'Landmark' ruling stops eviction of farmworkers and...


A farmer’s application to evict the adult children of farmworkers employed on his farm Hammansdans outside Wellington in the Western Cape was dismissed by Judge Zeenat Carelse in the Land Claims Court on 13 April 2021. 
Ashraf Mahomed, who represented the workers, said the judgment was a landmark ruling which in essence protected the rights of children and the right to family life.

The application was brought before the court by First Realty (Krugersdorp) (Pty) Ltd. The farm and company have been owned by farmer Chris Hamman since 2011. The eviction sought was in terms of the Extension of Security of Tenure Act, 62 of 1997. ....

Three truck accidents involving farmworkers, that have claimed the lives of three people and left several injured, are a matter of grave concern and highlight a real threat to farmworkers in the Western Cape. 
The accidents happened between Monday 4 January 2021 and Wednesday 27 January 2021. Nosey Pieterse, president of the Bawsi Agricultural Workers Union of South Africa, said the spate of truck accidents involving farmworkers was not something new.
“We had fights with the authorities and didn’t get answers from government, both national and provincial. It is important that the accidents be attended to, especially in the light of Covid-19. Only now people might come to realise that overloaded trucks are a real and serious threat to our people. ....

The incident happened in Klapmuts, outside Cape Town, early yesterday.
EMS spokeswoman Deanna Bessick said they received a call about the incident at 7am, and 12 ambulances and two rescue cars were sent to the scene.
“Two patients are seriously injured, 27 sustained moderate to serious injuries and 51 sustained minor injuries,” she said.
Transport MEC Bonginkosi Madikizela wished the injured workers a speedy recovery. He said the truck driver was trying to avoid crashing into a car when he lost control. He also urged drivers not to go over the vehicle capacity.
“We urge drivers, especially of trucks, to always drive with caution and not exceed the total vehicle carrying capacity. We wish all the injured workers a speedy recovery,” said Madikizela. ....

Accessing government funds when existing as a NGO is like trying to jog in quicksand. In recent interviews with The Daily Vox, two organisations listed this as a major stumbling block when looking for funding. While we understand checks and balances are needed when funds are involved- but why not move into a more holistic approach to vetting organisations?
Jacqueline Cupido from FACEUP Manenberg said that they partnered one year with the City of Cape Town for a holiday programme. Subsequently it was unsuccessful as they only catered for 50 children, after being given a number of 300. The facilitators had to share snacks meant for one child into three. Upon further enquiry the problem lies with third-party coordinators first who access funds first before the actual NGO.
