good morning. welcome cnn this morning. merry christmas eve out there. santa is making his rounds. new developments from former president trump s legal team in a filing submitted late last night. the president is urging a federal appeals court to slow out the federal election subversion case against him in washington, d.c. his attorneys driving home the point trump was working in his official capacity as president to make sure the integrity of the election results. in the document they said before any single prosecutor can ask a court to sit in judgment of the president s conduct, congress must have approved of it by impeaching and convicting the president and since that didn t happen, trump has immunity. well the appeals court expedited the process and will hear arguments january 9. the judge for the case paused procedural deadlines. it s up to an appeals court to decide if presidential immunity applies here. he is not the first president to invoke presiden ....

a curb and ran into a number of people in midtown manhattan. athena jones is here with us. what can eye tell us? victor, this is just breaking, 12:59 p.m., a taxi jumped a curb and struck three people. three of them critically injured. they were sent to a local hospital according to the nypd. it appears this is just an accident. this is being investigated by the detectives on the scene and the taxicab driver remained on the scene. four people struck, three people critically injured and taken to the hospital after a taxicab jumped the curb and hit the people walking on the sidewalk. we don t know the condition of the driver, although we know the driver is still on the scene. this happened around broadway and 29th street. for people who have any sense of manhattan, this is a few hours south of the empire state building. you can imagine how many people were on the sidewalk on a day like today, when it happened just before 1:00 p.m. as of right now, it s being investigate ....
