Tennessee lawmaker backs down from measure banning local challenges of state law constitutionality

A Tennessee lawmaker s attempt to bar local authorities from filing constitutional challenges over state law has failed for the year.
The proposal, spearheaded by Sen. Brian Kelsey, R-Germantown, has been watered down and passed the Senate 17-10 on Wednesday following bipartisan concerns from his colleagues the bill could restrict local governments authority to hold the state accountable.
The House matched with the Senate version Wednesday night and passed the bill 71-21. The bill is pending Gov. Bill Lee s signature.
The language barring local constitutional challenges was removed from Kelsey s original proposal. Under the previous language, local authorities would have been barred from suing the state in court or funding similar lawsuits over a state law s constitutionality. Tennessee legislators passed a $42.6 billion budget Thursday, one that s heavy on one-time spending and capital projects as a way to put to use surplus revenue.
Republican legislative leaders tout the budget bill as a conservative spending plan strategically using the state s surplus of cash toward projects that will continue to create jobs in future years. But some Democrats said the state did not prioritize enough additional ongoing funding to aid schools and struggling families.

Nathan Bedford Forrest bust: Tennessee gets OK to remove from Capitol


Gov. Bill Lee now has permission to remove from the Tennessee state Capitol the bust of Confederate Gen. Nathan Bedford Forrest, a process he has pursued much of the last year despite resistance from the legislature, which continues to push back against the statue s relocation.
 25 to 1 in favor of relocating the Forrest bust to the Tennessee State Museum, the alternative venue for a monument to the early Ku Klux Klan leader that members of the African American community and anti-racist advocates have sought for years.
The meeting lasted more than five hours as commissioners heard testimony from 30 speakers, the vast majority of them in favor of relocating the bust. Historians, pastors, activists and other interested citizens were among those who remained on the line of the virtual meeting for hours waiting to speak, as they have during past meetings of the Capitol and Historical commissions. ....
