北京一公司开设空壳公司，虚构劳动关系，为36名不具备参保条件的孕产妇骗取生育津贴98万余元。7月14日，北京市朝阳区人民法院对该案作出一审宣判，宋某等8人构成诈骗罪获刑。
“希望该案给企业和个人以警示，社保代缴背后的法律风险不可忽视。”该案主审法官说。
李某是其中一名孕产妇。“我没有在成蹊公司入职，只是和该公司签订了一个假的劳动合同，由他们公司代缴社保金。”每个月李某通过微信给成蹊公司转账1600 元，这部分钱包括社保金和给该公司的服务费。孩子出生后，她通过成蹊公司领取了约2.3万元生育津贴。
警方调查发现，成蹊公司的法定代表人宋某同时也是北京磐博企业管理有限公司（下称“磐博公司”）的法定代表人。成蹊公司没有实际办公地址和业务� ....
