Aunt challenges appointment of doctor nephew as estate executor of family matron who died under guardianship

HOUSTON - The adult grandson of a deceased 90-year-old Texas woman was appointed as independent executor of her estate following a lawsuit filed against the recused Harris County Probate Judge who had disqualified his mother from serving in the position, a press release states.
Judge Jason Cox, a Democrat, appointed Dr. Roy Lester Collins independent executor of the estate of Mrs. Hattie Owens after a hearing in which Dr. Collins’ cousin Aisha Ross, aunt Angelia Owens Sapp and uncle Mel Owens challenged his suitability, according to a press release.
“No bond or other security is required and that upon the taking and filing of the oath required by law, Letters of Testamentary shall issue to Dr. Roy Lester Collins, the IV, and that no other action be had in this court other than the return of an inventory appraisement and list of claims as required by law and notice pursuant to Texas state s code chapter 308,” wrote Judge ....

HOUSTON - The Houston-area probate judge accused of estate trafficking and racketeering is disputing the allegations of a Texas physician who sued in federal court after her 91-year-old mother Hattie Owens died under court-appointed guardianship, a press release states.
As previously reported in the SE Texas Record, Dr. Sheila Owens Collins sued Harris County Probate Judge Michael Newman, individually and in his official capacity in the U.S. District Court for the Southern District of Texas on Oct. 22, 2020.
“Judge Newman is entitled to judicial immunity on all of Plaintiff’s claims against him, wrote Attorney Rachel Fraser in Judge Newman’s Feb. 19 Motion to Dismiss. Judge Newman seeks a judgment that Plaintiff takes nothing against him.” ....

AUSTIN - A U.S. Magistrate issued a report recommending that Austin-based federal judge Lee Yeakel dismiss a pediatrician s lawsuit against Adult Protective Services, concerning her elderly mother who died under court-appointed guardianship.
Dr. Sheila Owens Collins sued the Texas Department of Family and Protective Services (TDFPS), her niece Aisha Ross, and Adult Protective Services (APS) Executive Director Jaimie Masters in the Texas Western District Court, accusing the state agency of violating the U.S. Constitution under 42 U.S.C. § 1985 and 42 U.S.C. § 1983.
“TDFPS argues that Plaintiff’s constitutional claims under § 1983 are barred by sovereign immunity,” wrote U.S. Magistrate Judge Susan Hightower in her Feb. 9 Report and Recommendation. “The Court agrees.” ....

HOUSTON - The Honorable Judge Michael Newman turned a blind eye to the alleged estate trafficking and elder abuse of a 91-year-old woman who was under a court-appointed guardianship when she died, according to an amended complaint submitted by her physician daughter.
“The temporary guardian [Dana Drexler] stated publicly that her goal was not to return Hattie Owens to her home as promised but to put her in a nursing facility and sell her house with attached attorney fees,” stated Dr. Sheila Owens Collins in her revised Feb. 5 lawsuit. “Judge Newman aided and abetted this scheme by approval of excessive fees and fees that were for personal use by the temporary guardian.” ....
