Third defendant ordered to trial in Stewart Road shooting
After a brief fifth day of a preliminary examination Monday, a judge has determined that there was enough testimony and evidence to send a third defendant in the Stewart Road shooting to a higher court to face trial.
First District Judge Michael C. Brown made the decision after hearing testimony from several witnesses including three detectives from the Monroe County Sheriff s Office who testified that a phone linked to the third defendant was at the intersection of Stewart and Telegraph at the time of the shooting. His fingerprints also were found on a box of cigarettes that were recovered from the suspect s car.
After four days of testimony, a judge this week determined enough evidence existed to send two defendants in the Stewart Road shooting to a higher court and face trial.
First District Judge Michael C. Brown made the decision following a lengthy preliminary examination that saw prosecutors call several witnesses, including Monroe County sheriff s detectives who provided evidence that linked at least one suspect to the scene.
Two defendants charged of spraying a carload of young women and children with bullets will be arraigned in circuit court May 7. They are Kelvin Harris, 28, who faces numerous felony charges including six counts of assault with intent to murder, and Austin Watkins, 26, who was charged with conspiracy to commit assault with intent to murder.
Telegraph Road shooting victim testifies from hospital room
When shots rang out Feb. 1, Alexandria (Baby Girl) Alamo-Cruz, 18, didn’t think they were directed at her car until, as she described in a court hearing Wednesday afternoon, she was face-to-face with a defendant, Kelvin Harris, also known as 40.
Alamo-Cruz was struck several times in the shooting, including in the head, that occurred on Stewart Road that night. She still has bullet fragments in her brain and paralysis in her right arm, according to her testimony taken from a hospital room. She is receiving speech therapy every day and physical therapy for her arm.
