And move forward to address what i think are some of the legitimate issues that commissioner rally has raised. Thank you, mr. Chairman. It is a delight to have you back your thank you chairman, Ranking Member distinguished members of the community for thank you for the opportunity to share my perspectives with you this morning and my written testimony for the record i discussed the commissions work. I will focus on spectrum options. In in march 2014 we unanimously adopted a licensing and service rule to option 65 megahertz of spectrum. This was not only important for wireless carriers seeking to be skyrocketing consumer demand but it was critical for the promotion of more competitive options. My colleagues and i agreed on a plan for smaller license blocks and geographic licensed areas. We also agreed on the need for interoperability between the aws one in aws three. The securities participation, promotes competition and ensures th ....

Sir, i sir, i would be happy to get a specific legal response. I think that what the court saying is that the commission is proposing common carrier like Regulation Without stepping up and saying you are a common carrier a common carrier which is what essentially that statement says, i believe. Violating the Communications Act if you are doing these common carriage like requirements without making a finding that that in fact, they are common carriers. The specific order that was put out, was is subject to ordinary notice and comment . Specifically to what was the public able to look at the details and comment on it . There was a full notice and comment preceding longer than average. Was the public able to view the specific details and comment on the specific details of this order before it was adopted . Policy this is good but we also need to give unlicensed services and wifi its proper due. After all, wifi is how we get on line in public and at home. Wifi is also how our wireless carriers managed their networks, in fact today nearly one half of all wireless data connections are at some point offloaded on to unlicensed spectrum. Wifi is how we foster innovation, because the low barriers to entry for unlicensed airwaves make them perfect sandboxes for experimentation. And wifi is a boone to the economy. The Economic Impact of unlicensed activity has been estimated at more than 140 billion annually. By any measure, thats big. So we need to make unlicensed Services Like wifi a priority in our spectrum policy, at the fcc, we are doing just that with our upcoming work. Its going to take more than this to keep up with demand. Thats why i think the time is right to explore greater ....

Disagree with the majority of this panel on the socalled open internet rule. And i appreciate you doing it cheerfully but also forcefully. And i want you to help us understand the reasons that you have given procedurally and substantively under the statute. As to why this decision is violative of requirements and violative of the Communications Act. Senator, thank you for the question. I could go through all 67 pages but ill abbreviate it for the sake of the panel and for everyone watching. In short there are problems with process and substance. My view is the agency failed to comply with the administrative procedure act. In terms of giving public fair notice and an opportunity to comment on the proposal it adopted. Heres the indisputable truth. The fcc never proposed title 2. It adopted a proposal in may of 2014 that was based on section 706. Through the course of the summer it was wide reported that section 706 was the lead ....
