At least 441 Aboriginal and Torres Strait Islander people have died in custody since the Royal Commission handed down its finding in 1991. These aren’t just numbers to us: these are our Elders, mothers, fathers, sisters, brothers and children.
No police officer or authority has ever been held criminally responsible. The legal system is so entrenched with systemic racism that Aboriginal people are the most incarcerated people in the world. Yet when one of our loved ones dies in the custody of police officers, prison guards or medical officers, there is no accountability. ....

Thirty years after sweeping reforms were recommended to end the injustice of Indigenous deaths in Australian custody, a spate of recent fatalities and soaring rates of Aboriginal incarceration have highlighted failures to act.
Jailing children as young as 10, persistent racist attitudes and tough law-and-order policies all contribute to what has been called as a national shame by Aboriginal leaders.
More than 450 Indigenous fatalities have been recorded since the landmark Royal Commission into Aboriginal Deaths in Custody was published in 1991, including five since early March. ....

The committee also determined that the Bail Act should be reformed to include an express consideration of Aboriginality as a provision to ensure people were not left on remand.
Aboriginal defendants are 20.4% more likely to be refused bail by police than non-Aboriginal defendants in similar cases, according to a recent NSW Bureau of Crime Statistics and Research (Bocsar) study of more than 500,000 bail decisions made in NSW between 2015 and 2019.
Guardian Australia’s Deaths Inside project found that, nationally, more than half (54%) of all Aboriginal people who died in custody between 2008 and 2021 were on remand.
The NSW committee recommended the urgent removal of hanging points in prison cells and urged the government to commit to a deadline for doing so. It cited the case of Tane Chatfield, who died in hospital two days after he was found hanging in his cell at the Tamworth correctional centre in September 2017. ....

Indigenous leaders and families have called for change across the nation s justice system following the handing down of a NSW parliamentary report into First Nations deaths in custody.

An Upper House Select Committee today tabled its findings and 39 recommendations which aim to reduce the over-representation of First Nations people in the criminal justice system.
