NIA will seek legal opinion on the court ruling and is expected to challenge Gogoi’s discharge before the Guwahati high court on Friday. “We are examining the order and will file a review before the high court. Gogoi was not in jail but in hospital for the last few months,” said a senior government official in New Delhi.

Assam MLA Akhil Gogoi on Thursday walked free after 19 months’ captivity, as a special NIA court cleared him of all charges under UAPA for his alleged role in the anti-CAA stir in December 2019. The National Investigative Agency, however, said it would appeal against the court’s decision to not frame charges.
GUWAHATI: Nearly 19 months after being arrested for allegedly inciting violence during the anti-CAA agitation, Assam activist and newly-elected MLA Akhil Gogoi walked out of judicial custody on Thursday after a special NIA court acquitted him of all charges under the Unlawful Activities (Prevention) Act. This was the last pending NIA case against him.
The special court said there wasn’t enough evidence to hold Gogoi guilty of any act of terrorism under the legislation invoked in the case registered against him in 2019.
On June 22, the court had cleared Gogoi of all charges under the UAPA, in a similar case filed against him at Chabua police station. Gogoi’s aides Manas Konwar, Dhajya Konwar and Bittu Sonowal were also acquitted.
