ajohnson@minotdailynews.com The Ward County State’s Attorney’s Office is appealing the dismissal of a Class A felony gross sexual imposition charge against Donald James Dean Mitchell, 21, by North Central District court Judge Doug Mattson. According to court documents, Mattson dismissed the case without prejudice in October 2020 after finding that there wasn’t probable cause for the case to move forward. The judge found that the officer who testified did not have first-hand knowledge of the event and had failed to identify the ages of Mitchell or the girl. The testifying officer had to review a police affidavit to determine Mitchell’s age and had testified that the girl might have been 15 or 16 when she was actually 14 at the time of the alleged crime on Dec. 1, 2018. Mitchell was 19 at the time.

Richard Ditmars, Minot, charged with possession of child porn, promoting sexual performance by a child | News, Sports, Jobs

ajohnson@minotdailynews.com Richard Owen Ditmars, 47, Minot, is charged in district court in Minot with 10 counts of Class C felony possession of child pornography and one count of Class B felony promotion of a sexual performance by a minor child, according to Minot police. According to a probable cause affidavit filed with the court, Ditmars had illegal images and videos on his phone and had allegedly emailed some of the images to a Yahoo account in January. The arrest came after an investigation by the Minot Police Department and North Dakota Bureau of Criminal Investigation. Both agencies are members of the Internet Crimes Against Children Task Force, a national network of 61 coordinated task forces representing more than 4,500 federal, state, and local law enforcement and prosecutorial agencies.
