WASHINGTON (AP) Former President Donald Trump has filed suit against three of the country’s biggest tech companies, saying he and other conservatives have been wrongfully censored. But legal experts say the suits are likely doomed to fail, given existing precedent and legal protections.
Trump announced the action against Facebook, Twitter and Google’s YouTube, along with the companies’ Mark Zuckerberg, Jack Dorsey and Sundar Pichai, at a press conference Wednesday in New Jersey, where he demanded that his accounts be reinstated. ....

Why Texas' social media bills are doomed to fail in the courts

Texas’ bid to end so-called censorship by social media companies is doomed to fail. Not for lack of trying, mind you, but the state’s inability to justify the constitutionality of SB 5 and HB 95 beyond the “free speech!” mantra.
It’s like Texas Republicans, and other GOP politicians looking to prevent the “censorship,” either conveniently forget or just plain ignore the idea of “freedom of association.” Freedom the Texas GOP once quickly attempted to defend including a 2017 law reaffirming the fact private child welfare services companies can refuse to do business with a client or potential client if their beliefs run contrary to the other. There’s also a law banning state and local governments from denying a contract based on religious beliefs. ....

Section 230 Continues To Not Mean Whatever You Want It To

In the annals of Section 230 crackpottery, the “publisher or platform” canard reigns supreme. Like the worst (or perhaps best) game of “Broken Telephone” ever, it has morphed into a series of increasingly bizarre theories about a law that is actually fairly short and straightforward.
Last week, this fanciful yarn took an even more absurd turn. It began on Friday, when Facebook began to roll out test warnings about extremism as part of its anti-radicalization efforts and in response to the Christchurch Call for Action campaign. There appears to be two iterations of the warnings: one asks the user whether they are concerned that someone they know is becoming an extremist, a second warns the user that they may have been exposed to extremist content (allegedly appearing while users were viewing specific types of content). Both warnings provide a link to support resources to combat extremism. ....
