowa over governor ron desantis and there you see nikki haley. the other question is here is the view among trump legal challenges. among iowa voters. 73% of republican caucus goers think the former president can beat president biden regardless of his legal challenges. this comes as the special counsel appealed to the supreme court to fast track a possible appeal there. and the supreme court saying we are going to hear whether we are going to fast track that. and whether they are going to take the case. that came in right before the show tonight. let's bring in our panel. fox news senior political analyst juan williams. franco or don't i can't say. correspondent for "national public radio" and mollie hemingway editor and chief at "the federalist." first of all, mollie, the polls are overwhelming. snapshots in time. not actual votes. we have never seen never seen like. this challenge for the anti-trump forces in that both of the top two candidates seeming to be competing for third place in the caucuses and primaries. it's been a pretty stable situation for trump in that he has always had the lead. the way that it's not stable is that his lead is increasing. and so his -- these polls show that his voters were very enthusiastic. they were very loyal. it's very likely he will be the nominee knee. the interesting thing is whether biden will be the nominee. the larger race is looking more and more not like 2016 when trump won but almost like 1980 when people were suffering so much economically where they were not having -- they didn't have enough money and the foreign situation was bad in 1908 with jimmy carter. this is a very interesting race. >> bret: franco, welcome, by the way. >> thank you. >> bret: special counsel jack smith asked the supreme court to rule on whether former president donald trump can be prosecuted on charges relating to his efforts to overturn the 2020 election results. he is filing. seeks to go arend a the appeals court that had initially been expected to handle the case. now the supreme court has weighed in and said they are going to consider that. that's a big deal for the court. because usually they are very respectful of the appellate process. this is probably going to be fast-tracked if you had to guess. >> it's a very significant deal. jack smith really wants to keep this on track in a certain timeline. the trump campaign pushing back. they are asking why do you need to rush this? we are going to see more and it's going to continue to play out. but i mean this battle over the courts is just getting more chaotic and more chaotic. >> i think it will be very interesting to see what happens next unwritten thing trial done before the election. if the appellate process went out, went forward, former president trump could win and this would be all erased. >> pardon himself potentially. jack smith pushed this to the supreme court. he wants the supreme court to rule here. and, obviously, thinks that he will win with the supreme court. and, of course, even if he doesn't win, well then why go through the appellate process. why go through the trial because then, nothing can be charged to a man who says that he is immune from those charges given that he was president of the united states. so, let's get it on and what jack smith is saying let's ring the bell. let's just do this now. >> just because jack smith wants things done quickly doesn't mean the supreme court wants things done quickly he keeps asserting need to get it done quickly. obvious he wants a quick and easy conviction. that's the point of trying to put political opponents in prison. the supreme court doesn't share that viewpoint. they are probably less inclined to get involved. >> bret: to your point here is jonathan turley on that very question. >> he decided that he wanted to leapfrog over the court of appeals and go directly to the supreme court. the only reason for that is that he is really focused entirely on trying trump during this campaign and trying to convict him before the election. the question about the supreme court is going to feel that that is such an you are jeanette priority you bring this case before super tuesday. >> bret: asked for the trump campaign lawyers by next wednesday. i want to turn to hillary clinton. washington examiner. she has emerged as key champion of biden's 2024 campaign recent fundraiser in washington. hosted by clinton and whitehaven estate at her whitehaven estate. the former secretary of state women's leadership forum reportedly pulled in $1 million for biden's re-election. however, a fundraising prowess isn't the only support to biden's election. clinton is stepping up as one of biden's higher profile surrogates. franco, obviously, she doesn't have a super frac record in these national elections but it seems like the biden folks are leaning on the former secretary of state. >> apparently. so that seems to be the reporting. only going to give more enthusiasm to many of biden's detractors. this hillary clinton for trump is kind of in some ways it's red meat. it's a way to, you know, to attack biden and that's what he does so often. i mean, there is a reason that trump used to talk about crooked hillary and switching the name to crooked joe biden very beneficial for the trump chain i'm curious how the imind campaign responds. >> maybe on the abortion issue she makes that case like kamala harris makes it and that's really the issue the democrats feel like is their sweet spot. >> absolutely not only that you look right now and the polls do not look good for biden at this moment. a lot of that has to do with the democratic base. young people, people under 40 and young women lot of opposition on israel. the democratic base that's weak. and hillary clinton is good there. >> bret: really quickly, it doesn't look like all of this funding, the supplemental is going to get done. >> it looks like they thought if they claimed to pretend to care about border security that they might be able to get more funding for ukraine, that doesn't seem to be going over as well. >> bret: again we will talk to president zelenskyy tomorrow here on "special report." we will see. up next, new memorial to america's war dead in europe. we'll bring you there. ♪ ike this learning center...
