The Town of Peterborough denied all claims alleged by Walden Eco Village landlord Akhil Garland after it became a third-party defendant in the ongoing lawsuit between Garland and former Eco Village tenants, according to court documents filed at the end of March.
Garland’s representatives alleged that the town knew and supported the activities on the Eco Village site and was therefore responsible for the damages claimed by the former tenants, who were evicted on five days’ notice in December 2020 after the town found safety and code violations on site, including missing building permits for eight of 15 total rental units. The Court agreed to add the town to the ongoing case on March 26. Peterborough’s lawyer, John Ratigan, declined to comment on the suit. ....

The proposed 26-home subdivision on the former site of the Walden Eco Village in Peterborough was met with a considerable amount of public opposition at a Planning Board meeting on Monday. It was the first opportunity for public comment on the formal proposal.
Applicant Akhil Garland first described his plan to subdivide the Walden Eco Village in July 2020, at which point 25 tenants were renting the seven cottages and nine tiny houses, or casitas, on site. The 52-acre property is accessed via Garland Way off Middle Hancock Road in Peterborough’s rural district. The project’s application process led town staff to discover that 15 structures on the property lacked required permits, including all the casitas. Town officials observed hazardous electrical and gas configurations during a December site visit associated with the application, which caused the town to evict the site’s 25 tenants on Dec. 16. Emergency relief will not be granted to the former tenants of Peterborough’s Walden Eco Village, a judge ruled last week, but the longer-term class action suit continues.
Thirteen former tenants signed a class action lawsuit at the end of December against Akhil Garland, his business Utopia Living LLC, and the Garland Family Land Trust, of which Garland is a trustee. They sought emergency relief in the form of speedy returns of security deposits, costs associated with moving and emergency housing, and assistance in finding new rental housing at a hearing on Jan. 7.
The suit came after the Town of Peterborough issued a cease and desist order to Garland on Dec. 11, which called for the eviction of the property’s 25 tenants by Dec. 16. Peterborough issued the order after discovering safety hazards within the property’s 15 rental units during an inspection prompted by Garland’s proposal to subdivide and ....

PETERBOROUGH, N.H. (AP) Former tenants of a New Hampshire community of tiny houses are suing their landlord, alleging that the property owner breached their leases by charging them to live in homes that were not up to code.
Nearly 25 former tenants of the Walden Eco-Village were given less than a week to vacate their homes after a Peterborough code enforcement officer cited violations that included electrical and propane heating systems that failed to meet code, New Hampshire Public Radio reported.
