Share and speak up for justice, law & order. ST. LOUIS St. Louis Circuit Attorney Kim Gardner is facing a disciplinary hearing that could result in the loss of her law license. An investigation launched in 2019 by the office of Alan Pratzel, the chief disciplinary counsel appointed by the Missouri Supreme Court, has found probable cause that Gardner committed professional misconduct during her past attempts to prosecute former Republican Gov. Eric Greitens, KMOV reported. The case was assigned Tuesday to go before a hearing, Fox 2 reported. A state webpage published Tuesday lists Gardner’s name among other cases pending before disciplinary hearing panels against Missouri lawyers. ....
| Print this article Circuit Attorney Kim Gardner, the St. Louis prosecutor who charged Mark and Patricia McCloskey for brandishing guns at protesters last summer, could have her law license revoked following a professional misconduct investigation and impending hearing. The Missouri Chief Disciplinary Counsel found probable cause that Gardner is guilty of professional misconduct after she allegedly hid evidence and fabricated facts while she was prosecuting then-Gov. Eric Greitens, according to court documents reported on Wednesday. The case is now set to go before a disciplinary hearing panel, according to a state website. In January 2018, the top attorney contracted William Don Tisaby, a private investigator who was later charged with perjury and evidence tampering, to help conduct an inquiry into Greitens, who at the time was accused of inappropriate extramarital contact with an anonymous individual identified as K.S. ....
Print this article Mark and Patricia McCloskey, the couple seen protecting their home with firearms during unrest last summer, want their criminal case to be revisited by a grand jury after Circuit Attorney Kim Gardner was found by a judge to have ulterior motives in the proceedings. “Due to the bias of Kim Gardner’s office, we believe the grand jury process was tainted and should be reviewed and revisited,” Joel Schwartz, the attorney for the pair, told the Associated Press on Wednesday. The McCloskeys were charged in July with unlawful use of a weapon in addition to evidence tampering following the circulation of the viral video that showed the duo confronting protesters in front of their St. Louis mansion following the death of George Floyd. Mark McCloskey, donning a pink polo, walked around his lawn with an AR-15, while his wife, Patricia, carried a silver handgun, ....

Posted on The Charge Against St. Louis Couple for Defending their Home U.S.A. –-(AmmoLand.com)- On Sunday, 28 June, 2020, the property of a married couple of Saint Louis lawyers was invaded by a screaming, unruly mob. Under Missouri law, the couple had a right to defend themselves and their home. From a previous article on AmmoLand: Section 563.031 specifically allows the use of deadly force, not just showing a weapon, against people who have entered private property unlawfully. In order to be justified, the person using the force must reasonably believe such force to be necessary to defend themselves or a third person from the unlawful use of force. ....
Listen / UPI Mark McCloskey, left, faces a felony charge of unlawful use of a weapon. The judge has said the office of Circuit Attorney Kim Gardner cannot prosecute the case against him. A judge ruled earlier this month that St. Louis Circuit Attorney Kimberly Gardner can’t prosecute one of the attorneys who infamously brandished a gun at protesters this summer. Gardner’s initial prosecution made headlines around the world and made the attorneys, Mark and Patricia McCloskey, public figures. They even made an appearance at the Republican National Convention. But now their prosecution is in doubt. The fact that Gardner cited the case against Mark and Patricia McCloskey in two fundraising emails, wrote Circuit Judge Thomas Clark II in Mark McCloskey’s case, could give the appearance that she brought the criminal prosecution “for political purposes.” Clark also barred other prosecutors in Gardner’s office from taking the case. ....
