evan beta's is outside the federal courthouse in delaware for us. evan court just took a break for lunch what more have we learned from hallie biden's testimony well, bars we saw juror are some jurors who rarely take notes, taking very, very, a lot of notes during hallie biden's testimony. >> i mean, she is the prosecution's star witness. and as you pointed out she is the only witness so far and path possibly in this entire trial, who will be able to say she believed hunter biden was using drugs in the month of october of 2018, who bought the firearm on october 12 of 2018? that's when prosecutors say that new he was struggling with drug addiction and knew that he didn't have didn't qualify to be able to buy that and that's reason why he's on trial here today. she found a firearm on october 23rd, and what she testified is that she believed that he was using drugs around the 22nd or the 23rd? under cross-examination, as you pointed out, she did say that she didn't actually witness it, but she believed based on his on his on his behavior, that he was using drugs. now the importance of this is this the defense is trying to drive home the point that prosecution has him using drugs in september and in november but during this key period before he bought the firearm they don't have any proof that he actually was using drugs. and what they're trying to do is to drive a little bit of distance and perhaps a little bit of his frame of mind from that period to have the jury doubt whether he knew he was breaking the law when he bought this fire alarm. she was very embarrassed. she said about her draw her drug use and you could see that this is a very emotional part of this, of this trial, emotional part of this testimony. hunter biden was looking straight ahead, looking at her periods during her during her testimony, boys and evan before we heard from her, we heard from this gun store employee, who sold hunter biden the gun what did jurors hear from him well, the importance of this gun store employees for you as he was there when hunter biden was filling out the form, the atf form 4473, where he attested that he was not an addict, was not somebody who is addicted to drugs drugs and what what we what we had today was to defense tried to shake him a little bit off his story and he didn't really budge very much. what the defense is i'm trying to do is to is to try to get to some of the discrepancies in that handling of that atf form. we know we know that there is a second version of that form that exists that the judge ruled could not be shown in court. the jury does not know about it, and so he was trying to see if he could get that gun store employees 42 at least open the way for him to talk about it? the gun store employee did not really budge and we will see whether this is something that a hunter biden's team will be able to use in a possible appeal should he be convicted. >> bores evan perez live from outside the courthouse in wilmington, delaware. >> evan, thank you so much. let's discuss these developments with former federal prosecutor, renato mariotti. we're not thanks so much for being with us this afternoon. let's start in chronological order. this gun store owner, the defense, tried to focus on two things during the cross-examination. one of them was how quickly he wanted this sale processed. and then the second was some of the details in the actual form. the questionnaire that a hunter biden signed. what's the significance of those aspects of the cross-examination prosecution has to prove beyond a reasonable doubt that hunter biden knowingly and willfully made a false statement on that form, and essentially, what the defense is trying to do is essentially suggests he was hurried through that. >> this is not a considered decision on his part. he was just the acting checking a box because as you alluded to earlier, boris is his testimony is essentially or his story is gonna be as defense is that he he was on a rehab program is coming out of rehab programs. so we thought of himself as sober that period of time. so this was not considered and really tried to give the jury some of the context so they understand this was not a very well thought out decision on his part, and therefore, not willful so hallie biden is testimony about her own use of crack was a stunning moment. >> the prosecution obviously wants to highlight her saying that she found remnants of crack alongside big gun in a hunter's car. that offense actually wants to muddy the waters. they want to highlight her own drug use to argue that some of the cocaine remnants that were discovered by investigators may not have been hunters. who do you think has the strongest argument there? >> well, look, this is obviously there's an uphill battle for the defense on this point generally. >> but i think what the defense is trying to do here is partly to call into question our her testimony. >> i mean, the fact that she was on drugs also could potentially impact your perception? the events at that time but the defense, as we discussed, and i think you discussed a moment ago what evan is really focused on trying to say, look, maybe he was using drugs the month prior. maybe you as using drunk some a month afterwards, but this was his state of mind during that month. so i think it does it's an effective point. but really the jury's not going to be swayed unless they just feel bad for hunter and think that the prosecution is wrong-headed in some in some fashion, the prosecution is expected to wrap up their case today. do you think that they've proven beyond a reasonable doubt that hunter is guilty? >> i think they have a strong case. i mean, i think there's a lot of questions here about why this case is broad and so on. this is a very unusual case i do think there's very, very substantial appellate issues. the statutes been called into question, the constitutionality of it, and so on there's an i meant that there was already a deal but i think in terms of the jury verdict, the defense is an uphill battle here and they're really hoping to get a hung jury we're not on my reality. >> appreciate your perspective on the case. thanks so much. briana the white house is continuing to push for an end to the israel-hamas war. >> and american official says the united states and 60 teen other countries whose citizens were taken hostage by hamas on october 7 are set to release a joint statement today to try to get a hostage release and ceasefire deal over the line. the president outlined a proposal last week, he characterized it as an israeli proposal, but hamas now says the plan that it received differs from what biden presented and it falls short of their demands in the meantime, the crisis in gaza continues to deepen the un is now warning half of gaza's population is expected to face death and starvation by mid-july, cnn's jeremy diamond is following the latest developments live force from jerusalem. and jeremy, there's also been an airstrike in gaza that killed more than 40. what are the latest details on that? >> yeah, that's right, briana, it's been a very deadly week in central gaza as the israeli military has clearly been stepping up, its airstrikes in that area late last night overnight. actually, i should say in the early hours of this morning thank israeli airstrike hit a un school and unrwa school that was effectively converted into a makeshift shelter for thousands of displaced palestinian and the israeli military says that it was targeting 20 to 30 militants who they say, were onsite sheltering there and planning attacks against israeli troops in an israeli military spokesman, colonel peter learners saying that he was not aware of any civilian casualties. but the reality of images that we've seen of the bodies coming out of that strike and the records from a luxe martyrs hospital in that area indicate that a majority of the 40 people who were killed in this strike were indeed women and children, and nine women and 14 children with the youngest being just for years old. this is obviously not the first time that we have seen the israeli military strikes in this area causing civilian casualties, just a couple of weeks next ago, actually, the israeli military use the same types of munitions that it used in this strike. the gbu-39 small-diameter bomb fragments were found at the scene of this strike. those are the same munitions that they use in that deadly strike in rafah on another camp for displaced palestinians that killed 45 people. the united nations relief agency in gaza, the main agency in gaza saying that this area was sheltering 6,000 people and saying that targeting un premises or using them for military purposes to work together to make sure we protect democracy 80 years after normandy i think that's such a key part of what today means this was really the beginning of america as a superpower. this was the beginning of a world order that americans have so benefited from for the last eight decades. it seems like a lot of people have forgotten that. >> how do you drive that message home? >> and get them to recognize? you know, where this comes from. this sort of as much as some people will complain about how things are. there are a lot of wonderful things out there for americans. how do you get them to recognize that? >> i think it's important for our leaders to continue to remind the american people about the sacrifices that were made i know that we have a tendency to forget what happened in the past. and only you think about the present but the reality is that there is an important legacy here. the legacy stretches from franklin roosevelt to joe biden almost every president has committed this country trying to protect our freedom. so i mean, i think, i think it's important to remember that ronald reagan spoke at the 40th anniversary of de d-day and at that time he talked about learning the lessons of war, and not forgetting the lessons of war understanding that we can't be isolationists, that we have to work with our allies any ended that speech by saying, your hopes are our hopes and your destiny is our destiny that's a republican president i think we have to remind ourselves that it is important not to forget what happened at normandy because we need that strength. we need that courage today as we confront the adversaries of the present and speaking of that, we saw ukrainian president zelenskyy he was there today. he got a lot of attention for good reason. many people see parallels in the ukraine war to the conflict that was fought in world war ii. how do you see that parallel? >> well, i don't think there's any question. i mean, i i frankly i was a young boy and world war ii, i think it was about 6-years-old when normandy happened but i never thought that i would see in my lifetime another tyrant trying to invade a sovereign democracy. for no other reason, but that he does not believe the people of that country have the right to decide how to govern themselves so putin's invasion of ukraine is very much a wake-up call that democracy is still under threat in this world. under threat from tyrants like putin and others and under threat if we are not willing to come together, to pull together a strong alliance of united states and other countries to defend democracy. that's, that's the main message today, is that we cannot allow tyrants to succeed we cannot allow democracy to be lost because we fail to stand up, work together, fight months behind bars, but said he could stay free pending an appeal of his conviction while they discussed that appeal in the hearing today, and the judge said, look, the appeals court wholeheartedly disagreed with the legal arguments abandoned and his team are making he said he was not you put off his sentence. any longer and he said it's time for steve bannon to report to prison. and there was a seconds, less than 30 seconds, it's taking place nearly 15 hours after its successful launch from cape canaveral yesterday. and after nasa discovered two additional helium leaks during the voyage, late last night with us as we await this milestone, cnn space and defense correspondent kristin fisher and retired nasa astronaut leroy wow kristen first talked to us about what's actually happening right now seconds away from this doc. >> yeah, they've actually extended it to just about a few minutes because they want to make sure the light is right. >> so what you have is boeing's starliner spacecraft, that's that capsule that the astronauts that we watched launched yesterday have been inside for the last 24 hours or so. >> and what it is doing, it is it is slowly approaching the international space station and they're going to dock. but this is the first time they have ever done that with a crew on board. and of course you have astronauts and cosmonauts aboard the international space station. and so what they want to do is take it very slowly and they want to wait until there's actual sunlight on the boeing starliner spacecraft right now, they're in a period of darkness nighttime in space. so they're waiting just a few more minutes until they get that sunlight there now on the final approach, and they've been troubleshooting these pesky rcs thrusters as they're called the things that kind of propel the spacecraft do those last-minute final adjustments, but they think they've walked they've worked through those issues and we're now just minutes away, nine meters away, as well, pointers five centimeters at a go. it's going to still be a second here. i also prefer driving during the day to driving at night, so that makes complete sense to me. we're watching every little thing with this, right? so we're watching those thrusters. this was a slight delay compared to what it was supposed to docx, but also these little helium leaks. what's going on here? >> yes. so we knew there was a helium leak before launch. nasa and boeing was aware of it and they said, hey, you know what we think it is within our parameters that it's still safe to fly so we knew there was going to be one. but once the spacecraft got into orbit, they found two more. last night before nasa astronauts, butch wilmore and sunny williams went to sleep they made them do all these things to kind of shut down some of these thrusters to stop the leak. and they troubleshoot it overnight and decided that they were okay and go for this docking today. so it could have been more serious but turned out not to be. and so now they're just troubleshooting these final things. it's a first test flight. these things do happen, but here it's nice they're serious issue we just got word from the feed. we're now roughly like a minute, 30 from docking. >> leroy as we're watching this unfold, take us inside the minds of these astronauts about to accomplish something historic oh, absolutely. butch and sandi are constantly professionals. they're very laser focused on the task at hand. docking is one of those critical maneuvers. and so they're watching, their instruments there. they've got their check checklist sound and they are just monitoring the situation monitoring the automatic situation poised to take manual control if necessary and again, they're delayed just a little bit just to wait for optimal lighting conditions that a big deal tell us what we're looking at here. are you able to see the picture is we're looking at the capsule moving towards the space station yes so i have an image of the capsule as it's approaching. so as you pointed out, very slowly approaching, very slowly or not at all, like, the movies. you don't come whizzing in and dock. it takes that takes a bit of time. >> you've got to be got to be slow and deliberate anyway, by the, by the way, i mean, i'm very familiar with this process on my mission in the russian soyuz capsule, we had an emergency during docking and we had to execute a manual night docking so we didn't wait for the lighting conditions, but we were look at that, i think at docked is this is this a success? yeah it's looking like it, right? >> yeah all right. >> i believe so. let's huge deal it's so close. >> it's 0.5 meters away. i mean, it should be docking. let's go ahead and listen into the nasa feed right now it's tough to. >> hear but we're waiting with bated breath for confirmation that they've dog it was it was slow and it was tedious, but it appears to have been successful. so leroy put this docking into context for us, what it means for the bigger picture of space travel well, what it means is that if they've successfully docked and it seems like they have awaiting that confirmation, as you said, but that means that we now have a second path to launching nasa astronauts to and from the iss course spacex has been doing it for nearly three years. >> we one nasa likes redundancy. astronauts like redundancy all engineers do and so this would mean we have a second path without having to go back to relying on the russians. and their soyuz vehicle so this is a historic moment. butch and sunny, i'm sure they're going through their procedures, but they're also thrilled to but to be attached to the iss. >> yeah. not the least, because that's not a giant capsule. the ran, right. i'm sure they're looking forward to stretching their legs oh yeah yeah. no, it's not a not a big capsule by any means space show by comparison was a palace, right? >> i mean, we could have seven astronauts with our seats deployed and still be very much in more of a business class type of seating arrangement but then the less these vehicles are very capable and they do there the job well. and hopefully everything else will continue to go relatively smoothly for this flight test absolutely. >> kristen, what happens next? >> well, what happens next is these astronauts are going to spend about eight days up at the international space station. but in addition to them bringing themselves and this new spacecraft, they've also brought a new replacement pump to fix the machine that recycles, get this the astronaut urine and turns it into drinking water. it's been direction for a few days now. >> so as you can imagine, there have quite literally been bad next, if urine piling up at the international space station secured but limited space. >> and so right now, inside that boeing's starliner spacecraft is a replay placement pump for that urine recycling system. >> a critical piece of infrastructure that's needed unworthy question so a critical mission, my gosh i'm sure the crew there was excited to see sunny in bucha anyways, but they're gonna get like a hero's welcome
