Justice Swarana Kanta Sharma was hearing a writ petition filed by Sister Sephy, who was convicted in the Sister Abhaya murder case, against a virginity test conducted on her by the Central Bureau of Investigation in 1992.
The Delhi High court on Tuesday declared that the virginity test conducted on a female detainee, accused under investigation, or in custody, whether judicial or police, is unconstitutional and in violation of Article 21 of the Constitution which includes right to dignity.
A virginity test administered on female detainees or accused while in police or judicial custody violates Article 21 of the Constitution, the Delhi High Court has reportedly ruled.
This ruling was made by Justice Swarana Kanta Sharma in a case involving the Central Bureau of Investigation's (CBI) administration of a virginity test on Sister Sephy.
