KMSS moves SC against rejection of Akhil Gogoi's bail plea | Guwahati News

GUWAHATI: Krishak Mukti Sangram Samiti (KMSS) has filed a petition before the Supreme Court, challenging the Gauhati High Court order which rejected the bail plea of the peasants’ body chief Akhil Gogoi.
“After a prolonged hearing, the honourable Gauhati High Court rejected the bail plea of Gogoi. Thereafter, we had decided to move the Supreme Court challenging the order and accordingly we filed a petition on January 27,” advocate Shantanu Borthakur said.
However, no date has been fixed for hearing by the court as of now.
The high court, while rejecting the bail plea, observed that Gogoi had sent 15 members of his organization to camps to get them trained like Maoists. The court also said there were monetary transactions between Gogoi and the CPI (Maoist). ....

GUWAHATI: The Guwahati high court, while rejecting the bail plea of peasant leader Akhil Gogoi on Thursday, upheld the verdict of a special NIA court and ruled that the anti-CAA protests in the state led by him in 2019 were not in line of non-violent “satyagraha” but “squarely falls within the definition of terrorist act as defined in in Unlawful Activities (Prevention) Act.”
A division bench comprising Justice Kalyan Rai Surana and Justice Ajit Bathakur in its order stated, “By use of violence, the appellant (Akhil)-led mob had brushed aside the noble concept of non-violent protest, which is popularly known as satyagraha and that such conduct of paralyzing the government machinery, causing economic blockade, causing enmity between groups, disruption of public peace an widespread disharmony and dissatisfaction towards the government, are acts which are prejudicial/for national integration and such acts squarely falls within the definition of “terrorist act” as d ....

GUWAHATI: The Gauhati High Court on Thursday rejected the bail plea of Krishak Mukti Sangram Samiti (KMSS) chief Akhil Gogoi after it found monetary transactions between CPI (Maoist) and the peasants’ leader. Gogoi has been in jail since December 2019 over alleged Maoist links.
Hearing the plea registered by the National Investigation Agency (NIA), the bench of justice Kalyan Rai Surana and justice Ajit Borthakur observed that Gogoi had sent 15 male and female members of his organization to CPI (Maoist) camps to get trained. ....

HC rejects bail petition of KMSS leader Akhil Gogoi in violent CAA protests

Thursday rejected the bail petition of Krishak Mukti Sangram Parishad (KMSS) and Raijor Dal leader Akhil Gogoi in the case related to his alleged role in violent protests against Citizenship (Amendemnt) Act lodged by the NIA.
A division bench of the High Court comprising Justices Kalyan Rai Surana and Ajit Bathakur rejected the bail petition of Akhil Gogoi.
Gogoi is lodged in Guwahati Central jail since his arrest in December 2019 for his alleged role in violent anti- Citizenship Amendment Act protests.
He was arrested on December 12, 2019 as a preventive measure while protests against the CAA in the state raged and resulted in violence at several places. ....
