Parliament had passed an Act in 2019 titled ‘Consumer Protection Act’ with an aim , generally speaking, to protect the interests of the consumer and to have a legal and proper mechanism to settle consumers’ disputes . Though the Act had already been passed in 1986 but to give more teeth to it , it was made more effective and stringent in 2019. Since the Act has become applicable to the UT of Jammu and Kashmir following Reorganisation of the State with effect from October 2019, so far no headway has been made in respect of establishment of District Consumer Disputes Redressal Commissions in the UT of Jammu and Kashmir . The notable thing is that for appointing of Presidents of these Commissions steps were taken only in early April this year when for 10 districts of the UT, applications were invited. However, very poor response to the notice for inviting applications led the Government further extend the date of submission to May 15. A ....

Senate passes budget
On Friday, the Senate gave final approval to the $7.17 billion FY 2022 budget, H.439. Senate Appropriations Chair Jane Kitchel, D-Caledonia, called it “as complicated a budget as I’ve ever had to put together in my time in the Senate” due to the flood of federal aid to Vermont for coronavirus relief and an unexpected $211 million revenue surplus.
The bill spends $478.5 million in federal American Rescue Plan Act funds, while incorporating only a portion of Gov. Scott’s ARPA spending proposal. Kitchel said the governor’s plan did not focus enough on the legislature’s funding priorities, including service delivery structure, court re-opening and higher education needs. Scott had asked the legislature to place all of the ARPA expenditures in a separate bill. Kitchel rejected that request, instead placing all ARPA spending in one designated section of the budget bill. ....

JAMMU, May 4: Establishment of District Consumer Disputes Redressal Commissions in the Union Territory of Jammu and Kashmir will get delayed as the Government has received poor response to the notice inviting applications for the posts of Presidents within the specified time-frame.
Due to this, vital provision of the Consumer Protection Act passed by the Parliament in the year 2019 will remain unimplemented for the unspecified time-frame and consumers will remain deprived of a proper forum for redressal of their grievances. ....

Consumer Protection Act: impact of change in forum on pending proceedings and retrospectivity

In its 16 March 2021 judgment in
Neena Aneja v Jai Prakash Associates Ltd (Civil Appeal 3766-3767 of 2020), the Division Bench of the Supreme Court dealt with the issue of:
[w]hether a complaint which was filed and registered under the Act of 1986, before the new [Consumer Protection]
Act of 2019 came into force, has to be entertained under the provisions of the erstwhile legislation[.]
Facts
Said issue arose from a complaint (for claims of Rs21.9 million) which had been filed by the appellant before the National Consumer Dispute Redressal Commission on 18 June 2020. In an order dated 30 July 2020, the commission dismissed the complaint on the ground that following the enactment of the Consumer Protection Act 2019 (which took effect from 20 July 2020), its pecuniary jurisdiction has been enhanced from rupees one crore to rupees ten crores . Further, the commission dismissed a review against said order on 5 October 2020. ....
