The federal district court in Montana on Tuesday invalidated the federal government’s approval of the first phase of the Rock Creek Mine, a major copper and silver mine proposed beneath the Cabinet Mountains Wilderness in northwest Montana.
The court ruled that the U.S. Fish and Wildlife Service and U.S. Forest Service violated the Endangered Species Act by unlawfully ignoring the impacts of the full mine proposal on federally protected grizzly bears and bull trout. The ruling safeguards the most vulnerable grizzly bear population in the lower 48 states, threatened bull trout, and sacred and aboriginal lands of the Ktunaxa Nation from the mine’s impacts.  ....

BILLINGS, Mont. (AP) A U.S. judge on Wednesday struck down the government’s approval of the first phase of a long-stalled copper and silver mine that would be constructed beneath a northwestern Montana wilderness.
The decision against the Rock Creek Mine near Noxon is the latest in series of legal setbacks for a project first proposed in the late 1980s.
U.S. District Judge Donald Molloy sided with opponents who said an environmental review by federal officials was insufficient because it considered only exploration work and not full-scale mining. ....

BILLINGS, Mont. (AP) - Montana officials conducted an appropriate review before granting a water permit for a proposed silver and copper mine that would run beneath a wilderness area near the Idaho border, the Montana Supreme Court ruled Wednesday.
The 5-2 ruling reversed a lower court decision from 2019 that said officials had failed to adequately consider potential damage to nearby streams from Hecla Mining Co.’s proposed Rock Creek Mine.
The mine beneath the Cabinet Mountains Wilderness near Noxon would employ about 300 people and cover almost 500 acres (202 hectares). ....
