BOURNEDALE The former owner of the shuttered Scenic View Motel will no longer be liable to pay thousands of dollars in fines for repeat health sanitation violations dating back to 2019. “We use the fines as a tool in order to get enforcement,” said Stanley Andrews, chair of the Board of Health on Thursday. “We did not get compliance on that site.” However, the owner had already vacated the site, located at 871 Scenic Highway, and stopped operating as a motel after the fines were assessed, Andrews said. On Wednesday, a lawsuit filed byformer owner A.J. Michael Realty, LLC against the Bourne Board of Health, asking to reconsider the fines, was dismissed in Barnstable Superior Court by Judge Gregg Pasquale. ....
Michaela Chesin, Banner Staff PROVINCETOWN The Provincetown Public Pier Corporation continues to face legal challenges after reclassifying commercial fishermen’s vessels last year – especially from one person. Provincetown resident and fisherman David Flattery was shocked last summer when he was no longer granted a commercial fishing slip at MacMillan Pier, a spot he held since 2015 for his 22-foot his shellfish vessel Bethany Lynn, he said. Pier Corp. Board of Director members and Pier Manager Doug Boulanger made the decisions while trying to correctly apply local harbor regulations so that fishermen who are allocated slips at the town-owned pier, and are designated as full-time commercial fishermen, fit the qualifications in the regulations, according to their comments at public meetings. ....
