The Warrens travelled to Auckland to collect the vehicle, but upon their arrival, they discovered the obscenity scratched into the paintwork.
Warren asked Roselea Holdings Ltd for a full refund as the car was not in the condition he was told it was in.
However, the company refused to pay the full amount, saying it was holding $2000 as compensation for lost profit, inconvenience and reselling the vehicle.
Warren went to the Motor Vehicle Disputes Tribunal, which has ordered the company to refund the $2000.
The tribunal heard Warren saw the car advertised on Trade Me. Before purchasing it, he spoke with Brendan Mulligan from Roslea Holdings. ....

The North Shore resident said on Thursday he has filed appeal papers in the Auckland District Court to re-seek compensation.
At the tribunal, the company argued the Panamera could be legally be referred to as a 2015 model as that was when it was first registered.
The tribunal found the company was technically correct, but had still misled Han and breached the Fair Trading Act.

However, it ruled Han was not eligible for compensation as he had not been able to prove he had suffered loss, the tribunal said. ....

A man who spent $47,500 on Porsche advertised as a newer model than it actually was has lost his bid to get a refund.
Wen Han purchased a Porsche Panamera from dealer Sunday Ltd in October 2020 and then attempted to return it after discovering the car represented as 2015 model was actually manufactured in 2012.
Han was forced to take the matter to the Motor Vehicle Disputes Tribunal after failing to get a refund from the dealer.
Han said that the Trade Me listing for the vehicle described it as a 2015 Porsche Panamera, and the vehicle offer and sale agreement and Consumer Information Notice described it having a vehicle year of 2015. ....

Some cars damaged in car crashes can be repaired, reregistered and resold, but motor dealers must tell buyers the true history of what they are buying.
A legal challenge to the duty of used car dealers to tell potential buyers when a car is a former insurance write-off has been abandoned.
In October​, Taieri Motor Court​ in Dunedin was ordered to pay a buyer $5000​ by the Motor Vehicle Disputes Tribunal after failing to tell buyer Mark Thorn​ that a car it sold him had previously been written off for insurance purposes, and then repaired and re-registered.
Tribunal adjudicator Jason McHerron​ said a reasonable buyer would expect to be told if a car was an insurance write-off, and that by failing to do tell Thorn, the company had breached the Fair Trading Act​. ....
