Fifth Circuit Issues Precedential Employment Discrimination Opinion in Favor of T-Mobile

Late last week, a three-judge panel sided with T-Mobile and its leave program administrator, Broadspire Services Inc., in a discrimination lawsuit brought by a transgender former employee. The opinion describes how, based on the record, T-Mobile Services USA Inc.’s firing of the plaintiff, Elijah Olivarez, was not discriminatory, but rather “ordinary business practice.”
The court explains that Olivarez was employed as a retail store associate for T-Mobile from approximately December 2015 to April 2018. During 2016, “a supervisor allegedly made demeaning and inappropriate comments about Olivarez’s transgender status,” which  Olivarez responded to by filing a complaint with human resources. ....

Will Hospitality Workers Get Their Jobs Back?
Local government wants to tell the hospitality industry how to repopulate its businesses. Employers are less than thrilled.
Minnesota, bars, restaurants, hotels, and other hospitality businesses have seen an estimated 116,000 jobs lost in the pandemic, says Hospitality Minnesota.
In March, the Minneapolis City Council approved Councilmember Steve Fletcher’s Hospitality Worker Right to Recall Ordinance to give former employees priority as jobs return. (A similar bill awaits action at the legislature, which covers the entire state and includes jobs at MSP Airport, though that bill’s fate is less promising.) The city ordinance applies to hotels or event venues with 50 or more guest rooms and event centers with at least 50,000 rentable square feet or 2,000 fixed seats. It covers employees with six months tenure who were laid off due to the pandemic, and reflects an initiative of Unite Here local 17. ....

Brad Hennen has joined Monroe Moxness Berg’s Business Law and Corporate Finance/Mergers and Acquisitions practice groups.
Hennen is a business attorney with experience in structured finance, investments, organizational governance, complex contracts, securities law and other business matters.
Hennen comes to Monroe MMB from solo practice, where he advised entrepreneurs on early-stage business planning, entity formation, securities and finance. For family-owned businesses he provided counsel on succession-planning issues, exit transactions and employment questions. Before his solo practice, Hennen was a partner at a large law firm, where he specialized in securities and mergers and acquisitions.
