Judge Rules Transgender Ohioans Can Change Birth Certificates

COLUMBUS, Ohio (CN) A federal judge ruled Wednesday that Ohio’s refusal to let transgender residents change the gender on their birth certificates is unconstitutional, finding the policy exposes them to workplace discrimination and a heightened risk of violence.
U.S. District Judge Michael Watson in Columbus sided with four transgender individuals, represented by Lambda Legal and the ACLU, who sued over the policy two and a half years ago, claiming it violates their equal protection and due process under the 14th Amendment.  ....

Judge strikes down Ohio prohibition on transgender people correcting birth certificates

(CNN) A federal judge on Wednesday struck down Ohio’s policy prohibiting transgender residents from correcting the gender marker on their birth certificate, clearing the way for individuals to alter the document to reflect their gender identity.
Judge Michael Watson wrote in his decision that prior to 2016, the state had allowed such changes to be made, but that the new policy, which was instituted by the state’s Department of Health in consultation with then-Republican Gov. John Kasich’s office, violates the Constitution.
“This policy resembles the sort of discrimination-based legislation struck down under the equal protection clause in Romer v. Evans as nothing more than a policy ‘born of animosity toward the class of person affected’ that has ‘no rational relation to a legitimate government purpose,’ ” he wrote, referring to a landmark 1996 gay rights case. ....

Judge clears way for transgender Ohioans to change birth certificates

A federal judge has cleared the way for transgender residents of Ohio to correct the gender on their birth certificates, striking down a former state policy prohibiting such changes.
In his decision Wednesday, Judge Michael Watson pointed out the state had allowed gender changes on birth certificates prior to 2016, alleging the state s policy instituted by Ohio s Department of Health in review with then-Gov. John Kasich s (R) office violated the Constitution, according to court documents.
A spokesperson for ODH responded to the Hill Wednesday evening, saying the decision is still under review by the department. ....

A cruel policy in Ohio that banned the legal recognition of transgender people on birth certificates has been declared unconstitutional by a federal judge.
Alongside Tennessee, Ohio is one of only two US states to maintain a policy that prohibits full gender recognition for transgender people, refusing to permit them to correct the gender marker on their birth certificates.
However, in a landmark victory on Wednesday (16 December), a federal judge sided with four transgender plaintiffs who had sued for their right to get accurate documentation.
One of the plaintiffs, Stacie Ray, was outed as transgender at work when she was required to provide her birth certificate for a new job, leading colleagues to refer to her as a “freak” and threaten to beat her up for using women’s bathrooms. ....
