in a battleground state and responds to questions about his support of candidates ahead of the mid terms. >> good morning. welcome to "way too early" on this friday. i'm jonathan lamire. we're following new developments in the timing of the house select committee subpoena to former president donald trump. last week the panel voted unanimously to sp trump for documents and testimony relating to the january 6th attack. while the subpoena was initially expected earlier this week, the time line has slid. according to "politico," trump hired a law firm that will engage with the house select committee. earlier this week, abc news had reported that the subpoena was delayed in part because investigators were still trying to find a lawyer for trump who would be authorized to accept service of it. while the exact timing of the subpoena remains unclear "the washington post" yesterday reported that it will come by the end of the week. according to the newspaper, trump told advisors that he potentially would be willing to testify live before the committee. privately, some members of his legal team have said allowing their client to testify in any capacity, that would be a significant mistake. meanwhile, the department of justice says it needs $34 million in funding to continue its massive investigation into the capitol attack. it wants that money included in a spending bill that needs to pass in december because of concerns that republicans would cut off funding next year if they win back the house of representatives in the upcoming mid terms. the doj has called the capital attack the most wide-ranging investigation in its history with more than 870 arrests so far. but the doj says its work is far from over. there are still hundreds of rioters who have not yet been arrested. when asked about the requests, the house appropriation chair, a democrat from connecticut, said, quote, there are lots of questions. we're taking a look at all of them and seeing what makes it and seeing what doesn't make it. we also have some major updates in the fulton county, georgia, investigation of potential 2020 election interference. two key trump allies have given testimony to the special grand jury. former republican senator kelly laughler whose loss helped win control of the senate two years ago as spoken to the grand jury. a source familiar with the matter confirms to nbc news that former white house council pat cipallone has already testified. cipallone has given tom to the january 6 select committee when he described ways on pushing back an ways to overturn the government. >> that's a terrible idea. and that's not how we do things in the united states. there is no legal authority to do that. and there is a way to contest elections, you know, that happens all the time. but the idea that the federal government could come in and seize election meetings and let -- i don't understand why we would tell you why that is a bad idea. it's a terrible idea. >> additionally, a federal appeals court has ruled against senator lindsey graham saying he must testify before that same fulton county grand jury regarding details about phone calls he made to top election officials in georgia amid complaints from then president trump that there had been widespread voter fraud. graham contended he shouldn't have to answer questions about the calls which are now part of fulton county district attorney's willis' criminal investigation into possible election interference in the state because graham says he made them in his capacity as chair of the senate judiciary committee, his post at the time. in a unanimous ruling thursday, a three judge panel of the 11th circuit u.s. court of appeals disagreed with graham's argue am p that's the actions were protected under the u.s. constitutions speech and debade clause. the united states says they have evidence that iran has sent troops to russian occupied territories in ukraine to assist the russians in launching drone attacks across the country. this is significant escalation. white house national security council spokesperson john kirby told reporters thursday that iran sent the trainers to help russian forces utilize the drones with, quote, better lethality. he said he didn't have a number but believed it was small. in a video addressed earlier this week, ukrainian president zelenskyy said his forces have shot down well over 200 of these tehran made drones just this month. the drones continue to target civilian areas and infrastructure. state department spokesperson ned price confirmed the latest developmentes in a news conference yesterday. >> we can confirm that russian military personnel based in crimea have been piloting iranian uavs and using them to conduct strikes across ukraine including strikes against kyiv in recent days. we assess that iranian personnel were on the ground and assisted russia in these operations. >> after recent comments from house gop leader kevin mccarthy cast doubt on future aid for ukraine, a group of lawmakers is quickly working to pass a military assistance package. with in a threat looming, the bipartisan bill would use a government funding bill during the lame duck session after the mid terms to secure a much higher level of military and other assistance than prior packages for ukraine. that's according to a lawmaker and congressional staffers. congress last month approved $12 billion in military and economic aid to ukraine. the amount would be enough to make sure ukraine can get through the year. a republican senator with naj of the matter told nbc news. quote, it will make the $12 billion look like pocket change. the white house has not yet made a formal request for knew nu funding, president biden did address the issue while on a campaign stop in pittsburgh yesterday. >> are you worried about ukraine aid? >> for the record, the president is in a pittsburgh sandwich place which is fantastic. joining us now, national security reporter for "the wall street journal," our friend, vivian sloan. we'll get to funding in a second. let's start with the reports about iran. and how they are actively helping russia with the war in ukraine both supplying drones and now personnel to help operate them. what sort of response can we see from the international community in an attempt to punish iran for this? >> good morning, jon. yeah, we have already seen some actions taken by the u.s. and its allies just in the last day. and this has been a case that they have been building over time. obviously, it comes at a very fragile moment for the biden administration because of the fact that they continue to try to resuscitate, if you will, the nuclear talks which, you know, have been foiling in recent weeks. so the reports complicate matters. they keep saying that the issue of supporting russian forces in ukraine is very separate from the nuclear talks. and they are going now focus primarily on iran's malign activities both in ukraine and across the middle east. and the nuclear agreement is not going to be focus for now. but obviously, you know, there are so many issues at stake with rhinian involvement. we have known that they are likely supporting moscow, our long time allies. so it is not a surprise. but with the u.s. coming out for the first time and very bluntly and publicly calling out iran, it obviously has very high stakes. >> you're right to point out extraordinary scenes of protest, nightly in iran in recent weeks. so kevin mckarnlg qui's comments earlier this week really put him to the public this divide within the republican party. mccarthy suggests there won't be a blank check anymore. the biden white house is watching this. they're also considering lending support for a lame duck package. >> there are a number of republicans that would come out publicly in favor of any kind of large package to ukraine. they're still trying to work out what that package would look like. a lot of these, it's important to tlaeb a lot of these packages while we put financial numbers on them, they're usually sent as weapons themselves. and so it's usually about what kind of weapons ukraine needs at that moment. that has been evolving over the year. for weeks now this is a growing concern among republicans in the house especially. i got back from ukraine a few weeks ago. my phone was blowing up with people saying members of their own party were going to renege on this aid to ukraine. the justification by those who are starting to kind of push back on the package is we have to check and balance and question where the money is coming from and how they're using it and revisit it over and over again. but there is also an election related issue at stake where a lot of voters starting to question, you know, why is ukraine getting billions of dollars when we can't afford gas and we can't afford to put food on the table? this is a growing issue for some republicans who have now started to push back and say, well, hold on. maybe i shouldn't be supporting this as much as we have been previously. and so obviously if the republicans do win the house, no one thinks that it's going to stop aid from going to ukraine. but it could make it a lot more complicated and a lot slower. >> slower and smaller packages, political risk here, no doubt. terrific stuff. thank you. we'll >> yeah. >> moments later, the presidents with asked about abortion and its role in the mid terms. take a look. >> do you have any opinion on the abortion at all? >> roe ve wade. read it, man, you'll get educated. >> joining me now, political reporter for the 19th. congratulations there. let us atalk a little bit about pennsylvania. and the president's appearance yesterday. give us your analysis of the role that he can play and let's be clear, despite what he said, candidates have been pretty choosey as to whether or not the president they want the president to stand alongside them. but pennsylvania, state where biden is very popular, is a place where fetterman decided he wanted him there. tell us about biden in pennsylvania and also just how important the upcoming pennsylvania senate debate will be. >> absolutely. first of all, thank you, john, for the congratulations. i appreciate it. yet, pennsylvania is a really important state f democrats want any chance of holding on to even the 50/50 split of the senate, they need to flip pennsylvania, baking in they may lose an incumbent. as you know, this is a very interesting strategy on biden's part. he's not doing a lot of big rallies like we saw trump do. it is the smaller targeted events with elected officials and candidates that point back to a part of his agenda. in this case, the bipartisan infrastructure law. it's a strategy we've seen from other members of the administration like vice president harris going on, for example, official visits along with fundraisers. but not big campaign rallies. biden is still pretty popular in pennsylvania. but he's not, you know, popular necessarily in every battleground state and every candidate may not want him on stage with him. >> the debate next week, fetterman, this will be a moment for him to show to voters his recovery from the stroke as well as a chance to take it to oz who has plenty of baggage in his own campaign. >> yes. absolutely. this is going to be a very, very highly watched debate. and also sort of a chance for him to prove not only that he's up to the job but to kind of normalize having auditory processing issues after a stroke. normalizing the accommodations that a lot of people may need in the workplace. there are a lot of currently serving new york senators you have to speak up and speak loudly because they don't hear as well. it's for him to say, hey, i'm no different. i had a stroke but i'm up to are this task and also to go negative on oz. it will be an interesting one. >> no doubt. give is a sense of your new reporting on how abortion stories are taking center stage in democratic campaign ads. polling suggests that economy is the top issue right now. abortion also very, very important as voters about to head to the polls. give us a sense how democrats want to press that issue in the final weeks. >> yeah. absolutely. so i reported yesterday on over a dozen democratic campaign ads that are not just about abortion but featuring first person testimonials from pim talking openly about abortion experiences. it signals how much democrats want to hammer reproductive rights in this election, but also the democratic party's evolution on the issue from saying oh, we should be safe, rare, legal to we need reproductive health to now explicitly saying the word abortion and featuring the first person stories that really have not been heard very much in the political arena. so it's definitely what they're banking on in the final weeks. it's an interesting trend now in campaign ads. >> all right. we'll be following that in the weeks ahead. political reporter for the 19th, grace panetta. still ahead, live to cnbc for the latest in it business news and a check on the markets with ch are deep in the red this morning. you can see it. there depressing, folks. we'll be right back. folks. we'll be right back. my most important kitchen tool? no, he's seizing the moment with merrill. moving his money into his investment account in real time and that's... how you collect coins. your money never stops working for you with merrill, a bank of america company. ♪i like to vöost it, vöost it♪ ♪my vitamins can boost it♪ ♪i like to vöost it, vöost it♪ ♪we like to vöost it♪ ♪♪ vöost: vitamin boosts. ♪vöost it♪ welcome back to "way too early." the race is on to find the new prime minister. of by the end of next friday the members will have voted on a replacement for liz truss who announced resignation yesterday after a, shall we say, tumultuous six weeks in office. facing criticism for the multistage process that resulted in truss succeeding former prime minister boris johnson in the first place, the conservatives are now implementing new rules for this leadership contest. on monday, the window will close for candidates to get the required 100 signatures from conservative members of parliament. those lawmakers will then narrow that pool down to two. and present those options to conservative voters who will then cast their ballots online. one of the favorites to take the mid atlantic sl former treasury secretary chief rishi sunak who lost to truss in the last vote six weeks ago. also the house of commons leader penny mordaunt, ben wallace and boris johnson himself. johnson announced his own resignation in july following a series of ethical scandals. but as conservatives search for britain's fifth prime minister in the last six years, the opposing labor party is calling for a different process altogether to determine the country's next leader. instead of the vote where only conservatives cast ballots, labor leaders are calling for an immediate general election in the united kingdom. under british law, the conservatives are not required to hold another general election until early 2025. one could still happen though if enough conservatives join with the opposition but given the party's poor public standing, it's unlikely that they would risk losing power in a general election. truss resigned yesterday after her economic policy plan sent the value of the pound plummeting. she will remain in office until her successor is appointed but will will still leave after the shortest tenure of any prime minister in british history. joining us now, senior reporter for nbc news digital, alexander smith and also with us, london correspondent for "the washington post" carla adam. good morning to you both. carla, let's start with you. this has been a tumultuous time for the united kingdom. boris johnson's resignation, queen's death and now liz truss is out the door. what is the national mood? >> yes. once again, tumultuous time. i've been on your show before talking about various tumultuous times. i think people are still processing. it's been an extraordinary few days and weeks and months. we think it's really the scale and really the pace of change that is really astonishing. i was thinking by the end of october we'll have had three prime ministers in eight weeks. then look to being day and what is going through the papers, there is a lot of focus the race is on and who is next? you mentioned boris johnson, he is one of the contenders. and, you know, we're wondering right now who is going to be next and what is going to be a very, very speedy contest? >> tell us a little bit about this race to be the next prime minister. in particular, give us more on the favorite and, yes, boris johnson. do we think there is an appetite for his come back? >> yes. so two of the frontrunners are thought to be, we don't know for sure, we don't have all of the official declarations. the two frontrunners are sunak and boris johnson. that all feels like deja vu. it's deja vu. we had similar races with some of the same candidates not that long ago. richy sunak was the runner up in truss in the last election. he is the chancellor as we call that role here at the finance minister. he also did best last time among torre nps who play an important, very important role in choosing the next leader. he is the bookie's front-runner right now. so watch that space. another frontrunner is boris johnson. he doesn't poll as well with the colleagues. they recently just booted him out of office. but he does poll very well with conservative party members. and that's a group of about 170,000 people. they also will play a part in this contest. this group is generally older, whiter, more right-wing than the rest of the party and the rest of the country. and they really feel buyer's remore with luz truss. -- liz truss. they want boris johnson back. these are two real contenders in the race. >> we'll have our answer quickly, without seem. alex, as we noted, labor leaders are calling for a general election s there any chance at all that actually happens? >> the rules are very publish indicated and changing all the times. it's hard to keep track of this. but basically the only way that a general election can be called is if a prime minister, whoever that might be, pulls one, or if a majority of law makers in the house of commons vote for one themselves. and, of course, as you earlier, the conservative party is doing so badly in the polls, this is a kind of turkey's voting at christmas situation where any incoming prime minister would have to say i know we're facing electoral wipeout, but i'm going to call this election and cost you all your jobs. it's that stark at the moment. absent some sort of dramatic change somewhere, it's difficult to see why a prime minister would give up everything immediately, every poll is unanimous, the only thing lawmakers are talking about at the moment is they would be so outraged if boris johnson were to come back, given the manner of his departure, the scandal, they said they would resign the whip, ceasing to become conservative lawmakers and that does raise the process of the parliamentary party disintegrating from belief, if he were to become the new leader. >> dismal polling at the moment. alex, there is a sense they won't call that election, so whoever that next prime minister is, just give us a quick sense, what are some of the challenges that he or she has to immediately take on? >> well, it's worth remembering that alongside this sort of revolving door drama of politics in london, there's a real economic crisis which is biting for millions of people already. i have been speaking to people this week who are struggling to heat their homes, struggling to eat. skipping meals because of the rising cost of food, the rising energy prices and that is only going to get worse this winter. the incoming prime minister is only going to inherit a country in deep political turmoil but economic as well where the government is equally unpopular and there's not an easy answer in terms of alleviating a lot of pain going into the winter. people are terrified. >> we will certainly be staying on this story and likely coming back to both of you soon. nbc's alexander smith and the "washington post's" carla adam, thank you to you both. the rare intervention by a major civil rights organization in a slate of key down ballot races this november. >> and then on "morning joe," the latest developments on the investigations into the january 6th attack on the capitol. the house select committee is expected to serve former president trump with a subpoena as early as today while the justice department calls for critically needed funding in order to continue its own probe. plus, the latest from the war in eastern europe as teheran escalates its support of moscow's forces. and u.s. lawmakers moved to shore up future military aid for ukraine after republicans threatened to cut it off.
