Biden administration says Oklahoma AG wrong about Bosse jurisdiction

Oklahoman
The Biden administration says Oklahoma Attorney General Mike Hunter is wrong to contend the state still has jurisdiction over crimes committed by non-Native Americans against Native Americans on reservations.
In a U.S. Supreme Court case involving Oklahoma death row inmate Shaun Michael Bosse, the Justice Department told the court that “no basis exists to reverse the long-held understanding of the division of federal, state, and tribal jurisdiction in Indian country, which generally governs throughout the Nation.
“To the contrary, on a number of occasions over many decades, this Court has reaffirmed the established rule that a State does not have jurisdiction over offenses by non-Indians against Indians in Indian country.” ....

'We're Not Going To Give Up Our Jurisdiction': Chickasaw Nation Gov. Anoatubby On McGirt Fallout

Chickasaw Nation Governor Bill Anoatubby
We ve been operating, since I came to work for the Nation, as though we have boundaries, Chickasaw Nation Governor Bill Anoatubby said while talking about the recent Oklahoma Court of Criminal Appeals decision that affirmed what he already knew: the Chickasaw Nation s reservation boundaries were never disestablished.
Anoatubby has been the leader of the Chickasaw Nation since 1987 and is often referred to as one of the most powerful people in Indian Country.
The leader of the Tribal Nation remembers a time when their operating budget was only a little more than $1 million, and most of that money came from the federal government. Today, the Chickasaw Nation boasts more than $500 million in annual revenue with multiple businesses and a state of the art medical facility. ....

McGirt ruling results in two more Oklahoma death row reversals

Oklahoman
An Oklahoma death row inmate who was just weeks away from execution in 2015 for killing his infant daughter had his conviction reversed Thursday because the child was a Cherokee and the crime occurred on the tribe’s reservation.
Benjamin Robert Cole was one of two death row inmates whose convictions were overturned as the Oklahoma Court of Criminal Appeals continued to apply last year’s U.S. Supreme Court decision in the McGirt case. James Chandler Ryder, sentenced to death for one of two murders he committed in 1999, also had his convictions overturned.
Four death row inmates have received reversals since the high court issued its ruling in the McGirt case, which has led most of eastern Oklahoma and some central Oklahoma counties to be deemed Indian Country for the purposes of criminal prosecutions. ....
