The People’s Republic of China (PRC) has for years engaged in artificial island construction in the South China Sea and justified its activities which have caused enormous environmental harm with frivolous claims of “historic rights” to the region. Both the PRC’s operations in and assertions of sovereignty over the South China Sea are illegal under the widely accepted United Nations Convention on the Law of the Sea (UNCLOS). In this piece, I argue that the US must itself ratify UNCLOS in order to lend greater credibility to its criticism of the PRC’s transgressions and more convincingly pressure Beijing to alter course.
