On February 4, House and Senate Democrats introduced the Protecting the Right to Organize (PRO) Act. The sponsors described the bill as comprehensive labor legislation aimed at bolstering workers’ collective bargaining rights. The legislation is an updated version of a 2020 bill that passed the House but never made it out of committee in the Senate. If enacted, the PRO Act would result in sweeping changes to the National Labor Relations Act (NLRA), including drastically expanded damages, fines, and civil penalties in some cases, imposing personal liability on company officers and directors. Other pro-union and pro-employee changes under the PRO Act include: (1) allowing parties to negotiate collective bargaining agreement provisions requiring employees to pay union dues or face termination, even in right-to-work states; (2) prohibiting employers from permanently replacing strikers and locking out employees in certain strike situations; ....

From Joe Biden’s signing of an Executive Order throttling the Keystone XL Pipeline and eliminating 11,000 direct jobs, to Biden’s questionable firing of National Labor Relations Board (NRLB) General Counsel Peter Robb, it is clear that a war on work, and who controls it, will be part of what defines this new administration.
The National Right to Work Legal Defense Foundation recently filed a Freedom of Information Act request for correspondence related to the firing of NRLB General Counsel Robb. Since the office was established in 1947, a General Counsel has never been fired, even with changes in administrations. Robb only had 10 months left on his tenure. ....

The first few weeks in the Biden administration have been nothing short of busy. At the National Labor Relations Board (Board), it seems like there has been no time to waste in prioritizing items on the administration’s agenda. 
Only hours after being sworn into office on Jan. 20, 2021, President Biden took unprecedented action and fired Trump-appointed General Counsel Peter Robb. Former General Counsel Robb was reportedly offered the opportunity to resign, but refused, and was then fired. Robb’s term was set to expire in November of this year. A day later, Biden terminated second in command, Deputy General Counsel Alice Stock. President Biden appointed Peter Sung Ohr to serve as Acting General Counsel of the Agency. Ohr, most recently served as the Regional Director of Region 13 of the NLRB in Chicago.  ....
