BOURNEDALE The former owner of the shuttered Scenic View Motel will no longer be liable to pay thousands of dollars in fines for repeat health sanitation violations dating back to 2019. 
“We use the fines as a tool in order to get enforcement,” said Stanley Andrews, chair of the Board of Health on Thursday. “We did not get compliance on that site.”
However, the owner had already vacated the site, located at 871 Scenic Highway, and stopped operating as a motel after the fines were assessed, Andrews said. 
On Wednesday, a lawsuit filed byformer owner A.J. Michael Realty, LLC against the Bourne Board of Health, asking to reconsider the fines, was dismissed in Barnstable Superior Court by Judge Gregg Pasquale. ....
