Anne Arundel County defends restaurant executive order at hearing

The hearing continued Tuesday with county officials defending the executive order.
The judge pressed Anne Arundel County Health Officer Dr. Nilesh Kalyanaraman for answers, demanding to know why the county is relying on hospital bed capacity projections rather than actual numbers.
The health officer told the court the county heavily relies on the number of COVID-19 hospitalization projections to determine what safety measures to put in place to help stop the spread. The numbers for December were off by 5,000 beds, leaving more than enough space to handle a spike in cases.
Mulford: This is not in the realm of reasonable probability. Why are you so wildly off with your projections? Why do you need to do more? ....

Legal challenge to Anne Arundel restaurant restrictions back in court

Nine witnesses including restaurant owners and doctors testified Monday via Zoom in the day-long hearing before Anne Arundel County Circuit Court Judge William Mulford.
The hearing turned into battle of the experts: attorneys for four Anne Arundel County restaurant owners contend County Executive Steuart Pittman does not have the authority to prohibit indoor dining, nor to restrict eating outdoors at restaurants by requiring 50% of tent flaps to be up. The attorneys also pointed out there is no scientific evidence to support restaurant dining contributes to the spread of COVID-19.
Lawyers for Pittman explained in court papers that Gov. Larry Hogan s executive order provides the legal authority to enact further restrictions. They said the science from public health experts is clear, that it shows taking actions to limit situations where people gather without masks will prevent the spread of the virus and save lives. ....

After a 12-hour hearing, a Maryland judge upheld a ban on indoor dining in Montgomery County late Wednesday night, agreeing with a judge in neighboring Prince George s County who made a similar ruling earlier in the day.
Their verdicts came as coronavirus cases continued to surge across the region and Democratic lawmakers and officials urged Gov. Larry Hogan, a Republican, to tap reserve funds for pandemic relief.
The county council, the county executive are trying to protect this community from death and from the virus, Montgomery County Circuit Judge James Bonifant said in his concluding remarks. I believe that standard is clear, and I believe that they are doing the best they can. ....
