The brother of David McAtee and four other protesters were arrested during a march on Wednesday, a day after prosecutors announced law enforcement officers would not be charged in his fatal shooting.
Jamie McAtee, 35, was arrested and charged with unlawful assembly and walking in a roadway, according to Louisville Metro Police spokesman Dwight Mitchell.
David YaYa McAtee, a barbecue owner, died at age 53 on June 1 from a single bullet wound to the chest. The bullet was fired just after midnight by a National Guard member as the troops and LMPD officers converged on 26th and Broadway to break up a crowd they said was there in violation of a curfew enacted in response to protests over the police killing of Breonna Taylor.

The jailhouses werenât jumping to much over the weekend, with the exception of Boyd County, which saw an influx of federal inmates moving through as they await court hearings at the federal court house in downtown Ashland.
While a few notorious names found themselves on the booking logs at Boyd, lock-ups were light, for the most part â fewer than five of the inmates booked over the weekend at Boyd were due to charges incurred on the street.
Bench warrants made a good bulk of the arrests over the weekend as well, especially at the Big Sandy Regional Detention Center.
