Investigation? right, so one question that a lot of people of asked is why does the government not just execute search warrants to recover anything that is out there in the wild? the problem is, in order to get a search warrant, you have to have probable cause to believe that evidence or fruits of a crime will be found in a specific locations. the fourth amendment requires particularity in the government s evidence and the government has to go to a magistrate judge and say we have this good faith belief. so the idea, the concern that there are documents that are still out there, is not enough. because classified documents, even when you go out and print out a secondary copy, everything is marked. it is very likely that the government knows what government had in its possession, that has not been turned over. but that alone is not enough for a warrant. ....
