One hundred days into Joe Biden’s presidency, his administration’s executive orders and agency actions have reinstated and advanced an environment that empowers sustainable investing. President Biden has also assembled a strong climate-change team and bestowed significant authority on it, including establishing a new White House Office of Domestic Climate Policy, headed by Gina McCarthy, and appointing former Secretary of State John Kerry to the U.S. National Security Council as special presidential envoy for climate.

DOL Issues New Guidance On Cybersecurity For Retirement Benefit Plans - Employment and HR


The Department of Labor (DOL) has issued its first-ever guidance
1 on cybersecurity for ERISA-regulated retirement
benefit plans. This guidance comes shortly after the Government
Accountability Office (GAO) released a report
2 calling
on the DOL to clarify how plan administrators should address
cybersecurity risks for defined benefit plans. The DOL s
guidance, which suggests combating cybercrime should be a priority
for plan sponsors and fiduciaries, also provides tips to
participants and beneficiaries on how to guard against cyber
threats.
The guidance has three parts: one directed at plan sponsors, one
directed at record keepers and service providers, and one directed
at plan participants. ....

SEC Leadership Changes
On April 14, 2021, the U.S. Senate voted to approve President Biden’s nomination of Gary Gensler as Chairman of the Securities and Exchange Commission (the “SEC”) through June 5, 2021. The vote came after the Senate Banking Committee endorsed Gensler’s nomination in March 2021. The confirmation only approves Gensler to serve the remainder of former SEC Chairman Jay Clayton’s term, though the Senate Banking Committee has cleared Gensler to serve another five-year term afterward. Gensler served as chairman of the U.S. Commodity Futures Trading Commission from 2009 to 2014, and helped to draft the Sarbanes-Oxley Act as senior advisor to U.S. Senator Paul Sarbanes. In a statement, the SEC’s four commissioners said they welcome Gensler “and look forward to working together to execute our vital mission.” ....
