Las Cruces man let out of prison weeks after judge orders release

A Las Cruces man who was being held in prison despite a judge ordering his immediate release four weeks ago was let out of the Otero County Prison Facility on Tuesday morning.
Judge Douglas Driggers of the 3rd Judicial District Court ordered Johnny Malone’s immediate release on Dec. 17 after finding that Malone, 37, had completed his sentence for 2007 rape and kidnapping convictions.
Despite the order, Malone was still being held in prison earlier this week. Corrections Department spokesman Eric Harrison told the Journal on Monday that the department was looking into the legality of Driggers’ order.
“After completing the review of the order, the department determined that it was appropriate to release Mr. Malone,” Harrison said in an email Wednesday. ....

LAS CRUCES – A man incarcerated in Otero County Prison Facility is now free, almost a month after a judge ordered his release.
Johnny Malone was ordered to be released by Third Judicial District Court Judge Douglas Driggers on Dec. 17.
On Monday, attorney Kenneth Stalter, told the
Sun-News that Malone, one of his clients, was being held unlawfully at the OCPF weeks after the judge s order. On Tuesday morning, Malone s family contacted Stalter to say he was scheduled to be released later that day. ....

A New Mexico man convicted of rape in 2007 remains in prison, despite a judge’s order last month to release him immediately.
A Corrections Department spokesman said the department is looking into the legality of the judge’s order.
Johnny Malone, 37, is currently being held at the Otero County Prison Facility. In April 2007, he pleaded guilty to one count of criminal sexual penetration and one count of kidnapping and was sentenced to six years in prison, followed by two years of parole and five years of supervised probation.

But in 2012, Malone violated his probation and, as a result, his sentence was changed to require five to 20 years of parole. Kenneth Stalter, Malone’s attorney, said Malone was given in-house parole, meaning he’s serving it in custody. ....
