[email protected] The Ward County State’s Attorney’s Office is appealing the dismissal of a Class A felony gross sexual imposition charge against Donald James Dean Mitchell, 21, by North Central District court Judge Doug Mattson. According to court documents, Mattson dismissed the case without prejudice in October 2020 after finding that there wasn’t probable cause for the case to move forward. The judge found that the officer who testified did not have first-hand knowledge of the event and had failed to identify the ages of Mitchell or the girl. The testifying officer had to review a police affidavit to determine Mitchell’s age and had testified that the girl might have been 15 or 16 when she was actually 14 at the time of the alleged crime on Dec. 1, 2018. [email protected] The Ward County State’s Attorney’s Office filed to dismiss a Class B felony armed robbery charge against Larry Dominique McLean, 29, of New Town, after it learned that he died on Jan. 28. McLean and his co-defendant, Tyquan Markeez Graham, 22, were both accused of robbing a man in the Sports on Tap parking lot in the early morning hours of July 26, 2020. McLean allegedly placed the victim in a chokehold from behind while Graham stole a firearm from the man’s vehicle. The two men then drove off in their vehicle. About an hour later, Graham was involved in a shooting incident in downtown Minot. Graham was shot and wounded in his right arm and hand. His alleged assailant, William Neal Lucy II, allegedly pistol-whipped Graham and shot him before Lucy himself was wounded. Lucy was charged in connection with the shooting and also with intent to deliver ecstasy and cocaine and is in custody at the Ward County Jail. ....
