Pretoria - While the 14-year-old Mbilwi Secondary School learner arrested for assaulting fellow pupil Lufuno Mavhunga will have to face the consequences of her alleged actions, the Child Justice Act tries as far as possible to divert children away from the criminal justice system
This is according to Zita Hansungule of the Centre for Child Law, who is an expert on the child justice system.
The teenager was on Thursday granted R1 500 bail at the Thohoyandou Children’s Court and released into the care of her mother.

The teenager was released into the care of her mother.
She is charged with assault with intent to cause grievous bodily harm.
Speaking to Pretoria News yesterday, her lawyer, Kagiso Muthivhithivhi, said the teenager should have been granted bail at her first appearance.
Muthivhithivhi said: âIt was long overdue.
âItâs unheard of to keep a 14-year-old in prison for assault.â
The minor appeared in camera and cannot be identified in accordance to the Criminal Procedure Act.

The Thohoyandou Children’s Court in Limpopo granted the minor R1500 bail on Thursday following her arrest over two weeks ago.
She faces a charge of assault for the brutal, public assault of the late Lufuno Mavhungu who died of suicide following the incident seen on a viral video on social media.
“The state opposed the bail looking at the seriousness of the offence even though we are dealing with the child who conflicts with the law. Remember that the defence wanted the child to be released under the custody of her guardian, however the court felt that bail must be fixed at R1500,” said regional spokesperson for the National Prosecuting Authority (NPA), Mashudu Malabi-Dzhangi.
