Family Law Week: Family Procedure (Amendment) Rules 2021

The
Family Procedure (Amendment) Rules 2021, which come into force on 6 April 2021, amend the Family Procedure Rules 2010 as follows:
Rule 3 amends rule 6.43 of the FPR which makes provision for cases where service is to be effected on a respondent outside of the United Kingdom.
Rule 4 inserts a new rule 36.3 into the FPR to enable provisions of the FPR to be modified or disapplied by Practice Directions to address issues for the work of the courts arising from a public emergency.

Amendments to paragraph 1.4 and 11.1 of Practice Direction 36N, to add provision for a legal representative of a respondent to use the online system for contested financial remedy applications and remove references to Maintenance Pending Suit applications, came into force on
18 December 2020. The remainder of the amendments come into force on
11 January 2021.

The introduction of new Practice Direction 41C to provide for a procedure by which, in specified circumstances, appeal proceedings in Family Division of the High Court may proceed by electronic means using an online case management system.

Application by a father against a mother for a finding of contempt of court, relating to a child removed to Nigeria.
This matter concerns an application by the father ( F ) against the mother ( M ) for a finding that M is in contempt of court in relation to four court orders. The parties are the parents of NE, a girl, aged 11.
Firstly, Mrs Justice Lieven DBE had to decide whether to proceed in M s absence despite this being a committal application. The judge considered
Sanchez v Pawell Obaz and Jolant Obaz [2015] EWHC 235 (Fam) finding that M had been properly served all documents via email (M is in Lagos) including the notice of hearing. M had sufficient time to prepare, she was aware of the proceedings and initially engaged in them. No reason was given for her non-attendance at this hearing, nor the last. The judge thought M had simply chosen not to engage and that an adjournment would not be likely to secure her attendance. ....
