Arkansas Supreme Court, theoretically non-partisan.

He is Circuit Judge
Gunner DeLay of Fort Smith, a former Republican state representative and senator, who was appointed by Republican Governors Huckabee and Hutchinson to stints as prosecutor and district judge. He was elected to a circuit judgeship in 2020.
He’s running for the seat now held by
Justice Karen Baker. She won a  special election to a partial term in 2010 and then ran unopposed for a full term in 2014. She hasn’t announced her plans, but I’ve attempted to reach her by e-mail. ....

LITTLE ROCK, Ark. (AP) An Arkansas judge and former Republican lawmaker on Thursday announced he s running for a seat on the state Supreme Court, which has been drawn the attention and spending by outside conservative groups in recent years.
Sebastian County Circuit Judge Gunner DeLay said he s running for the seat currently held by Justice Karen Baker, who hasn t said whether she s running for reelection next year. State Supreme Court justices are elected to eight-year terms.
“The Supreme Court is the last line of defense for protecting the rights of the people; rights that include free speech, the right to bear arms, and due process of law, DeLay said in a statement. “The stakes in the race are high because what courts decide today determines the kind of world our kids and grandkids live in tomorrow.” ....

Rep. Andrew Collins of Little Rock is pushing to shine a light on secretive spending in judicial campaigns.
Huge sums of money from anonymous sources are determining the winners and losers in appellate court races in recent years. A bill going up before lawmakers today would change that by shining light on dark money in Arkansas judicial elections.

“The bill was prompted by the overwhelming influence of anonymous spending in recent years in appellate judicial races in particular,” Collins explained. While judicial candidates themselves spent $1 million on TV ads during that time period, outside groups spent $3 million. “Dark money is completely dominating the discourse,” he said. ....

Supreme Court denies Judge Griffen's effort to hear capital case

In a brief order today, the Arkansas Supreme Court granted the state of Arkansas’s petition to prevent Circuit Judge Wendell Griffen from hearing a capital case.
The Supreme Court ordered Griffen off capital cases in 2017 following his participation in a demonstration outside the Governor’s Mansion. But he was assigned a murder case last fall under a new court case distribution plan and refused the prosecutor’s request to have the case reassigned. The prosecutor said he didn’t object to Griffen hearing capital cases but was bound to request the transfer by the Supreme Court’s earlier order. ....

The
Arkansas Supreme Court today ruled that
Brad Hunter Smith should be resentenced on his capital murder conviction for the kidnapping and murder of Cherrish Allbright in Cleveland County in January 2016.
His conviction and death sentence were upheld originally, but in seeking post-conviction relief Smith said he’d had ineffective counsel because his trial lawyer dropped an objection to the prosecution’s using Allbright’s pregnancy as an aggravating circumstance justifying the death penalty.

The Supreme Court’s 5-2 decision today turned on whether Allbright’s five-week-old embryo was a person under the statute, which says a person commits capital murder if “with the premeditated and deliberated purpose of causing the death of another person, the person causes the death of any person.” ....
