At laquan mcdonald. earlier in court, the defense argued that van dyke should only be found guilty of the second degree homicide because it s the larger charge and not found guilty of the other 16 aggravated batteries. the defense is arguing this because van dykes that no prior criminal history. he s eligible for probation. the defense is hoping the judge would buy that argument and only sentence van dyke to probation. in court, van dyke had heavy blood shot eyes. he grew out a beard while in prison. he looks broken down. different from the man that was clean cut during the trial. so far the state has called four witnesses to testify against van dyke s character and professionalism, all four alleging that van dyke physically abused them during arrests or called them racial slurs. in cross examination, the attorneys were able to cast some reasonable doubt on all of these witnesses so far. the defense is expected to call its witnesses to testify on behalf of jason van dyke. ....
