Native American Landowners Push Eighth Circuit to Order Dismantling of Oil Pipeline

(CN) An Eighth Circuit panel will determine whether an oil pipeline running through Native American land should come down because its easement permit issued in 1993 expired years ago.
A federal judge sided with the pipeline’s operator Andeavor and found that the property owners had not yet exhausted all administrative remedies. For its part, Andeavor claims it has been in a “regulatorily permitted holdover status while it seeks renewal of the right-of-way.”
Jeffrey Webb, an attorney for Andeavor, told the Eighth Circuit panel Thursday that the Bureau of Indian Affairs (BIA) decided it would treat that holdover as trespass in an action to assess damages from the expiration of the easement, but also ordered that the pipeline remain in place. ....

Law360 (February 18, 2021, 10:58 PM EST) An Eighth Circuit panel on Thursday questioned whether a group of Three Affiliated Tribes members could revive their proposed class action challenging a Marathon Petroleum Corp.-owned company s pipeline through their land, but also appeared skeptical that the federal government hadn t left the door open for them to pursue damages against the company.
An attorney for JoAnn Chase and about four dozen other members of the Three Affiliated Tribes also known as the Mandan, Hidatsa and Arikara Nation asked the court to overturn a North Dakota federal judge s ruling that the Bureau of Indian Affairs should resolve what to do. ....

A citizen of the Winnebago Tribe is taking on a key leadership position in President Joe Biden’s administration.
Ann Marie Bledsoe Downes will serve as Deputy Solicitor for Indian Affairs at the U.S. Department of the Interior.
In that role, she will lead the Indian Country legal team for the federal agency with
the most trust and treaty responsibilities to tribes and their citizens.
In recognition of the department’s importance, Biden has nominated Rep. Deb Haaland (D-New Mexico) to serve as Secretary of the Interior. If confirmed, the Pueblo of Laguna citizen will be the first Native person to lead Interior and the first Native person in a modern-day presidential cabinet. ....
